16-Section 10101 of the Omnibus Budget Reconciliation 6
17-Act of 1993 (30 U.S.C. 28f) is amended by adding at the 7
18-end the following: 8

39+Section 10101 of the Omnibus Budget Reconciliation 8
40+Act of 1993 (30 U.S.C. 28f) is amended by adding at the 9

24-EFINITION OF OPERATIONS .—In 11
25-this paragraph, the term ‘operations’ means— 12
26-‘‘(i) with respect to a locatable min-13
27-eral, any activity or work carried out in 14
28-connection with— 15
29-‘‘(I) prospecting; 16
30-‘‘(II) exploration; 17
31-‘‘(III) discovery and assessment; 18
32-‘‘(IV) development; 19
33-‘‘(V) extraction; or 20
34-‘‘(VI) processing; 21
35-‘‘(ii) the reclamation of an area dis-22
36-turbed by an activity described in clause 23
37-(i); and 24
38-‘‘(iii) any activity reasonably incident 25
39-to an activity described in clause (i) or (ii), 26 3

41-regardless of whether that incidental activ-1
42-ity is carried out on a mining claim, in-2
43-cluding the construction and maintenance 3
44-of any road, transmission line, pipeline, or 4
45-any other necessary infrastructure or 5

47+EFINITION OF OPERATIONS.—In this 13
48+paragraph, the term ‘operations’ means— 14
49+‘‘(i) with respect to a locatable min-15

61+‘‘(ii) the reclamation of an area dis-1
62+turbed by an activity described in clause 2
63+(i); and 3
64+‘‘(iii) any activity reasonably incident 4
65+to an activity described in clause (i) or (ii), 5
66+regardless of whether that incidental activ-6
67+ity is carried out on a mining claim, in-7
68+cluding the construction and maintenance 8
69+of any road, transmission line, pipeline, or 9
70+any other necessary infrastructure or means 10
71+of access on public land for a support facil-11
72+ity. 12

49-IGHTS TO USE, OCCUPATION, AND 8
50-OPERATIONS.—A claimant shall have the right 9
51-to use and occupy to conduct operations on 10
52-public land, with or without the discovery of a 11
53-valuable mineral deposit, if— 12
54-‘‘(i) the claimant makes a timely pay-13
55-ment of— 14
56-‘‘(I) the location fee required by 15
57-section 10102; and 16
58-‘‘(II) the claim maintenance fee 17
59-required by subsection (a); or 18
60-‘‘(ii) in the case of a claimant who 19
61-qualifies for a waiver of the claim mainte-20
62-nance fee under subsection (d)— 21
63-‘‘(I) the claimant makes a timely 22
64-payment of the location fee required 23
65-by section 10102; and 24 4

67-‘‘(II) the claimant complies with 1
68-the required assessment work under 2
69-the general mining laws. 3

75+ERATIONS.—A claimant shall have the right to 14
76+use and occupy to conduct operations on public 15
77+land, with or without the discovery of a valuable 16
78+mineral deposit, if— 17
79+‘‘(i) the claimant makes a timely pay-18
80+ment of— 19
81+‘‘(I) the location fee required by 20
82+section 10102; and 21
83+‘‘(II) the claim maintenance fee 22
84+required by subsection (a); or 23

89+qualifies for a waiver of the claim mainte-2

94+‘‘(II) the claimant complies with 7
95+the required assessment work under the 8

71-ULFILLMENT OF FEDERAL LAND POLICY 4
72-AND MANAGEMENT ACT OF 1976 .—A claimant that 5
73-fulfills the requirements of this section and section 6
74-10102 shall be deemed to satisfy any requirements 7
75-under the Federal Land Policy and Management Act 8
76-of 1976 (43 U.S.C. 1701 et seq.) for the payment 9
77-of fair market value to the United States for the use 10
78-of public land and resources pursuant to the general 11
79-mining laws. 12
98+ULFILLMENT OF FEDERAL LAND POLICY 10
99+AND MANAGEMENT ACT OF 1976 .—A claimant that ful-11
100+fills the requirements of this section and section 10102 12
101+shall be deemed to satisfy any requirements under the 13
102+Federal Land Policy and Management Act of 1976 14
103+(43 U.S.C. 1701 et seq.) for the payment of fair mar-15
104+ket value to the United States for the use of public 16
105+land and resources pursuant to the general mining 17
106+laws. 18

81-AVINGS CLAUSE.—Nothing in this sub-13
82-section— 14
83-‘‘(A) diminishes any right (including a 15
84-right of entry, use, or occupancy) of a claimant; 16
85-‘‘(B) creates or increases any right (includ-17
86-ing a right of exploration, entry, use, or occu-18
87-pancy) of a claimant on lands that are not open 19
88-to location under the general mining laws; 20
89-‘‘(C) modifies any provision of law or any 21
90-prior administrative action withdrawing lands 22
91-from location or entry; 23
92-‘‘(D) limits the right of the Federal Gov-24
93-ernment to regulate mining and mining-related 25 5

95-activities (including requiring claim validity ex-1
96-aminations to establish the discovery of a valu-2
97-able mineral deposit) in areas withdrawn from 3
98-mining (including under— 4
99-‘‘(i) the general mining laws; 5
100-‘‘(ii) the Federal Land Policy and 6
101-Management Act of 1976 (43 U.S.C. 1701 7
102-et seq.); 8
103-‘‘(iii) the Wilderness Act (16 U.S.C. 9
104-1131 et seq.); 10
105-‘‘(iv) sections 100731 through 100737 11
106-of title 54, United States Code (commonly 12
107-referred to as the ‘Mining in the Parks 13
108-Act’); 14
109-‘‘(v) the Endangered Species Act of 15
110-1973 (16 U.S.C. 1531 et seq.); or 16
111-‘‘(vi) division A of subtitle III of title 17
112-54, United States Code (commonly re-18
113-ferred to as the ‘National Historic Preser-19
114-vation Act’)); or 20
115-‘‘(E) restores any right (including a right 21
116-of entry, use, or occupancy, or right to conduct 22
117-operations) of a claimant that existed prior to 23
118-the date that the lands were closed to or with-24
119-drawn from location under the general mining 25 6
