1818 This Act may be cited as the ‘‘Migrant Processing 4
1919 and Protection Act of 2023’’. 5
2020 SEC. 2. INSPECTION OF APPLICANTS FOR ADMISSION. 6

8888 N GENERAL.—The Secretary of 3
8989 Homeland Security may return to a foreign ter-4
9090 ritory contiguous to the United States any alien 5
9191 arriving on land from that territory (whether or 6
9292 not at a designated port of entry) pending a 7
9393 proceeding under section 240 or review of a de-8
9494 termination under subsection (b)(1)(B)(iii)(III). 9
9595 ‘‘(B) M
9696 ANDATORY RETURN .—If at any 10
9797 time the Secretary of Homeland Security can-11
9898 not— 12
9999 ‘‘(i) comply with its obligations to de-13
100100 tain an alien as required under clauses (ii) 14
101101 and (iii)(IV) of subsection (b)(1)(B) and 15
102102 subsection (b)(2)(A); or 16
103103 ‘‘(ii) remove an alien to a country de-17
104104 scribed in section 208(a)(2)(A), 18
105105 the Secretary of Homeland Security shall, with-19
106106 out exception, including pursuant to parole 20
107107 under section 212(d)(5) and parole or release 21
108108 pursuant to section 236(a), return to a foreign 22
109109 territory contiguous to the United States any 23
110110 alien arriving on land from that territory 24
