2828 (a) I
2929 NGENERAL.—Section 24(b) of the Federal In-3
3030 secticide, Fungicide, and Rodenticide Act (7 U.S.C. 4
3131 136v(b)) shall be applied to require uniformity in national 5
3232 pesticide labeling, and prohibit any State, instrumentality 6
3333 or political subdivision thereof, or a court from directly 7
3434 or indirectly imposing or continuing in effect any require-8
3535 ments for, or penalize or hold liable any entity for failing 9
3636 to comply with requirements with respect to, labeling or 10
3737 packaging that is in addition to or different from the label-11
3838 ing or packaging approved by the Administrator under 12
3939 such Act (7 U.S.C. et seq.), including any requirements 13
4040 relating to warnings on such labeling or packaging. 14

4242 ROHIBITION.—The Administrator may not issue 15
4343 or adopt any guidance or any policy, take any regulatory 16
4444 action, or approve any labeling (or change to such label-17
4545 ing) that is inconsistent with or in any respect different 18
4646 from the conclusion of— 19
4747 (1) a human health assessment performed pur-20
4848 suant to the Federal Insecticide, Fungicide, and 21
4949 Rodenticide Act (7 U.S.C. 136 et seq.); or 22
5050 (2) a carcinogenicity classification for a pes-23
5151 ticide performed pursuant to such Act (7 U.S.C. 136 24
5252 et seq.). 25
