PROJECTS AND ACTIVITIES ELIGIBLE FOR ASSIST-1 ANCE. 2 Section 603 of the Federal Water Pollution Control 3 Act (33 U.S.C. 1383) is amended— 4 (1) in subsection (c)— 5 (A) in paragraph (11)(B) by striking 6 ‘‘and’’ at the end; 7 (B) in paragraph (12)(B) by striking the 8 period at the end and inserting ‘‘; and’’; and 9 (C) by adding at the end the following: 10 ‘‘(13) to any qualified nonprofit entity, as de-11 termined by the Administrator, to provide assistance 12 for the construction or acquisition of, or improve-13 ments to, a treatment works, or for any other activ-14 ity described in paragraphs (1) through (10).’’; 15 (2) in subsection (i)(3), by adding at the end 16 the following: 17 ‘‘(E) C ERTAIN ACTIVITIES INELIGIBLE.—A 18 State may not provide additional subsidization 19 under this subsection to a qualified nonprofit 20 entity for assistance described in subsection 21 (c)(13) or to the owner or operator of a pri-22 vately owned treatment works for assistance de-23 scribed in subsection (k).’’; and 24 (3) by adding at the end the following: 25 VerDate Sep 11 2014 03:37 Jan 20, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H250.IH H250 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •HR 250 IH ‘‘(k) SPECIALRULE FORPRIVATELYOWNEDTREAT-1 MENTWORKS.— 2 ‘‘(1) I N GENERAL.—In any fiscal year for which 3 the total amount appropriated to carry out this title 4 exceeds $1,638,826,000, any such amounts appro-5 priated in excess of $1,638,826,000 for such fiscal 6 year may be used to provide financial assistance 7 under this section to the owner or operator of a pri-8 vately owned treatment works for— 9 ‘‘(A) improvements to such privately owned 10 treatment works; 11 ‘‘(B) the construction of, or improvements 12 to, another privately owned treatment works; 13 ‘‘(C) measures to reduce the demand for 14 privately owned treatment works capacity 15 through water conservation, efficiency, or reuse; 16 ‘‘(D) measures to reduce the energy con-17 sumption needs for privately owned treatment 18 works; 19 ‘‘(E) measures to increase the security of 20 privately owned treatment works; and 21 ‘‘(F) any other activity described in para-22 graphs (1) through (10) of subsection (c). 23 ‘‘(2) L IMITATION.—Financial assistance may 24 only be provided under this subsection to the owner 25 VerDate Sep 11 2014 03:37 Jan 20, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H250.IH H250 pbinns on DSKJLVW7X2PROD with $$_JOB 4 •HR 250 IH or operator of a privately owned treatment works for 1 activities described in paragraph (1) that primarily 2 and directly benefit the individuals or entities served 3 by the privately owned treatment works, and not the 4 shareholders or owners of the treatment works, as 5 determined by the instrumentality of the State re-6 sponsible for administering the water pollution con-7 trol revolving fund through which such financial as-8 sistance is provided.’’. 9 Æ VerDate Sep 11 2014 03:37 Jan 20, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H250.IH H250 pbinns on DSKJLVW7X2PROD with $$_JOB
