3434 This Act may be cited as the ‘‘Border Safety and Se-4
3535 curity Act of 2023’’. 5

4343 ORDERS OF THE UNITEDSTATES.—Notwithstanding 3
4444 any other provision of law, if the Secretary of Homeland 4
4545 Security determines, in his discretion, that the suspension 5
4646 of the entry of covered aliens at an international land or 6
4747 maritime border of the United States is necessary in order 7
4848 to achieve operational control over such border, the Sec-8
4949 retary may prohibit, in whole or in part, the entry of cov-9
5050 ered aliens at such border for such period of time as the 10
5151 Secretary determines is necessary for such purpose. 11

5353 EQUIREDSUSPENSION OFENTRY OFALIENS.— 12
5454 Notwithstanding any other provision of law, the Secretary 13
5555 of Homeland Security shall prohibit the entry of covered 14
5656 aliens for any period during which the Secretary cannot— 15
5757 (1) detain such covered aliens as required under 16
5858 section 235(b)(1)(B) of the Immigration and Na-17
5959 tionality Act (8 U.S.C. 1225(b)(1)(B)); or 18
6060 (2) place such covered aliens in a program con-19
6161 sistent with section 235(b)(2)(C) of the Immigration 20
6262 and Nationality Act (8 U.S.C. 1225(b)(2)(C)). 21

7575 EFINITIONS.—In this section: 3
7676 (1) Except as otherwise provided, the terms 4
7777 have the meanings given such terms in section 101 5
7878 of the Immigration and Nationality Act (8 U.S.C. 6
7979 1101). 7
8080 (2) The term ‘‘covered alien’’ means an alien 8
8181 seeking entry to the United States who is inadmis-9
8282 sible under section 212(a)(7) of the Immigration 10
8383 and Nationality Act (8 U.S.C. 1182(a)(7)). 11
8484 (3) The term ‘‘operational control’’ has the 12
8585 meaning given such term in section 2 of the Secure 13
8686 Fence Act of 2006 (8 U.S.C. 1701 note). 14
