Election Mail Act

Impact

By introducing a uniform deadline for accepting mailed ballots, HB2987 modifies how states handle mail-in voting. It stipulates that ballots should be accepted if postmarked by the election date and received within a seven-day window post-election. This uniform approach can potentially alleviate confusion regarding state-specific regulations, fostering a more inclusive electoral process. Additionally, the bill directs election officials to use intelligent mail barcodes, ensuring better tracking and visibility of ballots, which can enhance transparency and reliability in election outcomes.

Summary

House Bill 2987, known as the Election Mail Act, proposes various amendments to the United States Code to enhance the efficiency and reliability of election mail. The bill mandates that the United States Postal Service (USPS) ensures same-day processing of all ballots received at its facilities. This stipulation aims to streamline the voting process and increase voter confidence in the electoral system, especially for mail-in ballots commonly used in federal elections. By emphasizing the need for timely ballot processing, the bill addresses perennial concerns regarding delays that can disenfranchise voters.

Contention

Critics of the bill may raise points about the reliability of mail delivery services and the implications of increased reliance on mail-in ballots. Some lawmakers and voting rights advocates express concerns that the bill does not sufficiently address systemic issues related to mail service vulnerabilities, particularly in rural and underserved communities. Additionally, they argue that while the intent of improving ballot tracking and access is commendable, the actual implementation may encounter roadblocks, including operational disruptions within the USPS that could hinder timely ballot delivery.

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. The bill declares that the right of a U.S. citizen to vote in any election for federal office shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. The bill establishes certain federal criminal offenses related to voting. In particular, the bill establishes a new criminal offense for conduct (or attempted conduct) to corruptly hinder, interfere with, or prevent another person from registering to vote or helping someone register to vote. Additionally, the bill sets forth provisions related to election security, including by requiring states to conduct post-election audits for federal elections. The bill outlines criteria for congressional redistricting and generally prohibits mid-decade redistricting. The bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosure of campaign-related fundraising and spending, requiring additional disclaimers regarding certain political advertising, and establishing an alternative campaign funding system for certain federal offices.
