To reduce the threshold for mandatory minimum penalties
for fentanyl-related offenses under the Controlled Sub-
stances Act and the Controlled Substances Import and
Export Act, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘Standardizing Thresh-2
olds Of Penalties for Fentanyl Act’’ or the ‘‘STOP 3
Fentanyl Act’’. 4
SEC. 2. AMENDMENTS TO THE CONTROLLED SUBSTANCES 5
ACT. 6
Section 401(b)(1) of the Controlled Substances Act 7
(21 U.S.C. 841(b)(1)) is amended— 8
(1) in subparagraph (A)(vi)— 9
(A) by striking ‘‘400’’ and inserting ‘‘5’’; 10
(B) by striking ‘‘100’’ and inserting 11
‘‘0.05’’; and 12
(C) by inserting ‘‘scheduled or unsched-13
uled’’ before ‘‘analogue of’’; and 14
(2) in subparagraph (B)(vi)— 15
(A) by striking ‘‘40’’ and inserting ‘‘0.5’’; 16
(B) by striking ‘‘10’’ and inserting 17
‘‘0.005’’; and 18
(C) by inserting ‘‘scheduled or unsched-19
uled’’ before ‘‘analogue of’’. 20
SEC. 3. AMENDMENTS TO THE CONTROLLED SUBSTANCES 21
IMPORT AND EXPORT ACT. 22
Section 1010(b) of the Controlled Substances Import 23
and Export Act (21 U.S.C. 960(b)) is amended— 24
(1) in paragraph (1)(F)— 25
(A) by striking ‘‘400’’ and inserting ‘‘5’’; 26

(B) by striking ‘‘100’’ and inserting 1
‘‘0.05’’; and 2
(C) by inserting ‘‘scheduled or unsched-3
uled’’ before ‘‘analogue of’’; 4
(2) in paragraph (2)(F)— 5
(A) by striking ‘‘40’’ and inserting ‘‘0.5’’; 6
(B) by striking ‘‘10’’ and inserting 7
‘‘0.005’’; and 8
(C) by inserting ‘‘scheduled or unsched-9
uled’’ before ‘‘analogue of’’; and 10
(3) by adding at the end the following: 11
‘‘(8) In the case of a violation under subsection 12
(a) of this section involving a mixture or substance 13
containing a detectable amount of N-phenyl-N-[1-(2- 14
phenylethyl)-4-piperidinyl] propanamide or a mixture 15
or substance containing a detectable amount of any 16
analogue of N-phenyl-N-[1-(2-phenylethyl)-4- 17
piperidinyl] propanamide, in which the substance 18
was imported along the United States international 19
border with Mexico, the person committing such a 20
violation shall be sentenced to a term of imprison-21
ment of not less than 20 years and not more than 22
life imprisonment and if death or serious bodily in-23
jury results from the use of such substance shall be 24
sentenced to life imprisonment.’’. 25

SEC. 4. EFFECTIVE DATE. 1
The amendments made by this Act shall apply to an 2
offense occurring on or after the date of enactment of this 3
Act. 4
