SHORT TITLE. 3 This Act may be cited as the ‘‘Sanctioning Tyrannical 4 and Oppressive People within the Chinese Communist 5 Party Act’’ or the ‘‘STOP CCP Act’’. 6 SEC. 2. FINDINGS. 7 Congress finds the following: 8 (1) The Hong Kong National Security Law pro-9 mulgated on July 1, 2020— 10 (A) contravenes the Basic Law of the Hong 11 Kong Special Administrative Region that pro-12 vides in Article 23 that the Legislative Council 13 of Hong Kong shall enact legislation related to 14 national security; 15 (B) violates the People’s Republic of China’s 16 commitments under international law, as de-17 fined by the Joint Declaration; and 18 (C) causes severe and irreparable damage to 19 the ‘‘one country, two systems’’ principle and 20 further erodes global confidence in the People’s 21 Republic of China’s commitment to international 22 law. 23 (2) Repression of ethnic Muslim minorities in 24 the Xinjiang Uyghur Autonomous Region of the Peo-25 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 3334 RH ple’s Republic of China has been ongoing, and was 1 formalized with the ‘‘Strike Hard Campaign against 2 Violent Terrorism’’ that began in 2014. 3 (3) The mass internment of Uyghur and other 4 Muslim ethnic minorities in the Xinjiang Uyghur 5 Autonomous Region has been ongoing since April 6 2017. 7 (4) The People’s Republic of China has con-8 ducted a targeted and systemic population-control 9 campaign against ethnic and religious minorities in 10 the Xinjiang Uyghur Autonomous Region by impos-11 ing and implementing coercive population-control 12 practices, including selectively enforcing birth quotas, 13 targeting minority women who are in noncompliance 14 with birth quotas, and subjecting women to coercive 15 measures such as forced birth control, forced steriliza-16 tion, and forced abortion. 17 (5) On October 6, 2020, 39 countries delivered a 18 cross-regional joint statement to the United States 19 Mission to the United Nations on the human rights 20 abuses on Uyghurs and other minorities for forced 21 birth control including sterilization. 22 (6) On January 19, 2021, the Department of 23 State determined that the People’s Republic of China 24 committed crimes against humanity and genocide 25 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 3334 RH against Uyghurs and other ethnic and religious mi-1 nority groups in the Xinjiang Uyghur Autonomous 2 Region, citing forced sterilizations, forced abortions, 3 coerced marriages, and separation of Uyghur children 4 from their families. 5 (7) The Department of State’s 2020 Country Re-6 ports on Human Rights Practices affirmed the geno-7 cide determination and noted coercive population 8 control measures inflicted on ethnic and religious mi-9 nority women in China, including forced injections 10 with ‘‘drugs that cause temporary or permanent end 11 to their menstrual cycles and fertility’’. 12 (8) The United States ratified the United Na-13 tions Convention on the Prevention and Punishment 14 of Genocide in 1988, recognizing that ‘‘imposing 15 measures intended to prevent births within the group’’ 16 with intent to destroy a group in whole or part is an 17 act that constitutes genocide. 18 (9) Taiwan is a free and prosperous democracy 19 of nearly 24,000,000 people and an important con-20 tributor to peace and stability around the world. 21 (10) Section 2(b) of the Taiwan Relations Act 22 (Public Law 96–8; 6 (B) ‘‘to declare that peace and stability in 7 the area are in the political, security, and eco-8 nomic interests of the United States, and are 9 matters of international concern’’; 10 (C) ‘‘to make clear that the United States 11 decision to establish diplomatic relations with 12 the People’s Republic of China rests upon the ex-13 pectation that the future of Taiwan will be deter-14 mined by peaceful means’’; 15 (D) ‘‘to consider any effort to determine the 16 future of Taiwan by other than peaceful means, 17 including by boycotts or embargoes, a threat to 18 the peace and security of the Western Pacific 19 area and of grave concern to the United States’’; 20 (E) ‘‘to provide Taiwan with arms of a de-21 fensive character’’; and 22 (F) ‘‘to maintain the capacity of the United 23 States to resist any resort to force or other forms 24 of coercion that would jeopardize the security, or 25 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 7 •HR 3334 RH the social or economic system, of the people on 1 Taiwan’’. 2 (11) Since the election of President Tsai Ing-wen 3 as President of Taiwan in 2016, the Government of 4 the People’s Republic of China has intensified its ef-5 forts to pressure Taiwan through diplomatic isolation 6 and military provocations. 7 (12) The rapid modernization of the People’s 8 Liberation Army and recent military maneuvers in 9 and around the Taiwan Strait illustrate a clear 10 threat to Taiwan’s security. 11 SEC. 3. SENSE OF CONGRESS. 12 It is the sense of Congress that members of the Chinese 13 Communist Party, led by General Secretary Xi Jinping, 14 are responsible for violations of Hong Kong’s autonomy, in-15 creased aggression against the people of Taiwan, numerous 16 human rights violations against the people of Hong Kong 17 and the people of Taiwan, and acts of repression and geno-18 cide against Uyghur Muslims in the Xinjiang Uyghur Au-19 tonomous Region. 20 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 8 •HR 3334 RH SEC. 4. IMPOSITION OF SANCTIONS ON MEMBERS OF THE 1 CENTRAL COMMITTEE OF THE CHINESE COM-2 MUNIST PARTY. 3 (a) I NGENERAL.—Not later than 30 days after the 4 date of the enactment of this Act, the President shall impose 5 the sanctions described in subsection (c) with respect to— 6 (1) each person who is a member of the Central 7 Committee of the Chinese Communist Party that the 8 President determines engages in the conduct described 9 in subsection (b); 10 (2) each person who is a member of any suc-11 cessor organization of the Central Committee of the 12 Chinese Communist Party that the President deter-13 mines engages in the conduct described in subsection 14 (b), in the event that the Central Committee is dis-15 solved; and 16 (3) each person who is an adult family member, 17 including a spouse or an adult family member of the 18 spouse, of a person described in paragraph (1) or 19 paragraph (2). 20 (b) S ANCTIONABLECONDUCT.—A person engages in 21 the conduct described by this subsection if the person plays 22 a significant role in the development or implementation of 23 government policies or laws that the President determines 24 appear designed to— 25 (1) violate the autonomy of Hong Kong; or 2 (3) contribute to political oppression or violation 3 of human rights of individuals or societal groups 4 within the People’s Republic of China, including 5 Uyghur Muslims. 6 (c) S ANCTIONSDESCRIBED.— 7 (1) I N GENERAL.—The sanctions described in 8 this subsection are the following: 9 (A) B LOCKING OF PROPERTY .—The Presi-10 dent shall exercise all of the powers granted to 11 the President under the International Emergency 12 Economic Powers Act (50 U.S.C. 1701 et seq.) to 13 the extent necessary to block and prohibit all 14 transactions in property and interests in prop-15 erty of the person if such property and interests 16 in property are in the United States, come with-17 in the United States, or are or come within the 18 possession or control of a United States person. 19 (B) A LIENS INELIGIBLE FOR VISAS, ADMIS-20 SION, OR PAROLE.— 21 (i) V ISAS, ADMISSION, OR PAROLE.— 22 An alien who the Secretary of State or the 23 Secretary of Homeland Security (or a des-24 ignee of one of such Secretaries) knows, or 25 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 10 •HR 3334 RH has reason to believe, is described in sub-1 section (a) is— 2 (I) inadmissible to the United 3 States; 4 (II) ineligible to receive a visa or 5 other documentation to enter the 6 United States; and 7 (III) otherwise ineligible to be ad-8 mitted or paroled into the United 9 States or to receive any other benefit 10 under the Immigration and Nation-11 ality Act (8 U.S.C. 1101 et seq.). 12 (ii) C URRENT VISAS REVOKED.— 13 (I) I N GENERAL.—The issuing 14 consular officer, the Secretary of State, 15 or the Secretary of Homeland Security 16 (or a designee of one of such Secre-17 taries) shall, in accordance with sec-18 tion 221(i) of the Immigration and 19 Nationality Act (8 U.S.C. 1201(i)), re-20 voke any visa or other entry docu-21 mentation issued to an alien described 22 in clause (i) regardless of when the 23 visa or other entry documentation is 24 issued. 25 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 11 •HR 3334 RH (II) EFFECT OF REVOCATION.—A 1 revocation under subclause (I) shall 2 take effect immediately and shall auto-3 matically cancel any other valid visa 4 or entry documentation that is in the 5 alien’s possession. 6 (2) E XCEPTIONS.— 7 (A) U NITED NATIONS HEADQUARTERS 8 AGREEMENT.—The sanctions described in para-9 graph (1)(B) shall not apply with respect to an 10 alien if admitting or paroling the alien into the 11 United States is necessary to permit the United 12 States to comply with the Agreement regarding 13 the Headquarters of the United Nations, signed 14 at Lake Success June 26, 1947, and entered into 15 force November 21, 1947, between the United Na-16 tions and the United States, or other applicable 17 international obligations. 18 (B) E XCEPTION FOR INTELLIGENCE , LAW 19 ENFORCEMENT, AND NATIONAL SECURITY ACTIVI-20 TIES.—Sanctions under paragraph (1) shall not 21 apply to any authorized intelligence, law en-22 forcement, or national security activities of the 23 United States. 24 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 12 •HR 3334 RH (d) PENALTIES.—The penalties provided for in sub-1 sections (b) and (c) of section 206 of the International 2 Emergency Economic Powers Act (50 U.S.C. 1705) shall 3 apply to a person that violates, attempts to violate, con-4 spires to violate, or causes a violation of regulations pro-5 mulgated to carry out this section or the sanctions imposed 6 pursuant to this section to the same extent that such pen-7 alties apply to a person that commits an unlawful act de-8 scribed in section 206(a) of that Act. 9 (e) I MPLEMENTATION AUTHORITY.—The President 10 may exercise all authorities provided to the President under 11 sections 203 and 205 of the International Emergency Eco-12 nomic Powers Act (50 U.S.C. 1702 and 1704) for purposes 13 of carrying out this section. 14 (f) R EGULATORYAUTHORITY.—The President shall, 15 not later than 30 days after the date of the enactment of 16 this Act, promulgate regulations as necessary for the imple-17 mentation of this section. 18 (g) W AIVER.—The President may, for one or more pe-19 riods of not more than 60 days each, waive the application 20 of sanctions or restrictions imposed with respect to a foreign 21 person under this section if the President certifies to the 22 appropriate congressional committees, not later than 15 23 days before such waiver takes effect, that the waiver is vital 24 to the national security interests of the United States. 25 VerDate Sep 11 2014 22:37 Sep 12, 2024 Jkt 049200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6203 E:\BILLS\H3334.RH H3334 kjohnson on DSK7ZCZBW3PROD with $$_JOB 13 •HR 3334 RH (h) TERMINATION.—The President may terminate any 1 sanctions imposed under subsection (a) not fewer than 15 2 days after the date on which the President provides a writ-3 ten certification to the appropriate congressional commit-4 tees, and concurrently publishes on a publicly available 5 website of the Federal Government, that— 6 (1) the People’s Republic of China and the Chi-7 nese Communist Party have— 8 (A) ceased the genocide of the Uyghur Mus-9 lim population, including verifiably shutting 10 down all internment camps of Uyghurs and end-11 ing the practice of facilitating or supporting 12 Uyghur forced labor and forced sterilization; 13 (B) ceased all forms of threats, military ex-14 ercises, and aggression toward Taiwan, includ-15 ing through verifiably, and for at least a period 16 of one year, having not conducted any breach of 17 Taiwan’s air space, territorial waters, or land 18 mass, by any military or intelligence personnel 19 associated with the People’s Republic of China or 20 the Chinese Communist Party, or any agency or 21 instrumentality thereof; and 3 (D) ceased efforts to steal the intellectual 4 property of United States persons; or 5 (2) the sanctioned person has— 6 (A) affirmatively renounced membership in 7 the Chinese Communist Party; and 8 (B) taken affirmative steps to denounce or 9 remediate the conduct forming the basis for im-10 position of the sanction. 11 (i) S UNSET OFWAIVER ANDLICENSEAUTHORI-12 TIES.—The President’s authority to issue waivers or li-13 censes with respect to sanctions required by subsection (a), 14 including pursuant to sections 203 and 205 of the Inter-15 national Emergency Economic Powers Act (50 U.S.C. 1702 16 and 1704), shall terminate on the date that is 2 years after 17 the date of the enactment of this Act. 18 (j) A PPROPRIATECONGRESSIONALCOMMITTEESDE-19 FINED.—In this section, the term ‘‘appropriate congres-20 sional committees’’ means— 21 (1) the Committee on Foreign Affairs and the 22 Committee on Financial Services of the House of Rep-23 resentatives;
