2424 SECTION 1. SHORT TITLE. 3
2525 This Act may be cited as the ‘‘Strengthening En-4
2626 forcement and Criminalizing Unlawful Records Enabling 5
2727 Flights Act’’ or the ‘‘SECURE Flights Act’’. 6

3535 NGENERAL.—The Administrator may not ac-4
3636 cept as valid proof of identification a prohibited identifica-5
3737 tion document at an airport security checkpoint. 6

3939 OTIFICATION TOIMMIGRATIONAGENCIES.—If 7
4040 an individual presents a prohibited identification docu-8
4141 ment to an officer of the Transportation Security Admin-9
4242 istration at an airport security checkpoint, the Adminis-10
4343 trator shall promptly notify the Director of U.S. Immigra-11
4444 tion and Customs Enforcement, the Commissioner of U.S. 12
4545 Customs and Border Protection, and the head of the ap-13
4646 propriate local law enforcement agency to determine 14
4747 whether the individual is in violation of any term of release 15
4848 from the custody of any such agency. 16

5050 NTRYINTOSTERILEAREAS.— 17

5252 N GENERAL.—Except as provided in para-18
5353 graph (2), if an individual is found to be in violation 19
5454 of any term of release under subsection (b), the Ad-20
5555 ministrator shall not permit such individual to enter 21
5656 a sterile area. 22

5858 XCEPTION.—An individual presenting a 23
5959 prohibited identification document under this section 24

6868 SEC. 3. COLLECTION OF BIOMETRIC INFORMATION FROM 5
6969 CERTAIN INDIVIDUALS SEEKING ENTRY INTO 6
7070 THE STERILE AREA OF AN AIRPORT. 7
7171 (a) I
7272 NGENERAL.—Beginning not later than 120 8
7373 days after the date of the enactment of this Act, the Ad-9
7474 ministrator shall collect biometric information from an in-10
7575 dividual described in subsection (b) prior to authorizing 11
7676 such individual to enter into a sterile area. 12
7777 (b) I
7878 NDIVIDUALDESCRIBED.—An individual de-13
7979 scribed in this subsection is an individual who— 14
8080 (1) is seeking entry into the sterile area of an 15
8181 airport; 16
8282 (2) does not present a covered identification 17
8383 document; and 18
8484 (3) the Administrator cannot verify is a na-19
8585 tional of the United States. 20

8787 ARTICIPATION INIDENT.—Beginning not later 21
8888 than 120 days after the date of the enactment of this Act, 22
8989 the Administrator, in coordination with the Secretary of 23

9999 DMINISTRATOR.—The term ‘‘Adminis-5
100100 trator’’ means the Administrator of the Transpor-6
101101 tation Security Administration. 7

103103 IOMETRIC INFORMATION .—The term ‘‘bio-8
104104 metric information’’ means any of the following: 9
105105 (A) A fingerprint. 10
106106 (B) A palm print. 11
107107 (C) A photograph, including— 12
108108 (i) a photograph of an individual’s 13
109109 face for use with facial recognition tech-14
110110 nology; and 15
111111 (ii) a photograph of any physical or 16
112112 anatomical feature, such as a scar, skin 17
113113 mark, or tattoo. 18
114114 (D) A signature. 19
115115 (E) A voice print. 20
116116 (F) An iris image. 21

118118 OVERED IDENTIFICATION DOCUMENT .— 22
119119 The term ‘‘covered identification document’’ means 23
120120 any of the following, if the document is valid and 24

135135 (iv) Free and Secure Trade (FAST). 11
136136 (C) An identification card issued by the 12
137137 Department of Defense, including such a card 13
138138 issued to a dependent. 14
139139 (D) Any document required for admission 15
140140 to the United States under section 211(a) of 16
141141 the Immigration and Nationality Act (8 U.S.C. 17
142142 1181(a)). 18
143143 (E) An enhanced driver’s license issued by 19
144144 a State. 20
145145 (F) A photo identification card issued by a 21
146146 federally recognized Indian Tribe. 22
147147 (G) A personal identity verification creden-23
148148 tial issued in accordance with Homeland Secu-24
149149 rity Presidential Directive 12. 25
