To amend title 18, United States Code, to prohibit the pur-
chase of a semiautomatic assault weapon by, and the
sale of such a weapon to, individuals under 25 years
of age, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting the Second 4
Amendment through Responsible Gun Ownership Act’’. 5

SEC. 2. PROHIBITION ON PURCHASE OF A SEMIAUTOMATIC 1
ASSAULT WEAPON BY, AND SALE OF SUCH A 2
WEAPON TO, INDIVIDUALS UNDER 25 YEARS 3
OF AGE. 4
(a) D
EFINITIONS.—Section 921(a) of title 18, United 5
States Code, is amended— 6
(1) by inserting after paragraph (30) the fol-7
lowing: 8
‘‘(31) The term ‘semiautomatic assault weapon’ 9
means any of the following, regardless of country of manu-10
facture or caliber of ammunition accepted: 11
‘‘(A) A semiautomatic rifle that has the capac-12
ity to accept a detachable ammunition feeding device 13
and any one of the following: 14
‘‘(i) A pistol grip. 15
‘‘(ii) A forward grip. 16
‘‘(iii) A folding, telescoping, or detachable 17
stock, or is otherwise foldable or adjustable in 18
a manner that operates to reduce the length, 19
size, or any other dimension, or otherwise en-20
hances the concealability, of the weapon. 21
‘‘(iv) A grenade launcher. 22
‘‘(v) A barrel shroud. 23
‘‘(vi) A threaded barrel. 24
‘‘(B) A semiautomatic rifle that has a fixed am-25
munition feeding device with the capacity to accept 26

more than 10 rounds, except for an attached tubular 1
device designed to accept, and capable of operating 2
only with, .22 caliber rimfire ammunition. 3
‘‘(C) Any part, combination of parts, compo-4
nent, device, attachment, or accessory that is de-5
signed or functions to accelerate the rate of fire of 6
a semiautomatic rifle but not convert the semiauto-7
matic rifle into a machinegun. 8
‘‘(D) A semiautomatic pistol that has the ca-9
pacity to accept a detachable ammunition feeding 10
device and any one of the following: 11
‘‘(i) A threaded barrel. 12
‘‘(ii) A second pistol grip. 13
‘‘(iii) A barrel shroud. 14
‘‘(iv) The capacity to accept a detachable 15
ammunition feeding device at some location out-16
side of the pistol grip. 17
‘‘(v) A semiautomatic version of an auto-18
matic firearm. 19
‘‘(vi) A manufactured weight of 50 ounces 20
or more when unloaded. 21
‘‘(vii) A stabilizing brace or similar compo-22
nent. 23

‘‘(E) A semiautomatic pistol with a fixed am-1
munition feeding device that has the capacity to ac-2
cept more than 10 rounds. 3
‘‘(F) A semiautomatic shotgun that has any one 4
of the following: 5
‘‘(i) A folding, telescoping, or detachable 6
stock. 7
‘‘(ii) A pistol grip. 8
‘‘(iii) A fixed ammunition feeding device 9
with the capacity to accept more than 5 rounds. 10
‘‘(iv) The ability to accept a detachable 11
ammunition feeding device. 12
‘‘(v) A forward grip. 13
‘‘(vi) A grenade launcher. 14
‘‘(G) Any shotgun with a revolving cylinder. 15
‘‘(H) All of the following rifles, copies, dupli-16
cates, variants, or altered facsimiles with the capa-17
bility of any such weapon thereof: 18
‘‘(i) All AK types, including the following: 19
‘‘(I) AK, AK47, AK47S, AK–74, 20
AKM, AKS, ARM, MAK90, MISR, 21
NHM90, NHM91, Rock River Arms LAR– 22
47, SA85, SA93, Vector Arms AK–47, 23
VEPR, WASR–10, and WUM. 24
‘‘(II) IZHMASH Saiga AK. 25

‘‘(L) Any combination of parts from which a 1
firearm described in subparagraphs (A) through (K) 2
can be assembled. 3
‘‘(M) The frame or receiver of a rifle or shot-4
gun described in subparagraph (A), (B), (C), (F), 5
(G), (H), (J), or (K).’’; and 6
(2) by adding at the end the following: 7
‘‘(38) The term ‘semiautomatic pistol’ means any re-8
peating pistol that— 9
‘‘(A) utilizes a portion of the energy of a firing 10
cartridge to extract the fired cartridge case and 11
chamber the next round; and 12
‘‘(B) requires a separate pull of the trigger to 13
fire each cartridge. 14
‘‘(39) The term ‘semiautomatic shotgun’ means any 15
repeating shotgun that— 16
‘‘(A) utilizes a portion of the energy of a firing 17
cartridge to extract the fired cartridge case and 18
chamber the next round; and 19
‘‘(B) requires a separate pull of the trigger to 20
fire each cartridge. 21
‘‘(40) The term ‘barrel shroud’— 22
‘‘(A) means a shroud that is attached to, or 23
partially or completely encircles, the barrel of a fire-24

arm so that the shroud protects the user of the fire-1
arm from heat generated by the barrel; and 2
‘‘(B) does not include— 3
‘‘(i) a slide that partially or completely en-4
closes the barrel; or 5
‘‘(ii) an extension of the stock along the 6
bottom of the barrel which does not encircle or 7
substantially encircle the barrel. 8
‘‘(41) The term ‘detachable ammunition feeding de-9
vice’ means an ammunition feeding device that can be re-10
moved from a firearm without disassembly of the firearm 11
action. 12
‘‘(42) The term ‘fixed ammunition feeding device’ 13
means an ammunition feeding device that is permanently 14
fixed to the firearm in such a manner that it cannot be 15
removed without disassembly of the firearm. 16
‘‘(43) The term ‘folding, telescoping, or detachable 17
stock’ means a stock that folds, telescopes, detaches or 18
otherwise operates to reduce the length, size, or any other 19
dimension, or otherwise enhances the concealability, of a 20
firearm. 21
‘‘(44) The term ‘forward grip’ means a grip located 22
forward of the trigger that functions as a pistol grip. 23

‘‘(45) The term ‘grenade launcher’ means an attach-1
ment for use on a firearm that is designed to propel a 2
grenade or other similar destructive device. 3
‘‘(46) The term ‘pistol grip’ means a grip, a thumb-4
hole stock or Thordsen-type grip or stock, or any other 5
characteristic that can function as a grip. 6
‘‘(47) The term ‘threaded barrel’ means a feature or 7
characteristic that is designed in such a manner to allow 8
for the attachment of a device such as a firearm silencer 9
or a flash suppressor. 10
‘‘(48) The term ‘belt-fed semiautomatic firearm’ 11
means any repeating firearm that— 12
‘‘(A) utilizes a portion of the energy of a firing 13
cartridge to extract the fired cartridge case and 14
chamber the next round; 15
‘‘(B) requires a separate pull of the trigger to 16
fire each cartridge; and 17
‘‘(C) has the capacity to accept a belt ammuni-18
tion feeding device.’’. 19
(b) P
ROHIBITIONS.—Chapter 44 of title 18, United 20
States Code, is amended— 21
(1) in section 922(x)— 22
(A) in paragraph (3)(B), by striking ‘‘juve-23
nile’’ and inserting ‘‘person who is less than 25 24
years of age’’; 25

(B) by redesignating paragraphs (3) 1
through (6) as paragraphs (5) through (8), re-2
spectively; and 3
(C) by inserting after paragraph (2) the 4
following: 5
‘‘(3) It shall be unlawful for a person to sell a semi-6
automatic assault weapon to another person who the seller 7
knows or has reasonable cause to believe is less than 25 8
years of age. 9
‘‘(4) It shall be unlawful for a person who is less than 10
25 years of age to purchase a semiautomatic assault weap-11
on.’’; and 12
(2) in section 924(a)(6)(B)(ii)— 13
(A) by striking ‘‘handgun’’ each place the 14
term appears and inserting ‘‘handgun, a semi-15
automatic assault weapon,’’; 16
(B) by inserting ‘‘, or sold a semiautomatic 17
assault weapons to a person who is less than 25 18
years of age,’’ after ‘‘juvenile’’ the 1st place the 19
term appears; and 20
(C) by inserting ‘‘or purchaser, as the case 21
may be,’’ after ‘‘juvenile’’ the 2nd place the 22
term appears. 23
