2929 (a) I
3030 NGENERAL.—Except as provided by subsection 4
3131 (c), an action described in subsection (b) shall be— 5
3232 (1) treated as a covered project, as defined in 6
3333 section 41001(6) of the FAST Act (42 U.S.C. 7
3434 4370m(6)), without regard to the requirements of 8
3535 that section; and 9
3636 (2) included in the Permitting Dashboard main-10
3737 tained pursuant to section 41003(b) of that Act (42 11
3838 13 U.S.C. 4370m–2(b)). 12

4040 CTIONSDESCRIBED.—An action described in 13
4141 this subsection is an action taken by the Secretary of De-14
4242 fense pursuant to Presidential Determination 2022–11 15
4343 (87 Fed. Reg. 19775; relating to certain actions under 16
4444 section 303 of the Defense Production Act of 1950) or 17
4545 the Presidential Memorandum of February 27, 2023, ti-18
4646 tled ‘‘Presidential Waiver of Statutory Requirements Pur-19
4747 suant to Section 303 of the Defense Production Act of 20
4848 1950, as amended, on Department of Defense Supply 21
4949 Chains Resilience’’ (88 Fed. Reg. 13015) to create, main-22
5050 tain, protect, expand, or restore sustainable and respon-23
5151 sible domestic production capabilities through— 24

5656 mining, beneficiation, and value-added processing 2

5858 (2) byproduct and co-product production at ex-4
5959 isting mining, mine waste reclamation, and other in-5

6161 (3) modernization of mining, beneficiation, and 7
6262 value-added processing to increase productivity, envi-8
6363 ronmental sustainability, and workforce safety; or 9
6464 (4) any other activity authorized under section 10
6565 303(a)(1) of the Defense Production Act of 1950 11
6666 (50 U.S.C. 4533(a)(1)). 12

6868 XCEPTION.—An action described in subsection 13
6969 (b) may not be treated as a covered project or be included 14
7070 in the Permitting Dashboard under subsection (a) if the 15
7171 project sponsor (as defined in section 41001(18) of the 16
7272 FAST Act (42 U.S.C. 4370m(18))) requests that the ac-17
7373 tion not be treated as a covered project. 18
