Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SUSPENSION OF ENTRY OF ALIENS. 1 (a) A UTHORITYTOSUSPENDENTRY OFALIENS AT 2 B ORDERS OF THE UNITEDSTATES.—Notwithstanding 3 any other provision of law, if the Secretary of Homeland 4 Security determines, in his discretion, that the suspension 5 of the entry of covered aliens at an international land or 6 maritime border of the United States is necessary in order 7 to achieve operational control over such border, the Sec-8 retary may prohibit, in whole or in part, the entry of cov-9 ered aliens at such border for such period of time as the 10 Secretary determines is necessary for such purpose. 11 (b) R EQUIREDSUSPENSION OFENTRY OFALIENS.— 12 Notwithstanding any other provision of law, the Secretary 13 of Homeland Security shall prohibit the entry of covered 14 aliens for any period during which the Secretary cannot— 15 (1) detain such covered aliens as required under 16 section 235(b)(1)(B) of the Immigration and Na-17 tionality Act (8 U.S.C. 1225(b)(1)(B)); or 18 (2) place such covered aliens in a program con-19 sistent with section 235(b)(2)(C) of the Immigration 20 and Nationality Act (8 U.S.C. 1225(b)(2)(C)). 21 (c) E NFORCEMENT BY STATEATTORNEYSGEN-22 ERAL.—The attorney general of a State, or other author-23 ized State officer, alleging a violation of a subsection (b) 24 that affects such State or its residents, may bring an ac-25 tion against the Secretary of Homeland Security on behalf 26 VerDate Sep 11 2014 22:57 Jan 11, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H29.IH H29 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •HR 29 IH of the residents of the State in an appropriate United 1 States district court to obtain appropriate injunctive relief. 2 (d) D EFINITIONS.—In this section: 3 (1) Except as otherwise provided, the terms 4 have the meanings given such terms in section 101 5 of the Immigration and Nationality Act (8 U.S.C. 6 1101). 7 (2) The term ‘‘covered alien’’ means an alien 8 seeking entry to the United States who is inadmis-9 sible under section 212(a)(7) of the Immigration 10 and Nationality Act (8 U.S.C. 1182(a)(7)). 11 (3) The term ‘‘operational control’’ has the 12 meaning given such term in section 2 of the Secure 13 Fence Act of 2006 (8 U.S.C. 1701 note). 14 Æ VerDate Sep 11 2014 22:57 Jan 11, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H29.IH H29 pbinns on DSKJLVW7X2PROD with $$_JOB
