21	21	To amend the Federal Crop Insurance Act to require the
22	22	Federal Crop Insurance Corporation to carry out re-
23	23	search and development regarding a policy to insure wine
24	24	grapes against losses due to smoke exposure, and for
25	25	other purposes.
26	26	Be it enacted by the Senate and House of Representa-1
27	27	tives of the United States of America in Congress assembled, 2
28	28	SECTION 1. SHORT TITLE. 3
29	29	This Act may be cited as the ‘‘Smoke Exposure Crop 4
30	30	Insurance Act of 2023’’. 5

34	34	SEC. 2. POLICY TO INSURE WINE GRAPES AGAINST LOSSES 1
35	35	DUE TO SMOKE EXPOSURE. 2
36	36	Section 522(c) of the Federal Crop Insurance Act (7 3
37	37	U.S.C. 1522(c)) is amended by adding at the end the fol-4
38	38	lowing: 5
39	39	‘‘(20) W
40	40	INE GRAPES.— 6
41	41	‘‘(A) I
42	42	N GENERAL.—Not later than 1 year 7
43	43	after the date of the enactment of this para-8
44	44	graph, the Corporation shall carry out research 9
45	45	and development, or offer to enter into 1 or 10
46	46	more contracts with 1 or more qualified persons 11
47	47	to carry out research and development, regard-12
48	48	ing a policy to insure wine grapes (including 13
49	49	wine grapes produced in the States of Cali-14
50	50	fornia, Oregon, and Washington) against losses 15
51	51	due to wildfire smoke exposure. 16
52	52	‘‘(B) A
53	53	VAILABILITY OF POLICY.—Notwith-17
54	54	standing the last sentence of section 508(a)(1), 18
55	55	and section 508(a)(2), not later than 18 19
56	56	months after the date of the enactment of this 20
57	57	paragraph, the Corporation shall make available 21
58	58	a policy described in subparagraph (A) if the 22
59	59	requirements of section 508(h) are met. 23

61	61	EPORT.—Not later than 2 years 24
62	62	after the date of enactment of this paragraph, 25
63	63	the Corporation shall submit to the Committees 26

71	71	‘‘(i) the results of the research con-5
72	72	ducted under subparagraph (A); 6
73	73	‘‘(ii) a description of the policies made 7
74	74	available under this paragraph; and 8
75	75	‘‘(iii) the feasibility of a product that 9
76	76	allows producers to claim an indemnity 10
77	77	through post-harvest, post-vinification test-11
78	78	ing, if such testing demonstrates smoke 12
79	79	damage that was not detectable prior to 13
80	80	harvest.’’. 14
