1919 This Act may be cited as the ‘‘Criminal Alien Gang 4
2020 Member Removal Act’’. 5
2121 SEC. 2. GROUNDS OF INADMISSIBILITY AND DEPORT-6

2424 EFINITION OFGANGMEMBER.—Section 101(a) 8

3030 ‘‘(53) The term ‘criminal gang’ means an ongoing 1
3131 group, club, organization, or association of 5 or more per-2
3232 sons that has as one of its primary purposes the commis-3
3333 sion of 1 or more of the following criminal offenses and 4
3434 the members of which engage, or have engaged within the 5
3535 past 5 years, in a continuing series of such offenses, or 6
3636 that has been designated as a criminal gang by the Sec-7
3737 retary of Homeland Security, in consultation with the At-8
3838 torney General, as meeting these criteria. The offenses de-9
3939 scribed, whether in violation of Federal or State law or 10
4040 foreign law and regardless of whether the offenses oc-11
4141 curred before, on, or after the date of the enactment of 12
4242 this paragraph, are the following: 13
4343 ‘‘(A) A ‘felony drug offense’ (as defined in sec-14
4444 tion 102 of the Controlled Substances Act (21 15
4545 U.S.C. 802)). 16
4646 ‘‘(B) An offense under section 274 (relating to 17
4747 bringing in and harboring certain aliens), section 18
4848 277 (relating to aiding or assisting certain aliens to 19
4949 enter the United States), or section 278 (relating to 20
5050 importation of alien for immoral purpose). 21
5151 ‘‘(C) A crime of violence (as defined in section 22
5252 16 of title 18, United States Code). 23

6161 lating to fraud and related activity in connection 6
6262 with identification documents or access devices), sec-7
6363 tions 1581 through 1594 of such title (relating to 8
6464 peonage, slavery, and trafficking in persons), section 9
6565 1951 of such title (relating to interference with com-10
6666 merce by threats or violence), section 1952 of such 11
6767 title (relating to interstate and foreign travel or 12
6868 transportation in aid of racketeering enterprises), 13
6969 section 1956 of such title (relating to the laundering 14
7070 of monetary instruments), section 1957 of such title 15
7171 (relating to engaging in monetary transactions in 16
7272 property derived from specified unlawful activity), or 17
7373 sections 2312 through 2315 of such title (relating to 18
7474 interstate transportation of stolen motor vehicles or 19
7575 stolen property). 20
7676 ‘‘(F) A conspiracy to commit an offense de-21
7777 scribed in subparagraphs (A) through (E).’’. 22

7979 NADMISSIBILITY.—Section 212(a)(2) of such Act 23
8080 (8 U.S.C. 1182(a)(2)) is amended by adding at the end 24

8686 GANGS.—Any alien is inadmissible who a con-2
8787 sular officer, the Secretary of Homeland Secu-3
8888 rity, or the Attorney General knows or has rea-4
8989 son to believe— 5
9090 ‘‘(i) to be or to have been a member 6
9191 of a criminal gang (as defined in section 7
9292 101(a)(53)); or 8
9393 ‘‘(ii) to have participated in the activi-9
9494 ties of a criminal gang (as defined in sec-10
9595 tion 101(a)(53)), knowing or having reason 11
9696 to know that such activities will promote, 12
9797 further, aid, or support the illegal activity 13

129129 NGENERAL.—The Secretary of Homeland Se-10

131131 designate a group, club, organization, or association of 5 12
132132 or more persons as a criminal gang if the Secretary finds 13
133133 that their conduct is described in section 101(a)(53). 14

142142 Leader, and Minority Leader of the Senate, and the 21
143143 members of the relevant committees of the House of 22

146146 association of 5 or more persons under this sub-25
147147 section and the factual basis therefor. 26

211211 that submits a petition for revocation under 24
212212 this subparagraph of its designation as a crimi-25

222222 180 days after receiving a petition for rev-5
223223 ocation submitted under this subpara-6
224224 graph, the Secretary shall make a deter-7
225225 mination as to such revocation. 8
226226 ‘‘(II) C
227227 LASSIFIED INFORMATION .— 9
228228 The Secretary may consider classified in-10
229229 formation in making a determination in re-11
230230 sponse to a petition for revocation. Classi-12
231231 fied information shall not be subject to dis-13
232232 closure for such time as it remains classi-14
233233 fied, except that such information may be 15
234234 disclosed to a court ex parte and in camera 16
235235 for purposes of judicial review under sub-17

251251 N GENERAL.—If in a 5-year period no 2
252252 review has taken place under subparagraph (B), 3
253253 the Secretary shall review the designation of the 4
254254 criminal gang in order to determine whether 5
255255 such designation should be revoked pursuant to 6
256256 paragraph (6). 7
257257 ‘‘(ii) P
258258 ROCEDURES.—If a review does not 8
259259 take place pursuant to subparagraph (B) in re-9
260260 sponse to a petition for revocation that is filed 10
261261 in accordance with that subparagraph, then the 11
262262 review shall be conducted pursuant to proce-12
263263 dures established by the Secretary. The results 13
264264 of such review and the applicable procedures 14
265265 shall not be reviewable in any court. 15

267267 UBLICATION OF RESULTS OF RE -16
268268 VIEW.—The Secretary shall publish any deter-17
269269 mination made pursuant to this subparagraph 18
270270 in the Federal Register. 19

272272 EVOCATION BYACT OFCONGRESS.—The Con-20
273273 gress, by an Act of Congress, may block or revoke a des-21
274274 ignation made under paragraph (1). 22

282282 a designation made under paragraph (1) at any 2
283283 time, and shall revoke a designation upon completion 3
284284 of a review conducted pursuant to subparagraphs 4
285285 (B) and (C) of paragraph (4) if the Secretary finds 5
286286 that— 6
287287 ‘‘(i) the group, club, organization, or asso-7
288288 ciation of 5 or more persons that has been des-8
289289 ignated as a criminal gang is no longer de-9
290290 scribed in section 101(a)(53); or 10
291291 ‘‘(ii) the national security or the law en-11
292292 forcement interests of the United States war-12
293293 rants a revocation. 13
294294 ‘‘(B) P
295295 ROCEDURE.—The procedural require-14
296296 ments of paragraphs (2) and (3) shall apply to a 15
297297 revocation under this paragraph. Any revocation 16
298298 shall take effect on the date specified in the revoca-17
299299 tion or upon publication in the Federal Register if 18
300300 no effective date is specified. 19

302302 FFECT OFREVOCATION.—The revocation of a 20
303303 designation under paragraph (5) or (6) shall not affect 21
304304 any action or proceeding based on conduct committed 22
305305 prior to the effective date of such revocation. 23

317317 MENDMENTS TO A DESIGNATION.— 5
318318 ‘‘(1) I
319319 N GENERAL.—The Secretary may amend 6
320320 a designation under this subsection if the Secretary 7
321321 finds that the group, club, organization, or associa-8
322322 tion of 5 or more persons has changed its name, 9
323323 adopted a new alias, dissolved and then reconsti-10
324324 tuted itself under a different name or names, or 11
325325 merged with another group, club, organization, or 12
326326 association of 5 or more persons. 13
327327 ‘‘(2) P
328328 ROCEDURE.—Amendments made to a 14
329329 designation in accordance with paragraph (1) shall 15
330330 be effective upon publication in the Federal Register. 16
331331 Paragraphs (2), (4), (5), (6), (7), and (8) of sub-17
332332 section (a) shall also apply to an amended designa-18
333333 tion. 19

335335 DMINISTRATIVE RECORD .—The adminis-20
336336 trative record shall be corrected to include the 21
337337 amendments as well as any additional relevant infor-22
338338 mation that supports those amendments. 23

352352 UDICIALREVIEW OFDESIGNATION.— 7
353353 ‘‘(1) I
354354 N GENERAL.—Not later than 30 days 8
355355 after publication in the Federal Register of a des-9
356356 ignation, an amended designation, or a determina-10
357357 tion in response to a petition for revocation, the des-11
358358 ignated group, club, organization, or association of 5 12
359359 or more persons may seek judicial review in the 13
360360 United States Court of Appeals for the District of 14
361361 Columbia Circuit. 15
362362 ‘‘(2) B
363363 ASIS OF REVIEW.—Review under this 16
364364 subsection shall be based solely upon the administra-17
365365 tive record, except that the Government may submit, 18
366366 for ex parte and in camera review, classified infor-19
367367 mation used in making the designation, amended 20
368368 designation, or determination in response to a peti-21
369369 tion for revocation. 22

371371 COPE OF REVIEW.—The Court shall hold 23
372372 unlawful and set aside a designation, amended des-24

378378 ‘‘(A) arbitrary, capricious, an abuse of dis-3
379379 cretion, or otherwise not in accordance with 4
380380 law; 5
381381 ‘‘(B) contrary to constitutional right, 6
382382 power, privilege, or immunity; 7
383383 ‘‘(C) in excess of statutory jurisdiction, au-8
384384 thority, or limitation, or short of statutory 9
385385 right; 10
386386 ‘‘(D) lacking substantial support in the ad-11
387387 ministrative record taken as a whole or in clas-12
388388 sified information submitted to the court under 13
389389 paragraph (2); or 14
390390 ‘‘(E) not in accord with the procedures re-15
391391 quired by law. 16

393393 UDICIAL REVIEW INVOKED .—The pend-17
394394 ency of an action for judicial review of a designation, 18
395395 amended designation, or determination in response 19
396396 to a petition for revocation shall not affect the appli-20
397397 cation of this section, unless the court issues a final 21
398398 order setting aside the designation, amended des-22
399399 ignation, or determination in response to a petition 23
400400 for revocation. 24

411411 ests of the United States; 6
412412 ‘‘(3) the term ‘relevant committees’ means the 7
413413 Committees on the Judiciary of the Senate and of 8
