31	31	To amend the Public Health Service Act to prohibit the

34	34	tissue that is obtained pursuant to an induced abortion,

41	41	SECTION 1. SHORT TITLE. 1
42	42	This Act may be cited as the ‘‘Protecting Life and 2
43	43	Integrity in Research Act of 2023’’. 3
44	44	SEC. 2. NO RESEARCH BY HHS INVOLVING HUMAN FETAL 4
45	45	TISSUE OBTAINED PURSUANT TO AN IN-5
46	46	DUCED ABORTION. 6
47	47	(a) I
48	48	NGENERAL.—The Public Health Service Act is 7
49	49	amended by inserting after section 498A of such Act (42 8
50	50	U.S.C. 289g–1) the following: 9
51	51	‘‘SEC. 498A–1. NO RESEARCH INVOLVING HUMAN FETAL TIS-10
52	52	SUE OBTAINED PURSUANT TO AN INDUCED 11
53	53	ABORTION. 12
54	54	‘‘(a) I
55	55	NGENERAL.—The Secretary may not conduct 13
56	56	or support any research involving human fetal tissue that 14
57	57	is obtained pursuant to an induced abortion. 15
58	58	‘‘(b) D
59	59	EVELOPMENT OF NEW, ETHICALCELL 16
60	60	L
61	61	INES.—Subsection (a) does not limit the authority of the 17
62	62	Secretary to develop or support the development of new, 18
63	63	high-efficiency cell lines, including for the production of 19
64	64	vaccines and genetic vectors, so long as the cell lines are 20
65	65	not derived from human fetal tissue that is obtained pur-21
66	66	suant to an induced abortion.’’. 22

68	68	ONFORMINGAMENDMENTS.—Section 498A of 23
69	69	the Public Health Service Act (42 U.S.C. 289g–1) is 24

81	81	ACQUISITION, RECEIPT, OR ACCEPTANCE OF 8
82	82	A DONATION OF HUMAN FETAL TISSUE 9
83	83	KNOWING THAT THE TISSUE WAS OBTAINED 10
84	84	PURSUANT TO AN INDUCED ABORTION. 11

86	86	NGENERAL.—Section 498B(c)(1) of the Public 12
87	87	Health Service Act (42 U.S.C. 289g–2(c)(1)) is amended 13
88	88	to read as follows: 14
89	89	‘‘(1) solicit or knowingly acquire, receive, or ac-15
90	90	cept a donation (excluding any transfer for purposes 16
91	91	of autopsy or burial) of human fetal tissue knowing 17
92	92	that— 18
93	93	‘‘(A) a human pregnancy was deliberately 19
94	94	initiated to provide such tissue; or 20
95	95	‘‘(B) the tissue was obtained pursuant to 21
96	96	an induced abortion; or’’. 22

98	98	ONFORMINGCHANGES.—Section 498B of the 23
99	99	Public Health Service Act (42 U.S.C. 289g–2), as amend-24
100	100	ed by subsection (a), is further amended— 25

119	119	TISSUE AND CORRESPONDING REPORTING. 16
120	120	Section 498A of the Public Health Service Act (42 17
121	121	U.S.C. 289g–1) is amended— 18
122	122	(1) in the section heading, by striking ‘‘

125	125	and inserting ‘‘
126	126	RESEARCH ON FETAL TISSUE ’’; 21
127	127	(2) in subsection (a)(1)— 22

136	136	‘‘Notwithstanding any other provision of law, 4
137	137	any research of the Department of Health and 5
138	138	Human Services on human fetal tissue shall be 6
139	139	conducted or supported in accordance with this 7
140	140	section.’’; and 8
141	141	(3) in subsection (b)(1)(B), by inserting ‘‘if the 9
142	142	fetal tissue is intended for transplantation,’’ before 10
