14	14	ments of internet-connected toys for children, and for
15	15	other purposes.
16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Transparency Over 4
20	20	Toys Spying Act’’ or the ‘‘TOTS Act’’. 5
21	21	SEC. 2. LABELING AND USER AGREEMENT REQUIREMENTS 6
22	22	FOR INTERNET-CONNECTED TOYS. 7
23	23	(a) R
24	24	EGULATIONS.—Not later than 1 year after the 8
25	25	date of the enactment of this Act, the Commission shall 9
26	26	promulgate under section 553 of title 5, United States 10

30	30	Code, regulations that require a manufacturer introducing 1
31	31	into interstate commerce an internet-connected toy to in-2
32	32	clude— 3
33	33	(1) on the packaging associated with the toy, a 4
34	34	label that clearly indicates— 5
35	35	(A) that the toy has the ability to— 6
36	36	(i) connect to the internet; and 7
37	37	(ii) collect and transmit the personal 8
38	38	information of a user of the toy; and 9
39	39	(B) whether personal information collected 10
40	40	by the toy is retained— 11
41	41	(i) in the toy; or 12
42	42	(ii) by the manufacturer or another 13
43	43	entity; and 14
44	44	(2) in any user agreement or privacy policy as-15
45	45	sociated with the toy, highlighted information that is 16
46	46	easy to read, is the first text presented by the agree-17
47	47	ment or policy, and describes— 18
48	48	(A) how personal information may be col-19
49	49	lected by the toy and what personal information 20
50	50	may be collected; 21
51	51	(B) what personal information may be re-22
52	52	tained in the toy; 23

57	57	transmitted from the toy and to whom the per-2
58	58	sonal information may be transmitted; 3
59	59	(D) how transmitted personal information 4
60	60	may be provided to, retained, and used by the 5
61	61	manufacturer or another entity; 6
62	62	(E) any actions taken by the manufacturer 7
63	63	to minimize the collection, retention, or trans-8
64	64	mission of personal information; 9
65	65	(F) the protections available to the user 10
66	66	with respect to collected, retained, or trans-11
67	67	mitted personal information, including protec-12
68	68	tions under Federal law; and 13
69	69	(G) whether the toy can be used in a man-14
70	70	ner that prevents the collection, retention, or 15
71	71	transmission of personal information, including 16
72	72	without connection to the internet or another 17
73	73	internet-connected device. 18

79	79	TICES.—A violation of a regulation promulgated 22
80	80	under subsection (a) shall be treated as a violation 23
81	81	of a regulation under section 18(a)(1)(B) of the 24
82	82	Federal Trade Commission Act (15 U.S.C. 25

89	89	OWERS OF COMMISSION .—The Commis-3
90	90	sion shall enforce the regulations promulgated under 4
91	91	subsection (a) in the same manner, by the same 5
92	92	means, and with the same jurisdiction, powers, and 6
93	93	duties as though all applicable terms and provisions 7
94	94	of the Federal Trade Commission Act (15 U.S.C. 41 8
95	95	et seq.) were incorporated into and made a part of 9
96	96	this Act. Any person who violates such a regulation 10
97	97	shall be subject to the penalties and entitled to the 11
98	98	privileges and immunities provided in the Federal 12
99	99	Trade Commission Act. 13

101	101	EFINITIONS.—In this section: 14
102	102	(1) I
103	103	NTERNET-CONNECTED TOY .—The term 15
104	104	‘‘internet-connected toy’’ means a device— 16
105	105	(A) introduced into interstate commerce 17
106	106	and targeted to a child or likely to be operated 18
107	107	by a child; 19
108	108	(B) the purpose of which is entertainment 20
109	109	or amusement; 21
110	110	(C) that is able to be connected to the 22
111	111	internet, directly or through another internet- 23
112	112	connected device; and 24

117	117	tion of a child may be collected and transmitted 2
118	118	to a person other than the child or the parent 3

121	121	ERSONAL INFORMATION .—The term ‘‘per-5
122	122	sonal information’’ means individually identifiable 6
123	123	information about an individual, including— 7
124	124	(A) a first and last name; 8
125	125	(B) a home or other physical address, in-9
126	126	cluding street name and name of a city or town; 10
127	127	(C) an e-mail address; 11
128	128	(D) a telephone number; 12
129	129	(E) a Social Security number; 13
130	130	(F) a photo, video, or audio recording; 14
131	131	(G) any other identifier that the Commis-15
132	132	sion determines permits the physical or online 16
133	133	contacting of a specific individual; or 17
134	134	(H) information concerning a child or the 18
135	135	parents of that child collected from the child 19
136	136	and combined with an identifier described in 20
137	137	this paragraph. 21

140	140	PRIVACY PROTECTION ACT OF 1998 .—The terms 23
141	141	‘‘child’’, ‘‘Commission’’, ‘‘parent’’, and ‘‘person’’ 24
