28	28	presence of a healthcare provider, and for other purposes.
29	29	Be it enacted by the Senate and House of Representa-1
30	30	tives of the United States of America in Congress assembled, 2
31	31	SECTION 1. SHORT TITLE. 3
32	32	This Act may be cited as the ‘‘Teleabortion Preven-4
33	33	tion Act of 2023’’. 5

38	38	HEALTHCARE PROVIDER PRESENT. 2

42	42	HYSICIANPRESENT.—Chapter 74 of title 18, United 4
43	43	States Code, is amended— 5
44	44	(1) in the chapter heading by striking ‘‘PAR-6
45	45	TIAL-BIRTH’’; and 7
46	46	(2) by inserting after section 1531 the fol-8
47	47	lowing: 9
48	48	‘‘§ 1532. Chemical abortions prohibited without a 10
49	49	healthcare provider physically present 11
50	50	‘‘(a) O
51	51	FFENSE.—Any healthcare provider who, in or 12
52	52	affecting interstate or foreign commerce, who knowingly 13
53	53	provides or attempts to provide a chemical abortion— 14
54	54	‘‘(1) without physically examining the patient; 15
55	55	‘‘(2) without being physically present at the lo-16
56	56	cation of the chemical abortion; and 17
57	57	‘‘(3) without scheduling a follow-up visit for the 18
58	58	patient to occur not more than 14 days after the ad-19
59	59	ministration or use of the drug to assess the pa-20
60	60	tient’s physical condition, 21
61	61	shall be fined not more than $1,000 or imprisoned not 22
62	62	more than 2 years, or both. This subsection does not apply 23
63	63	to a chemical abortion that is necessary to save the life 24
64	64	of a mother whose life is endangered by a physical dis-25
65	65	order, physical illness, or physical injury, including a life- 26

69	69	endangering physical condition caused by or arising from 1
70	70	the pregnancy itself. 2
71	71	‘‘(b) N
72	72	OLIABILITY OF THE PATIENT.—A patient 3
73	73	upon whom an abortion is performed may not be pros-4
74	74	ecuted under this section or for a conspiracy to violate 5
75	75	this section. 6
76	76	‘‘(c) D
77	77	EFINITIONS.—In this section: 7
78	78	‘‘(1) A
79	79	BORTION DRUG.—The term ‘abortion 8
80	80	drug’ means any medicine, drug or any other sub-9
81	81	stance, or any combination of drugs, medicines or 10
82	82	substances, when it is used— 11
83	83	‘‘(A) to intentionally kill the unborn child 12
84	84	of a woman known to be pregnant; or 13
85	85	‘‘(B) to intentionally terminate the preg-14
86	86	nancy of a woman known to be pregnant, with 15
87	87	an intention other than— 16
88	88	‘‘(i) to produce a live birth; or 17
89	89	‘‘(ii) to remove a dead unborn child. 18
90	90	‘‘(2) A
91	91	TTEMPTS TO PROVIDE .—In this section, 19
92	92	the term ‘attempts to provide’, means conduct that, 20
93	93	under the circumstances as the actor believes them 21
94	94	to be, constitutes a substantial step in a course of 22
95	95	conduct planned to culminate in a chemical abortion. 23
96	96	‘‘(3) H
97	97	EALTHCARE PROVIDER .—The term 24
98	98	‘healthcare provider’ means any person licensed to 25

103	103	eral and State laws. 2
104	104	‘‘(4) P
105	105	ROVIDE.—In this section, the term ‘pro-3
106	106	vide’, means to dispense or prescribe an abortion 4
107	107	drug, or to otherwise make an abortion drug avail-5
108	108	able to a patient. 6
109	109	‘‘(5) C
110	110	HEMICAL ABORTION .—The term ‘chem-7
111	111	ical abortion’ refers to the use of an abortion drug 8
112	112	to— 9
113	113	‘‘(A) intentionally kill the unborn child of 10
114	114	a woman known to be pregnant; or 11
115	115	‘‘(B) intentionally terminate the pregnancy 12
116	116	of a woman known to be pregnant, with an in-13
117	117	tention other than— 14
118	118	‘‘(i) to produce a live birth; or 15
119	119	‘‘(ii) to remove a dead unborn child. 16
120	120	‘‘(6) U
121	121	NBORN CHILD.—The term ‘unborn child’ 17
122	122	means an individual organism of the species homo 18
123	123	sapiens, beginning at fertilization, until the point of 19
124	124	being born alive as defined in section 8(b). 20

126	126	ULE OFCONSTRUCTIONREGARDINGECTOPIC 21

128	128	REGNANCY.—Nothing in this section shall be construed 22
129	129	to have any impact on the treatment of a verified ectopic 23
130	130	pregnancy. 24

134	134	‘‘(e) SEVERABILITY.—If any provision of this section 1
135	135	or the application of such provision to any person or cir-2
136	136	cumstance is held to be invalid, the remainder of this sec-3
137	137	tion and the application of the provisions of the remainder 4
138	138	to any person or circumstance shall not be affected there-5
139	139	by.’’. 6
