18	18	To amend the Agricultural Trade Act of 1978 to preserve
19	19	foreign markets for goods using common names, and
20	20	for other purposes.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Safeguarding Amer-4
25	25	ican Value-added Exports Act’’ or the ‘‘SAVE Act’’. 5

32	32	EFINITIONS.—Section 102 of the Agricultural 3
33	33	Trade Act of 1978 (7 U.S.C. 5602) is amended— 4
34	34	(1) in the matter preceding paragraph (1), by 5
35	35	striking ‘‘As used in this Act—’’ and inserting ‘‘In 6
36	36	this Act:’’; 7
37	37	(2) by redesignating paragraphs (2) through 8
38	38	(8) as paragraphs (3), (5), (6), (7), (8), (9), and 9
39	39	(4), respectively, and reordering accordingly; 10
40	40	(3) by inserting after paragraph (1) the fol-11
41	41	lowing: 12
42	42	‘‘(2) C
43	43	OMMON NAME.— 13
44	44	‘‘(A) I
45	45	N GENERAL.—The term ‘common 14
46	46	name’ means a name that, as determined by the 15
47	47	Secretary— 16
48	48	‘‘(i) is ordinarily or customarily used 17
49	49	for an agricultural commodity or food 18
50	50	product; 19
51	51	‘‘(ii) is typically placed on the pack-20
52	52	aging and product label of the agricultural 21
53	53	commodity or food product; 22
54	54	‘‘(iii) with respect to wine— 23
55	55	‘‘(I) is— 24

60	60	arily used for a wine grape vari-2
61	61	etal name; or 3
62	62	‘‘(bb) a traditional term or 4
63	63	expression that is typically placed 5
64	64	on the packaging and label of the 6
65	65	wine; and 7
66	66	‘‘(II) does not mean any appella-8
67	67	tion of origin for wine listed in sub-9
68	68	part C of part 9 of title 27, Code of 10
69	69	Federal Regulations (or successor reg-11
70	70	ulations); and 12
71	71	‘‘(iv) the use of which is consistent 13
72	72	with standards of the Codex Alimentarius 14
73	73	Commission. 15
74	74	‘‘(B) C
75	75	ONSIDERATIONS.—In making a de-16
76	76	termination under subparagraph (A), the Sec-17
77	77	retary may take into account— 18
78	78	‘‘(i) competent sources, such as dic-19
79	79	tionaries, newspapers, professional journals 20
80	80	and literature, and information posted on 21
81	81	websites that are determined by the Sec-22
82	82	retary to be reliable in reporting market 23
83	83	information; 24

87	87	‘‘(ii) the use of the common name in 1
88	88	a domestic, regional, or international prod-2
89	89	uct standard, including a standard promul-3
90	90	gated by the Codex Alimentarius Commis-4
91	91	sion, for the agricultural commodity or 5
92	92	food product; and 6
93	93	‘‘(iii) the ordinary and customary use 7
94	94	of the common name in the production or 8
95	95	marketing of the agricultural commodity or 9
96	96	food product in the United States or in 10
97	97	other countries.’’; and 11
98	98	(4) in paragraph (7) (as so redesignated), in 12
99	99	subparagraph (A)— 13
100	100	(A) in clause (v), by striking ‘‘or’’ at the 14
101	101	end; 15
102	102	(B) in clause (vi), by striking the period at 16
103	103	the end and inserting ‘‘; or’’; and 17
104	104	(C) by adding at the end the following: 18
105	105	‘‘(vii) prohibits or disallows the use of 19
106	106	the common name of an agricultural com-20
107	107	modity or food product of the United 21
108	108	States.’’. 22

118	118	‘‘SEC. 303. NEGOTIATIONS TO DEFEND THE USE OF COM-3
119	119	MON NAMES. 4
120	120	‘‘(a) I
121	121	NGENERAL.—The Secretary shall coordinate 5
122	122	efforts with the United States Trade Representative to se-6
123	123	cure the right of United States agricultural producers, 7
124	124	processors, and exporters to use common names for agri-8
125	125	cultural commodities or food products in foreign markets 9
126	126	through the negotiation of bilateral, plurilateral, or multi-10
127	127	lateral agreements, memoranda of understanding, or ex-11
128	128	changes of letters that assure the current and future use 12
129	129	of each common name identified by the Secretary in con-13
130	130	nection with United States agricultural commodities or 14
131	131	food products. 15
132	132	‘‘(b) R
133	133	EPORT.—The Secretary and the United States 16
134	134	Trade Representative shall submit to Congress a report 17
135	135	every 2 years regarding efforts and successes in carrying 18
136	136	out subsection (a).’’. 19
