15	15	To amend the Animal Welfare Act to ensure that all dogs
16	16	and cats used by research facilities are obtained legally.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Pet Safety and Protec-4
21	21	tion Act of 2023’’. 5
22	22	SEC. 2. PROTECTION OF PETS. 6
23	23	(a) R
24	24	ESEARCHFACILITIES.—Section 7 of the Animal 7
25	25	Welfare Act (7 U.S.C. 2137) is amended to read as fol-8
26	26	lows: 9

30	30	‘‘SEC. 7. SOURCES OF DOGS AND CATS FOR RESEARCH FA-1

32	32	‘‘(a) D
33	33	EFINITION OFPERSON.—In this section, the 3
34	34	term ‘person’ means any individual, partnership, firm, 4
35	35	joint stock company, corporation, association, trust, es-5
36	36	tate, pound, shelter, or other legal entity. 6
37	37	‘‘(b) U
38	38	SE OFDOGS ANDCATS.—No research facility 7
39	39	or Federal research facility may use a dog or cat for re-8
40	40	search or educational purposes if the dog or cat was ob-9
41	41	tained from a person other than a person described in sub-10
42	42	section (d). 11
43	43	‘‘(c) S
44	44	ELLING, DONATING, OROFFERINGDOGS AND 12
45	45	C
46	46	ATS.—No person, other than a person described in sub-13
47	47	section (d), may sell, donate, or offer a dog or cat to any 14
48	48	research facility or Federal research facility. 15
49	49	‘‘(d) P
50	50	ERMISSIBLESOURCES.—A person from whom 16
51	51	a research facility or a Federal research facility may ob-17
52	52	tain a dog or cat for research or educational purposes 18
53	53	under subsection (b), and a person who may sell, donate, 19
54	54	or offer a dog or cat to a research facility or a Federal 20
55	55	research facility under subsection (c), shall be— 21
56	56	‘‘(1) a dealer licensed under section 3 that has 22
57	57	bred and raised the dog or cat; 23
58	58	‘‘(2) a publicly owned and operated pound or 24
59	59	shelter that— 25
60	60	‘‘(A) is registered with the Secretary; 26

64	64	‘‘(B) is in compliance with section 28(a)(1) 1
65	65	and with the requirements for dealers in sub-2
66	66	sections (b) and (c) of section 28; and 3
67	67	‘‘(C) obtained the dog or cat from its legal 4
68	68	owner, other than a pound or shelter; 5
69	69	‘‘(3) a person that is donating the dog or cat 6
70	70	and that— 7
71	71	‘‘(A) bred and raised the dog or cat; or 8
72	72	‘‘(B) owned the dog or cat for not less 9
73	73	than 1 year immediately preceding the dona-10
74	74	tion; 11
75	75	‘‘(4) a research facility licensed by the Sec-12
76	76	retary; and 13
77	77	‘‘(5) a Federal research facility licensed by the 14
78	78	Secretary. 15
79	79	‘‘(e) P
80	80	ENALTIES.— 16
81	81	‘‘(1) I
82	82	N GENERAL.—A person that violates this 17
83	83	section shall be fined $1,000 for each violation. 18
84	84	‘‘(2) A
85	85	DDITIONAL PENALTY .—A penalty under 19
86	86	this subsection shall be in addition to any other ap-20
87	87	plicable penalty. 21
88	88	‘‘(f) N
89	89	OREQUIREDSALE ORDONATION.—Nothing 22
90	90	in this section requires a pound or shelter to sell, donate, 23
91	91	or offer a dog or cat to a research facility or Federal re-24
92	92	search facility.’’. 25

96	96	(b) FEDERALRESEARCHFACILITIES.—Section 8 of 1
97	97	the Animal Welfare Act (7 U.S.C. 2138) is amended— 2
98	98	(1) by striking ‘‘Sec. 8. No department’’ and 3
99	99	inserting the following: 4
100	100	‘‘SEC. 8. FEDERAL RESEARCH FACILITIES. 5
101	101	‘‘Except as provided in section 7, no department’’; 6
102	102	(2) by striking ‘‘research or experimentation 7
103	103	or’’; and 8
104	104	(3) by striking ‘‘such purposes’’ and inserting 9
105	105	‘‘that purpose’’. 10
106	106	(c) C
107	107	ERTIFICATION.—Section 28(b)(1) of the Animal 11
108	108	Welfare Act (7 U.S.C. 2158(b)(1)) is amended by striking 12
109	109	‘‘individual or entity’’ and inserting ‘‘research facility or 13
110	110	Federal research facility’’. 14
111	111	SEC. 3. EFFECTIVE DATE. 15
112	112	The amendments made by section 2 take effect on 16
113	113	the date that is 90 days after the date of enactment of 17
114	114	this Act. 18
