of Federal red flag orders.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Preventing Unjust Red 4
Flag Laws Act of 2023’’. 5

SEC. 2. PROHIBITION ON FUNDING FOR IMPLEMENTATION 1
AND ENFORCEMENT OF RED FLAG LAWS OR 2
RULES. 3
(a) P
ROHIBITION ONFUNDING.—None of the funds 4
made available for any Federal department or agency may 5
be used to— 6
(1) implement or enforce Federal red flag laws; 7
or 8
(2) provide assistance to States, local, tribal, or 9
territorial government departments or agencies for 10
the implementation or enforcement of red flag laws. 11

EDFLAGLAWDEFINED.—In this section, the 12
term ‘‘red flag law’’ means a risk-based, temporary, and 13
preemptive protective order that authorizes the removal of 14
a firearm without due process. 15
