18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Protect Our Water 4
20	20	Rights Act’’. 5
21	21	SEC. 2. ALLOCATIONS FOR SACRAMENTO VALLEY CON-6
22	22	TRACTORS. 7

30	30	(A) IN GENERAL.—The Secretary of the 1
31	31	Interior, acting through the Bureau of Rec-2
32	32	lamation (in this Act, referred to as the ‘‘Sec-3
33	33	retary’’) is directed, in the operation of the 4
34	34	Central Valley Project, to allocate water pro-5
35	35	vided for irrigation purposes to existing Central 6
36	36	Valley Project agricultural water service con-7
37	37	tractors within the Sacramento River Water-8
38	38	shed in compliance with the following: 9
39	39	(i) Not less than 100 percent of their 10
40	40	contract quantities in a ‘‘Wet’’ year. 11
41	41	(ii) Not less than 100 percent of their 12
42	42	contract quantities in an ‘‘Above Normal’’ 13
43	43	year. 14
44	44	(iii) Not less than 75 percent of their 15
45	45	contract quantities in a ‘‘Below Normal’’ 16
46	46	year. 17
47	47	(iv) Not less than 50 percent of their 18
48	48	contract quantities in a ‘‘Dry’’ year. 19
49	49	(v) Not less than 50 percent of their 20
50	50	contract quantities in a ‘‘Critically Dry’’ 21

52	52	(vi) In all years not identified in sub-23
53	53	paragraphs (A) through (E), the allocation 24
54	54	percentage for existing Central Valley 25

67	67	type terms used in subparagraph (A) have the 9
68	68	meaning given those year types in the Sac-10
69	69	ramento Valley Water Year Type (40–30–30) 11

72	72	ONDITIONS.—The Secretary’s actions 13
73	73	under paragraph (1) shall be subject to— 14
74	74	(A) the priority of individuals or entities 15
75	75	with Sacramento River water rights, including 16
76	76	those with Sacramento River Settlement Con-17
77	77	tracts, that have priority to the diversion and 18
78	78	use of Sacramento River water over water 19
79	79	rights held by the United States for operations 20
80	80	of the Central Valley Project; 21
81	81	(B) the United States obligation to make 22
82	82	a substitute supply of water available to the 23
83	83	San Joaquin River Exchange Contractors; and 24

89	89	to section 3406(d) of the Central Valley Project 3
90	90	Improvement Act, (Public Law 102–575). 4

92	92	ROTECTION OF MUNICIPAL ANDINDUSTRIAL 5

94	94	UPPLIES.—Nothing in subsection (a) shall be deemed 6
95	95	to— 7
96	96	(1) modify any provision of a water service con-8
97	97	tract that addresses municipal and industrial water 9
98	98	shortage policies of the Secretary; 10
99	99	(2) affect or limit the authority of the Secretary 11
100	100	to adopt or modify municipal and industrial water 12
101	101	shortage policies; 13
102	102	(3) affect or limit the authority of the Secretary 14
103	103	to implement municipal and industrial water short-15
104	104	age policies; or 16
105	105	(4) affect allocations to Central Valley Project 17
106	106	municipal and industrial contractors pursuant to 18
107	107	such policies. 19
108	108	(c) P
109	109	ROTECTION OF OPERATIONS AND DELIV-20
110	110	ERIES.—Nothing in subsection (a) or the Secretary’s im-21
111	111	plementation of subsection (a) shall constrain, govern, or 22
112	112	affect, directly or indirectly, the operations of the Central 23
113	113	Valley Project’s American River Division or any deliveries 24
114	114	from that Division, its units or facilities. 25

118	118	(d) NOEFFECT ONALLOCATIONS.—Nothing in sub-1
119	119	section (a) shall— 2
120	120	(1) affect the allocation of water to Friant Divi-3
121	121	sion contractors; or 4
122	122	(2) result in the involuntary reduction in con-5
123	123	tract water allocations to individuals or entities with 6
124	124	contracts to receive water from the Friant Division. 7

126	126	ERMDEFINED.—In this section, the term ‘‘ex-8
127	127	isting Central Valley Project agricultural water service 9
128	128	contractors within the Sacramento River Watershed’’ 10
129	129	means water service contractors within the Shasta, Trin-11
130	130	ity, and Sacramento River Divisions of the Central Valley 12
131	131	Project, that have a water service contract in effect, on 13
132	132	the date of the enactment of this section, that provides 14
133	133	water for irrigation. 15
134	134	SEC. 3. ANNUAL ALLOCATION FIELD BRIEFINGS. 16
135	135	The Secretary shall hold not less than 1 in-person 17
136	136	field hearing each county where a Central Valley Project 18
137	137	water service contractor is located during the period that 19
138	138	is after the initial water allocations for the Central Valley 20
139	139	Project and before the final water allocation announce-21
140	140	ment for the Central Valley Project. 22

144	144	SEC. 4. ADJUSTMENT OF COST REQUIREMENTS. 1
145	145	The operation and maintenance costs required to be 2
146	146	paid by Central Valley Project water contractors and the 3
147	147	Bureau of Reclamation shall be reversed, such that— 4
148	148	(1) the allocation percentage obligation held by 5
149	149	the Bureau of Reclamation on the day before the 6
150	150	date of the enactment of this Act shall be held by 7
151	151	Central Valley Project water contractors; and 8
152	152	(2) the allocation percentage obligation held by 9
153	153	the Central Valley Project water contractors on the 10
154	154	day before the date of the enactment of this Act 11
155	155	shall be held by the Bureau of Reclamation. 12
156	156	SEC. 5. REPORT. 13
157	157	Not later than 1 year after the date of the enactment 14
158	158	of this Act, the Secretary shall submit to Congress a re-15
159	159	port that includes an account of amounts that irrigation 16
160	160	districts and water user associations contracted with the 17
161	161	Bureau of Reclamation for agricultural water deliveries 18
162	162	owe to the Bureau of Reclamation related to debt incurred 19
163	163	for construction of facilities and other aspects of the 20
164	164	Klamath River Basin Reclamation Project. 21
165	165	SEC. 6. WATER OPERATIONS IN UPPER KLAMATH LAKE. 22
166	166	When operating the Klamath River Basin Reclama-23
167	167	tion Project, the Secretary, in accordance with State-adju-24
168	168	dicated water rights, shall— 25
