17	17	To amend title 38, United States Code, to render an indi-
18	18	vidual, who transfers certain educational assistance, to
19	19	which the individual is entitled because of an agreement
20	20	by such individual to serve in the Armed Forces, to
21	21	a dependent of that individual, and who fails to complete
22	22	such agreement, solely liable for the overpayment of such
23	23	educational assistance, and for other purposes.
24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2

29	29	SECTION 1. SHORT TITLE. 1
30	30	This Act may be cited as the ‘‘Protect Military De-2
31	31	pendents Act’’. 3
32	32	SEC. 2. SOLE LIABILITY FOR TRANSFERRED EDUCATIONAL 4
33	33	ASSISTANCE BY AN INDIVIDUAL WHO FAILS 5
34	34	TO COMPLETE A SERVICE AGREEMENT. 6
35	35	Subsection (i) of section 3319 of title 38, United 7
36	36	States Code, is amended— 8
37	37	(1) in paragraph (1)— 9
38	38	(A) by striking ‘‘In the event’’ and insert-10
39	39	ing ‘‘Subject to paragraph (2), in the event’’; 11
40	40	and 12
41	41	(B) by inserting ‘‘of this title’’ after ‘‘sec-13
42	42	tion 3685’’; 14
43	43	(2) in subparagraph (A) of paragraph (2)— 15
44	44	(A) in the heading, by striking ‘‘I
45	45	N GEN-16
46	46	ERAL’’ and inserting ‘‘SOLE LIABILITY’’; and 17
47	47	(B) by inserting ‘‘for which the individual 18
48	48	shall be solely liable to the United States for 19
49	49	the amount of the overpayment for purposes of 20
50	50	section 3685 of this title’’ before the period at 21
51	51	the end; and 22
52	52	(3) in subparagraph (B) of paragraph (2)— 23
53	53	(A) in the matter preceding clause (i), by 24
54	54	striking ‘‘Subparagraph (A) shall not apply’’ 25
55	55	and inserting ‘‘Neither the individual nor the 26
