3636 SECTION 1. SHORT TITLE. 1
3737 This Act may be cited as the ‘‘Transparent Represen-2
3838 tation Upholding Service and Trust in Congress Act’’ or 3
3939 the ‘‘TRUST in Congress Act’’. 4
4040 SEC. 2. PLACEMENT OF CERTAIN ASSETS OF MEMBERS OF 5
4141 CONGRESS AND THEIR SPOUSES AND DE-6
4242 PENDENT CHILDREN IN BLIND TRUST. 7

4444 NGENERAL.— 8

4646 EMBERS OCCUPYING OFFICE ON DATE OF 9
4747 ENACTMENT.—Not later than 90 days after the date 10
4848 of enactment of this Act, a Member of Congress and 11
4949 any spouse or dependent child of such Member shall 12
5050 place any covered investment owned by such Mem-13
5151 ber, spouse, or dependent child into a qualified blind 14
5252 trust. 15

5454 EMBERS ASSUMING OFFICE AFTER DATE 16
5555 OF ENACTMENT.—Not later than 90 days after the 17
5656 date an individual becomes a Member of Congress 18
5757 after the date of enactment of this Act, such indi-19
5858 vidual and any spouse or dependent child of such in-20
5959 dividual shall place any covered investment owned by 21
6060 such individual, spouse, or dependent child into a 22
6161 qualified blind trust. 23

6363 INGLING OF ASSETS.—A spouse or de-24
6464 pendent child of a Member of Congress may place 25

6969 lished by such Member under paragraph (1) or (2). 2

7171 SSETS UPON SEPARATION .—A Member of 3
7272 Congress and any spouse or dependent child of such 4
7373 Member may not dissolve any qualified blind trust in 5
7474 which a covered investment has been placed pursu-6
7575 ant to paragraph (1) or (2), or otherwise control 7
7676 such an investment, until the date that is 180 days 8
7777 after the date such Member ceases to be a Member 9
7878 of Congress. 10

8080 CCOUNTABILITY.— 11

8282 EMBERS OF THE HOUSE .—A Member of 12
8383 Congress who is a Member of the House of Rep-13
8484 resentatives shall— 14
8585 (A) not later than 15 days after the date 15
8686 a qualified blind trust is established under sub-16
8787 section (a), certify to the Clerk of the House of 17
8888 Representatives that such trust has been estab-18
8989 lished and that any covered investment owned 19
9090 by such Member or a spouse or dependent child 20
9191 of such Member has been placed in such trust; 21
9292 or 22
9393 (B) certify to the Clerk that such Member 23
9494 or a spouse or dependent child of such Member 24
9595 does not own any covered investment. 25

9999 (2) MEMBERS OF THE SENATE .—A Member of 1
100100 Congress who is a Senator shall— 2
101101 (A) not later than 15 days after the date 3
102102 a qualified blind trust is established under sub-4
103103 section (a), certify to the Secretary of the Sen-5
104104 ate that such trust has been established and 6
105105 that any covered investment owned by such 7
106106 Member or a spouse or dependent child of such 8
107107 Member has been placed in such trust; or 9
108108 (B) certify to the Secretary that such 10
109109 Member or a spouse or dependent child of such 11
110110 Member does not own any covered investment. 12

112112 EPORT.—The Clerk of the House of Rep-13
113113 resentatives and the Secretary of the Senate shall 14
114114 make available on the public website of the Clerk 15
115115 and the Secretary, respectively, any certification 16
116116 made under paragraph (1) or (2). 17

118118 XCEPTION.—A spouse or dependent child who 18
119119 receives compensation from their primary occupation 19
120120 through any covered investment shall not be required to 20
121121 place such covered investment in a qualified blind trust 21
122122 under this Act. 22

124124 EFINITIONS.—In this Act: 23

128128 (1) COMMODITY.—The term ‘‘commodity’’ has 1
129129 the meaning given the term in section 1a of the 2
130130 Commodity Exchange Act (7 U.S.C. 1a). 3

132132 OVERED INVESTMENT .—The term ‘‘cov-4
133133 ered investment’’— 5
134134 (A) means investment in a security, a com-6
135135 modity, or a future, or any comparable eco-7
136136 nomic interest acquired through synthetic 8
137137 means such as the use of a derivative; and 9
138138 (B) does not include— 10
139139 (i) a widely held investment fund de-11
140140 scribed in section 13104(f)(8) of title 5, 12
141141 United States Code; or 13
142142 (ii) a United States Treasury bill, 14
143143 note, or bond. 15

145145 EPENDENT CHILD.—The term ‘‘dependent 16
146146 child’’ has the meaning given that term in section 17
147147 13101 of title 5, United States Code. 18

149149 EMBER OF CONGRESS .—The term ‘‘Mem-19
150150 ber of Congress’’ has the meaning given that term 20
151151 in such section 13101. 21
