| 29 | 29 | | NGENERAL.—Section 24(b) of the Federal In-3 |

| 30 | 30 | | secticide, Fungicide, and Rodenticide Act (7 U.S.C. 4 |

| 31 | 31 | | 136v(b)) shall be applied to require uniformity in national 5 |

| 32 | 32 | | pesticide labeling, and prohibit any State, instrumentality 6 |
|---|
| 33 | 33 | | or political subdivision thereof, or a court from directly 7 |
|---|
| 34 | 34 | | or indirectly imposing or continuing in effect any require-8 |
|---|
| 35 | 35 | | ments for, or penalize or hold liable any entity for failing 9 |
|---|
| 36 | 36 | | to comply with requirements with respect to, labeling or 10 |
|---|
| 37 | 37 | | packaging that is in addition to or different from the label-11 |
|---|
| 38 | 38 | | ing or packaging approved by the Administrator under 12 |
|---|
| 39 | 39 | | such Act (7 U.S.C. et seq.), including any requirements 13 |
|---|
| 40 | 40 | | relating to warnings on such labeling or packaging. 14 |

| 42 | 42 | | ROHIBITION.—The Administrator may not issue 15 |

| 43 | 43 | | or adopt any guidance or any policy, take any regulatory 16 |
|---|
| 44 | 44 | | action, or approve any labeling (or change to such label-17 |
|---|
| 45 | 45 | | ing) that is inconsistent with or in any respect different 18 |
|---|
| 46 | 46 | | from the conclusion of— 19 |
|---|
| 47 | 47 | | (1) a human health assessment performed pur-20 |
|---|
| 48 | 48 | | suant to the Federal Insecticide, Fungicide, and 21 |
|---|
| 49 | 49 | | Rodenticide Act (7 U.S.C. 136 et seq.); or 22 |
|---|
| 50 | 50 | | (2) a carcinogenicity classification for a pes-23 |
