15	15	To direct certain heads of Federal agencies to develop a
16	16	strategy to improve Federal investigations of organized
17	17	retail crime, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Improving the Federal 4
22	22	Response to Organized Retail Crime Act of 2023’’. 5
23	23	SEC. 2. IMPROVING COORDINATION IN FEDERAL INVES-6
24	24	TIGATION OF ORGANIZED RETAIL CRIME. 7
25	25	(a) I
26	26	NGENERAL.—Not later than 180 days after the 8
27	27	date of the enactment of this Act, the Attorney General, 9

31	31	the Secretary of Homeland Security, the Postmaster Gen-1
32	32	eral, and the head of each relevant agency shall develop 2
33	33	a strategy to identify how each such relevant agency can 3
34	34	coordinate with other relevant agencies to— 4
35	35	(1) improve information sharing between the 5
36	36	Director of the Federal Bureau of Investigation, the 6
37	37	Commissioner of the U.S. Customs and Border Pro-7
38	38	tection, the Executive Associate Director of Home-8
39	39	land Security Investigations, the Director of the Se-9
40	40	cret Service, the Postmaster General, and the head 10
41	41	of each relevant agency on organized retail crime 11
42	42	networks; 12
43	43	(2) assist State and local law enforcement in 13
44	44	compiling materials and evidence necessary for pros-14
45	45	ecution of organized retail crime; and 15
46	46	(3) increase cooperation and information shar-16
47	47	ing between each such relevant agency and the retail 17
48	48	industry, State retail crime task forces, and other 18
49	49	retail crime task forces. 19

51	51	EPORTINGREQUIREMENT.—Not later than 180 20
52	52	days after the date of the enactment of this Act, the Attor-21
53	53	ney General, the Secretary of Homeland Security, the 22
54	54	Postmaster General, and the head of each relevant agency 23
55	55	shall submit a joint report to the relevant committees on 24
56	56	the strategy developed pursuant to subsection (a). 25

60	60	(c) COMPTROLLER GENERALREPORT.—Not later 1
61	61	than 1 year after the date of the enactment of this Act, 2
62	62	the Comptroller General shall publish a report on coordi-3
63	63	nation between the private sector and law enforcement to 4
64	64	deter and investigate organized retail crime. 5

66	66	EFINITIONS.—In this section: 6
67	67	(1) O
68	68	RGANIZED RETAIL CRIME .—The term ‘‘or-7
69	69	ganized retail crime’’ means the coordinated illegal 8
70	70	acquisition of retail goods through theft, embezzle-9
71	71	ment, fraud, or other means that are illegal under 10
72	72	Federal or State law for the purpose of selling or 11
73	73	distributing such goods in interstate commerce. 12

75	75	RGANIZED RETAIL CRIME NETWORK .—The 13
76	76	term ‘‘organized retail crime network’’ means a 14
77	77	criminal network that engages in organized retail 15
78	78	crime. 16
79	79	(3) R
80	80	ELEVANT AGENCY .—The term ‘‘relevant 17
81	81	agency’’ means any agency (as defined in section 18
82	82	551 of title 5, United States Code) determined by 19
83	83	the Attorney General and Secretary of Homeland 20
84	84	Security to have a role in information sharing and 21
85	85	investigation of organized retail crime. 22

87	87	ELEVANT COMMITTEES .—The term ‘‘rel-23
88	88	evant committees’’ means the House Committee on 24
89	89	the Judiciary, the House Committee on Homeland 25
