13	13	of such provisions as fall within the jurisdiction of the committee con-

16	16	To regulate bump stocks in the same manner as
17	17	machineguns.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Closing the Bump 4
22	22	Stock Loophole Act of 2023’’. 5
23	23	SEC. 2. BUMP STOCKS. 6
24	24	(a) I
25	25	NGENERAL.—Section 5845 of the Internal Rev-7
26	26	enue Code of 1986 is amended— 8

30	30	(1) in subsection (a), by striking ‘‘and (8) a de-1
31	31	structive device.’’ and inserting ‘‘(8) a destructive 2
32	32	device; and (9) a bump stock.’’; and 3
33	33	(2) by adding at the end the following new sub-4
34	34	sections: 5
35	35	‘‘(n) B
36	36	UMPSTOCK.—The term ‘bump stock’ means 6
37	37	any of the following: 7
38	38	‘‘(1) Any manual, power-driven, or electronic 8
39	39	device that is designed such that when the device is 9
40	40	attached to a semiautomatic weapon, the device 10
41	41	eliminates the need for the operator of a semiauto-11
42	42	matic weapon to make a separate movement for each 12
43	43	individual function of the trigger and— 13
44	44	‘‘(A) materially increases the rate of fire of 14
45	45	the semiautomatic weapon, or 15
46	46	‘‘(B) approximates the action or rate of 16
47	47	fire of a machinegun. 17
48	48	‘‘(2) Any part or combination of parts that is 18
49	49	designed and functions to eliminate the need for the 19
50	50	operator of a semiautomatic weapon to make a sepa-20
51	51	rate movement for each individual function of the 21
52	52	trigger and— 22
53	53	‘‘(A) materially increases the rate of fire of 23
54	54	a semiautomatic weapon, or 24

58	58	‘‘(B) approximates the action or rate of 1
59	59	fire of a machinegun. 2
60	60	‘‘(3) Any semiautomatic weapon that has been 3
61	61	modified in any way that eliminates the need for the 4
62	62	operator of the semiautomatic weapon to make a 5
63	63	separate movement for each individual function of 6
64	64	the trigger and— 7
65	65	‘‘(A) materially increases the rate of fire of 8
66	66	the semiautomatic weapon, or 9
67	67	‘‘(B) approximates the action or rate of 10
68	68	fire of a machinegun. 11

70	70	EMIAUTOMATIC WEAPON.—The term ‘semi-12
71	71	automatic weapon’ means any repeating weapon that— 13
72	72	‘‘(1) utilizes a portion of the energy of a firing 14
73	73	cartridge or shell to extract the fired cartridge case 15
74	74	or shell casing and chamber the next round, and 16
75	75	‘‘(2) requires a separate function of the trigger 17
76	76	to fire each cartridge or shell.’’. 18

78	78	MENDMENTS TO TITLE18, UNITEDSTATES 19

81	81	(1) Section 921(a) of title 18, United States 21
82	82	Code, is amended— 22
83	83	(A) in paragraph (3), by striking ‘‘muffler 23
84	84	or firearm silencer’’ and inserting ‘‘muffler, 24
85	85	firearm silencer, or bump stock’’; and 25

90	90	‘‘(38) The term ‘bump stock’ has the meaning given 2
91	91	such term in section 5845(n) of the National Firearms 3
92	92	Act (26 U.S.C. 5845(n)).’’. 4
93	93	(2) Section 922 of title 18, United States Code, 5
94	94	is amended— 6
95	95	(A) in each of subsections (a)(4) and 7
96	96	(b)(4), by inserting ‘‘bump stock,’’ before ‘‘ma-8
97	97	chinegun’’; and 9
98	98	(B) in subsection (o)— 10
99	99	(i) in paragraph (1), by inserting ‘‘or 11
100	100	bump stock’’ before the period; and 12
101	101	(ii) in paragraph (2)— 13
102	102	(I) in subparagraph (A), by strik-14
103	103	ing ‘‘or’’ at the end; 15
104	104	(II) in subparagraph (B), by 16
105	105	striking the period and inserting ‘‘; 17
106	106	or’’; and 18
107	107	(III) by adding at the end the 19
108	108	following: 20
109	109	‘‘(C) the otherwise lawful possession of a bump 21
110	110	stock that, on or before the date that is 1 year after 22
111	111	the date of the enactment of this subparagraph, is 23
112	112	registered to the possessor in accordance with sec-24
113	113	tion 5841 of the Internal Revenue Code of 1986.’’. 25

117	117	(c) EFFECTIVEDATE.— 1

119	119	N GENERAL.—The amendments made by 2
120	120	this section shall take effect on the date of the en-3
121	121	actment of this Act. 4
122	122	(2) A
123	123	PPLICATION TO POSSESSION ON DATE OF 5
124	124	ENACTMENT.—Notwithstanding paragraph (1), any 6
125	125	person on the date of the enactment of this Act pos-7
126	126	sessing a bump stock as defined in section 5845(n) 8
127	127	of the Internal Revenue Code of 1986 (as amended 9
128	128	by this Act) shall, not later than the date that is 1 10
129	129	year after the date of the enactment of this Act, reg-11
130	130	ister such bump stock in accordance with section 12
131	131	5841 of the Internal Revenue Code of 1986 and in-13
132	132	clude with such registration the information required 14
133	133	under section 5841(a) of such Code. Such registra-15
134	134	tion shall become a part of the National Firearms 16
135	135	Registration and Transfer Record required to be 17
136	136	maintained by such section. The prohibition on pos-18
137	137	session of an unregistered firearm under section 19
138	138	5861 of such Code shall not apply to a bump stock 20
139	139	described in this Act on any date that is 1 year or 21
140	140	less after the enactment of this Act. 22
