20	20	To create a point of order against spending that will increase
21	21	inflation unless inflation is not greater than 4.5 percent,
22	22	and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Inflation Prevention 4
27	27	Act of 2023’’. 5

31	31	SEC. 2. POINT OF ORDER AGAINST SPENDING THAT WILL 1
32	32	INCREASE INFLATION UNTIL INFLATION IS 2
33	33	NOT GREATER THAN 4.5 PERCENT. 3

35	35	OINT OFORDER IN THESENATE.— 4
36	36	(1) I
37	37	N GENERAL.—In the Senate, it shall not be 5
38	38	in order to consider a provision in a bill, joint resolu-6
39	39	tion, motion, amendment, amendment between the 7
40	40	Houses, or conference report that provides new 8
41	41	budget authority and that is estimated to result in 9
42	42	an increase in the Consumer Price Index for All 10
43	43	Urban Consumers, as published by the Bureau of 11
44	44	Labor Statistics, unless the annualized rate of in-12
45	45	crease in the Consumer Price Index for All Urban 13
46	46	Consumers most recently published by the Bureau of 14
47	47	Labor Statistics is not more than 4.5 percent. 15
48	48	(2) P
49	49	OINT OF ORDER SUSTAINED .—If a point 16
50	50	of order is made by a Senator against a provision 17
51	51	described in paragraph (1), and the point of order 18
52	52	is sustained by the Chair, that provision shall be 19
53	53	stricken from the measure and may not be offered 20
54	54	as an amendment from the floor. 21

56	56	ORM OF THE POINT OF ORDER .—A point 22
57	57	of order under subsection (a)(1) may be raised by a 23
58	58	Senator as provided in section 313(e) of the Con-24
59	59	gressional Budget Act of 1974 (2 U.S.C. 644(e)). 25

63	63	(4) CONFERENCE REPORTS .—When the Senate 1
64	64	is considering a conference report on, or an amend-2
65	65	ment between the Houses in relation to, a bill or 3
66	66	joint resolution, upon a point of order being made 4
67	67	by any Senator pursuant to subsection (a)(1), and 5
68	68	such point of order being sustained, such material 6
69	69	contained in such conference report or House 7
70	70	amendment shall be stricken, and the Senate shall 8
71	71	proceed to consider the question of whether the Sen-9
72	72	ate shall recede from its amendment and concur 10
73	73	with a further amendment, or concur in the House 11
74	74	amendment with a further amendment, as the case 12
75	75	may be, which further amendment shall consist of 13
76	76	only that portion of the conference report or House 14
77	77	amendment, as the case may be, not so stricken. 15
78	78	Any such motion in the Senate shall be debatable. 16
79	79	In any case in which such point of order is sustained 17
80	80	against a conference report (or Senate amendment 18
81	81	derived from such conference report by operation of 19
82	82	this paragraph), no further amendment shall be in 20
83	83	order. 21

85	85	UPERMAJORITY WAIVER AND APPEAL .—In 22
86	86	the Senate, this subsection may be waived or sus-23
87	87	pended only by an affirmative vote of three-fifths of 24
88	88	the Members, duly chose and sworn. An affirmative 25

111	111	ROVISION OF ESTIMATES .—Upon request 17
112	112	by a Member of Congress, the Congressional Budget 18
113	113	Office shall prepare an estimate of the effect on the 19
114	114	Consumer Price Index for All Urban Consumers of 20
115	115	the provisions in a bill, joint resolution, motion, 21
116	116	amendment, amendment between the Houses, or 22
117	117	conference report that provide new budget authority. 23

119	119	N GENERAL.—The estimated amount of 24
120	120	the increase in the Consumer Price Index for All 25

129	129	NGENERAL.—The Congressional Budget Office 5
130	130	shall notify Congress if the annualized rate of increase in 6
131	131	the Consumer Price Index for All Urban Consumers is 7
132	132	greater than 4.5 percent. 8

134	134	UBMISSION.—The Congressional Budget Office 9
135	135	may submit the certification required under subsection (a) 10
136	136	as part of another report required to be submitted to Con-11
