To amend title 11 of the United States Code to stop abusive 
student loan collection practices in bankruptcy cases. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Stopping Abusive Stu-4
dent Loan Collection Practices in Bankruptcy Act of 5
2023’’. 6
SEC. 2. AMENDMENT. 7
Section 523(d) of title 11 of the United States Code 8
is amended by striking ‘‘of this section’’ and inserting ‘‘or 9
the debtor requests a determination of the dischargeability 10

SEC. 3. EFFECTIVE DATE; APPLICATION OF AMENDMENT. 3
(a) E
FFECTIVEDATE.—Except as provided in sub-4
section (b), this Act and the amendment made by this Act 5
shall take effect on the date of the enactment of this Act. 6
(b) A
PPLICATION OFAMENDMENT.—The amendment 7
made by this Act shall apply only with respect to cases 8
commenced under title 11 of the United States Code on 9
or after the date of the enactment of this Act. 10
