Us Congress House Bill HB3911

Introduced
6/7/23

Caption

Ukrainian Adjustment Act of 2023

Impact

If enacted, HB 3911 would modify several existing immigration laws to provide easier access to permanent residency for Ukrainian nationals. Notably, inadmissibility grounds regarding prior criminal conduct occurring after February 2014 would not disqualify applicants, reflecting a purposeful humanitarian consideration. Additionally, the bill prohibits fees for application and requires that individuals applying under this act do not face removal from the U.S. while their application is pending, providing a safeguard for their continued presence during processing.

Summary

House Bill 3911, titled the 'Ukrainian Adjustment Act of 2023', aims to facilitate the adjustment of immigration status for nationals of Ukraine due to the ongoing humanitarian crisis resulting from the conflict in their country. The bill allows eligible Ukrainian nationals who have been paroled into the United States to apply for lawful permanent resident status while bypassing certain inadmissibility grounds that typically apply to immigrants. This streamlining is intended to support those affected by the geopolitical circumstances and enable them to secure their legal status in the U.S.

Contention

There may be potential points of contention regarding the implementation of this bill, particularly around the grounds for waiving inadmissibility and the logistical details for processing applications. Critics might express concern over the ramifications of bypassing certain legal barriers and the bill's potential impact on immigration enforcement. Additionally, discussions about fairness in applying such adjustments of status could arise, especially relating to how similar cases of other nationalities would be treated in the future.

Fund and Complete the Border Wall Act This bill establishes funding for a U.S.-Mexico border barrier and revises how border patrol agents are compensated for overtime. The Department of the Treasury shall set up an account for funding the design, construction, and maintenance of the barrier. The funds in the account are appropriated only for that purpose and for vehicles and equipment for border patrol agents. For each fiscal year, financial assistance to a country shall be reduced by $2,000 for each citizen or national of that country apprehended for illegally entering the United States through its southern border. The reduced amount shall be transferred to the border barrier account. The Department of State may opt not to reduce amounts appropriated to Mexico for various military and law enforcement-related activities. This bill establishes a 5% fee on foreign remittance transfers and increases the fee for the arrival/departure I-94 form for various aliens entering the United States, with part of the fees to go into the border barrier account. By December 31, 2023, DHS shall (1) take all actions necessary, including constructing barriers, to prevent illegal crossings along the U.S.-Mexico barrier; and (2) achieve operational control over all U.S. international borders. The bill changes how border patrol agents receive overtime pay when working up to 100 hours in a two-week period. For hours worked above 80, an agent shall receive at least 150% of the agent's regular hourly rate.
