15	15	To amend the Food and Nutrition Act of 2008 to provide
16	16	for the reissuance to households supplemental nutrition
17	17	assistance program benefits to replace benefits stolen
18	18	by identity theft or typical skimming practices, and for
19	19	other purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘SNAP Theft Protec-4
24	24	tion Act of 2023’’. 5

29	29	Section 7 of the Food and Nutrition Act of 2008 (7 2
30	30	U.S.C. 2016) is amended— 3
31	31	(1) in subsection (e) by inserting ‘‘or from the 4
32	32	reissuance of benefits stolen by identity theft or typ-5
33	33	ical skimming practices,’’ after ‘‘mail’’, and 6
34	34	(2) in subsection (h)(7)— 7
35	35	(A) by striking ‘‘Regulations’’ and insert-8
36	36	ing the following: 9
37	37	‘‘(A) R
38	38	EPLACEMENT OF BENEFITS .—Reg-10
39	39	ulations’’, and 11
40	40	(B) by adding at end the following: 12
41	41	‘‘(B) R
42	42	EISSUANCE OF STOLEN BENE -13
43	43	FITS.— 14
44	44	‘‘(i) I
45	45	SSUANCE OF REGULATIONS .— 15
46	46	Secretary shall issue regulations— 16
47	47	‘‘(I) to establish criteria for State 17
48	48	agencies to identify supplemental nu-18
49	49	trition assistance program benefits 19
50	50	stolen by identity theft or typical 20
51	51	skimming practices; and 21
52	52	‘‘(II) to provide for the 22
53	53	reissuance to households of benefits 23
54	54	stolen by identity theft, or typical 24
55	55	skimming practices, that meet such 25
56	56	criteria. 26

60	60	‘‘(ii) STATUS REPORT .—Not later 1
61	61	than 240 days after the Secretary issues 2
62	62	regulations under clause (i), the Secretary 3
63	63	shall submit to the Congress a report on 4
64	64	the status of benefits reissued under such 5
65	65	regulations that includes— 6
66	66	‘‘(I) a detailed description of the 7
67	67	prevalence of stolen benefits for which 8
68	68	benefits are reissued under such regu-9
69	69	lations; 10
70	70	‘‘(II) an examination of current 11
71	71	barriers, feasibility, and impact on 12
72	72	participant access and ease of use in 13
73	73	developing an electronic benefit trans-14
74	74	fer card that contains innovative tech-15
75	75	nologies such as an embedded 16
76	76	microchip along with the traditional 17
77	77	magnetic stripe; and 18
78	78	‘‘(III) such other information as 19
79	79	by the Secretary considers to be ap-20
80	80	propriate. 21

82	82	TOLEN BENEFIT REISSUANCE 22
83	83	REPORT.—Not later than 120 days after 23
84	84	end of each fiscal year that begins after 24
85	85	the Secretary issues regulations under 25

90	90	Congress a report for such fiscal year with 2
91	91	respect to each State that includes the ag-3
92	92	gregate value of supplemental nutrition as-4
93	93	sistance program benefits reissued under 5
94	94	such regulations and the number of house-6
95	95	holds to which such benefits were reissued. 7
96	96	‘‘(iv) E
97	97	VALUATION.—To maximize the 8
98	98	accessibility and security of electronic ben-9
99	99	efit transfer cards, the Secretary shall pe-10
100	100	riodically review and modify such regula-11
101	101	tions to take into account evolving tech-12
102	102	nology and the threat landscape to better 13
103	103	protect against benefit theft.’’. 14
