the limitation on deductions for personal casualty losses.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting Home-4
owners from Disaster Act of 2023’’. 5
SEC. 2. REPEAL OF LIMITATION ON DEDUCTION FOR PER-6
SONAL CASUALTY LOSSES. 7
(a) I
NGENERAL.—Section 165(h) of the Internal 8
Revenue Code of 1986 is amended by striking paragraph 9
(5). 10

(b) EFFECTIVEDATE.—The amendment made by 1
this section shall apply to losses sustained in taxable years 2
beginning after December 31, 2022. 3
