2626 This Act may be cited as the ‘‘Article I Regulatory 4

3131 SEC. 2. PRESIDENT’S ANNUAL BUDGET SUBMISSIONS. 1
3232 Section 1105(a) of title 31, United States Code, is 2
3333 amended by adding at the end the following: 3
3434 ‘‘(40)(A) for the first fiscal year that begins at 4
3535 least 120 days after the date of enactment of this 5
3636 paragraph, and every fiscal year thereafter until the 6
3737 fifth fiscal year that begins after the date of enact-7
3838 ment of this paragraph, a projection of the Federal 8
3939 regulatory cost of any proposed Federal regulation, 9
4040 rule, or statement (as such terms are defined in sec-10
4141 tion 321 of the Congressional Budget Act of 1974) 11
4242 for the fiscal year and at least each of the 4 ensuing 12
4343 fiscal years, which shall include— 13
4444 ‘‘(i) the projection of the Federal regu-14
4545 latory cost by agency and program; and 15
4646 ‘‘(ii) any changes in a Federal regulation, 16
4747 rule, or statement in the Unified Agenda of 17
4848 Federal Regulatory and Deregulatory Actions, 18
4949 compiled by the Regulatory Information Service 19

5252 ‘‘(B) for the fifth fiscal year that begins after 22
5353 the date of enactment of this paragraph, and every 23
5454 fiscal year thereafter, a regulatory authority budget 24

131131 an initial regulatory flexibility analysis under chapter 6 15
132132 of title 5, United States Code, shall, at the same time sub-16
133133 mit to each House of Congress, the Congressional Budget 17
134134 Office, and the Office of Management and Budget a cost 18
135135 estimate and cost benefit analysis of any new proposed 19
136136 regulations, rules, or statements that would have a Fed-20
137137 eral regulatory cost (as defined in section 321 of the Con-21
138138 gressional Budget Act of 1974, as added by this Act) of 22
139139 at least $100,000,000 for any fiscal year. 23
140140 SEC. 4. GUIDANCE DOCUMENTS. 24

147147 meanings given such terms in section 551 of title 5, 2

149149 (2) the term ‘‘guidance document’’ means an 4
150150 agency statement of general applicability and future 5
151151 effect, other than a rule, that sets forth a policy on 6
152152 a statutory, regulatory, or technical issue or an in-7
153153 terpretation of a statutory or regulatory issue; and 8
154154 (3) the term ‘‘significant guidance document’’— 9
155155 (A) means a guidance document that the 10
156156 Office of Management and Budget determines 11
157157 will be disseminated to regulated entities or the 12
158158 general public and may reasonably be antici-13
159159 pated to— 14
160160 (i) lead to an annual effect of not less 15
161161 than $100,000,000 on, or adversely affect 16
162162 in a material way, the economy, a sector of 17
163163 the economy, productivity, competition, 18
164164 jobs, the environment, public health or 19
165165 safety, or State, local, or tribal govern-20
166166 ments or communities; 21
167167 (ii) create a serious inconsistency or 22
168168 otherwise interfere with an action taken or 23
169169 planned by an agency other than the agen-24
170170 cy issuing the guidance document; 25

187187 (i) relates to regulations issued in ac-14

214214 RIVATERIGHT OFACTION.—Any person ag-11
215215 grieved of an action taken or failed to be taken under a 12
216216 guidance document that was not issued in accordance with 13
217217 subsection (b) may bring a civil action in an appropriate 14
218218 district court of the United States alleging that the guid-15
219219 ance document should have been treated as a significant 16
220220 guidance document. 17

363363 after the date of enactment of this section, the 11
364364 appropriate level for the Federal regulatory cost 12
365365 for the fiscal year shall be the amount of the 13
366366 first regulatory baseline submitted under sec-14
367367 tion 326; and 15
368368 ‘‘(C) for each fiscal year after the fiscal 16
369369 year described in subparagraph (B), the appro-17
370370 priate level for the Federal regulatory cost for 18
371371 the fiscal year shall be the level for the most re-19
372372 cent fiscal year for which such a level was in ef-20
373373 fect (under subparagraph (B), this subpara-21
374374 graph, or a concurrent resolution on the budg-22
375375 et). 23

384384 the joint explanatory statement accompanying the 4
385385 conference report on a concurrent resolution on the 5
386386 budget for such fiscal year shall include allocations 6
387387 of the Federal regulatory cost in effect under sub-7
388388 section (a) for such fiscal year and at least each of 8
389389 the 4 ensuing fiscal years— 9
390390 ‘‘(A) among each committee of the Senate 10
391391 and each committee of the House of Represent-11
392392 atives; 12
393393 ‘‘(B) by major functional category; and 13
394394 ‘‘(C) by agency. 14
395395 ‘‘(2) S
396396 UBALLOCATIONS.—As soon as practicable 15
397397 after receiving an allocation under paragraph (1), 16
398398 each committee shall— 17
399399 ‘‘(A) suballocate its allocation— 18
400400 ‘‘(i) among its subcommittees; 19
401401 ‘‘(ii) among programs over which the 20
402402 committee has jurisdiction; and 21
403403 ‘‘(iii) by agency; and 22
404404 ‘‘(B) submit for printing in the Congres-23
405405 sional Record a statement detailing each sub-24

414414 N GENERAL.—If a concurrent resolution 4
415415 on the budget setting forth the appropriate level for 5
416416 the Federal regulatory cost for a fiscal year has been 6
417417 agreed to, it shall not be in order in the Senate or 7
418418 the House of Representatives to consider any bill or 8
419419 resolution, or amendment thereto, which would cause 9
420420 an allocation or suballocation of the Federal regu-10
421421 latory cost made under subsection (b) for that fiscal 11
422422 year to be exceeded. 12
423423 ‘‘(2) W
424424 AIVER AND APPEAL.—A point of order 13
425425 under paragraph (1) may only be waived by the af-14
426426 firmative vote of three-fifths of the Members, duly 15
427427 chosen and sworn. An affirmative vote of three-fifths 16
428428 of Members, duly chosen and sworn, shall be re-17

433433 ETERMINATIONS BY BUDGETCOMMITTEES.— 21
434434 For purposes of this section, the amount of the Federal 22
435435 regulatory cost for a fiscal year and the amount of the 23
436436 Federal regulatory cost of a bill or resolution, or amend-24
437437 ment thereto, shall be determined by the Committee on 25

443443 ‘‘SEC. 323. ANALYSIS OF FEDERAL REGULATORY COST BY 3
444444 CONGRESSIONAL BUDGET OFFICE. 4
445445 ‘‘(a) I
446446 NGENERAL.—CBO shall prepare for each bill 5
447447 or resolution of a public character reported by any com-6
448448 mittee of the Senate or the House of Representatives (ex-7
449449 cept the Committee on Appropriations of each House), 8
450450 and submit to such committee— 9
451451 ‘‘(1) an estimate of the costs which would be in-10
452452 curred by the private sector in carrying out or com-11
453453 plying with such bill or resolution in the fiscal year 12
454454 in which it is to become effective and in each of the 13
455455 4 fiscal years following such fiscal year, which shall 14
456456 include— 15
457457 ‘‘(A) a net present value estimate of the 16

548548 shall incorporate any reduction to the level or alloca-16
549549 tion of the Federal regulatory cost attributable to a 17
550550 revision of a Federal regulation, rule, or statement 18

571571 to enforce a newly promulgated, or amendment to a, Fed-10
572572 eral regulation, rule, or statement during a fiscal year if— 11
573573 ‘‘(1) the OMB determines that change in the 12
574574 Federal regulatory cost attributable to the newly 13
575575 promulgated, or amendment to a, Federal regula-14
576576 tion, rule, or statement, as determined by the Bu-15
577577 reau of Economic Analysis under subsection (c)(1), 16
578578 would cause a breach of any level or allocation of the 17
579579 Federal regulatory cost in effect for the fiscal year; 18
580580 and 19
581581 ‘‘(2) the appropriation Act making the applica-20
582582 ble appropriations for the fiscal year contains a pro-21
583583 vision described in subsection (a). 22

586586 tions under this section with respect to a newly promul-24
587587 gated, or amendment to a, Federal regulation, rule, or 25

598598 RIVATERIGHT OFACTION.—Any person ag-7
599599 grieved of an action taken or failed to be taken under a 8
600600 Federal regulation, rule, or statement for which the OMB 9
601601 has issued a directive prohibiting enforcement under sub-10
602602 section (d) may bring a civil action in an appropriate dis-11
603603 trict court of the United States alleging that the Federal 12
604604 regulation, rule, or statement should not have been en-13
605605 forced. 14
606606 ‘‘SEC. 325. OMB–CBO REPORTS. 15
607607 ‘‘Not later than 5 years after the date of enactment 16
608608 of this section, and not later than September 15th of each 17
609609 odd-numbered year thereafter, OMB and CBO shall joint-18
