16	16	to be subsequently determined by the Speaker, in each case for consider-
17	17	ation of such provisions as fall within the jurisdiction of the committee
18	18	concerned
19	19	A BILL
20	20	To amend section 70108 of title 46, United States Code,
21	21	to prohibit the Secretary of the Department in which
22	22	the United States Coast Guard is operating from enter-
23	23	ing into an agreement relating to assessing the effective-
24	24	ness of antiterrorism measures at a foreign port with
25	25	any foreign government that is a state sponsor of ter-
26	26	rorism, and for other purposes.
27	27	Be it enacted by the Senate and House of Representa-1
28	28	tives of the United States of America in Congress assembled, 2

32	32	SECTION 1. SHORT TITLE. 1
33	33	This Act may be cited as the ‘‘International Port Se-2
34	34	curity Enforcement Act’’. 3
35	35	SEC. 2. FOREIGN PORT SECURITY ASSESSMENTS. 4
36	36	Section 70108 of title 46, United States Code, is 5
37	37	amended— 6
38	38	(1) in subsection (f)— 7
39	39	(A) in paragraph (1), by striking ‘‘provided 8
40	40	that’’ and all that follows through the end and 9
41	41	inserting the following: ‘‘if— 10
42	42	‘‘(A) the Secretary certifies that the for-11
43	43	eign government or international organization— 12
44	44	‘‘(i) has conducted the assessment in 13
45	45	accordance with subsection (b); and 14
46	46	‘‘(ii) has provided the Secretary with 15
47	47	sufficient information pertaining to its as-16
48	48	sessment (including information regarding 17
49	49	the outcome of the assessment); and 18
50	50	‘‘(B) the foreign government that con-19
51	51	ducted the assessment is not a state sponsor of 20
52	52	terrorism (as defined in section 3316(h)).’’; and 21
53	53	(B) by amending paragraph (3) to read as 22
54	54	follows: 23
55	55	‘‘(3) L
56	56	IMITATIONS.—Nothing in this section 24
57	57	may be construed— 25

61	61	‘‘(A) to require the Secretary to treat an 1
62	62	assessment conducted by a foreign government 2
63	63	or an international organization as an assess-3
64	64	ment that satisfies the requirement under sub-4
65	65	section (a); 5
66	66	‘‘(B) to limit the discretion or ability of the 6
67	67	Secretary to conduct an assessment under this 7
68	68	section; 8
69	69	‘‘(C) to limit the authority of the Secretary 9
70	70	to repatriate aliens to their respective countries 10
71	71	of origin; or 11
72	72	‘‘(D) to prevent the Secretary from re-12
73	73	questing security and safety measures that the 13
74	74	Secretary considers necessary to safeguard 14
75	75	Coast Guard personnel during the repatriation 15
76	76	of aliens to their respective countries of ori-16
77	77	gin.’’; and 17
78	78	(2) by adding at the end the following: 18
79	79	‘‘(g) S
80	80	TATESPONSORS OFTERRORISM AND INTER-19
81	81	NATIONAL TERRORIST ORGANIZATIONS.—The Sec-20
82	82	retary— 21
83	83	‘‘(1) may not enter into an agreement under 22
84	84	subsection (f)(2) with— 23
85	85	‘‘(A) a foreign government that is a state 24
86	86	sponsor of terrorism; or 25

90	90	‘‘(B) a foreign terrorist organization; and 1
91	91	‘‘(2) shall— 2
92	92	‘‘(A) deem any port that is under the juris-3
93	93	diction of a foreign government that is a state 4
94	94	sponsor of terrorism as not having effective 5
95	95	antiterrorism measures for purposes of this sec-6
96	96	tion and section 70109; and 7
97	97	‘‘(B) immediately apply the sanctions de-8
98	98	scribed in section 70110(a) to such port.’’. 9
