117117 posited in the SPR Petroleum Account under section 11

215215 vision of this Act, the Secretary shall establish, maintain, 13
216216 and operate a national network of Strategic Refined Pe-14
217217 troleum Product Reserves. 15

219219 OCATIONS.—In carrying out subsection (a), the 16
220220 Secretary shall establish, maintain, and operate at least 17
221221 one Reserve in each district. 18
222222 ‘‘(c) C
223223 APACITY.—Each Reserve shall have the capac-19
224224 ity to contain at least 4,000,000 barrels of gasoline and 20
225225 2,000,000 barrels of diesel fuel, and the network shall 21
226226 have the capacity to contain up to 250,000,000 barrels 22
227227 of gasoline and diesel fuel. 23

239239 ‘‘SEC. 193. AUTHORITY. 5
240240 ‘‘To the extent necessary or appropriate to carry out 6
241241 this part, the Secretary may— 7
242242 ‘‘(1) purchase, contract for, lease, or otherwise 8
243243 acquire, in whole or in part, storage and related fa-9
244244 cilities, and storage services; 10
245245 ‘‘(2) use, lease, maintain, sell, or otherwise dis-11
246246 pose of storage and related facilities acquired under 12
247247 this part; 13
248248 ‘‘(3) acquire by purchase, exchange (including 14
249249 exchange of petroleum products from the Strategic 15
250250 Petroleum Reserve or received as royalty from Fed-16
251251 eral lands), lease, or otherwise, gasoline or diesel 17
252252 fuel for storage in a Reserve; 18
253253 ‘‘(4) store gasoline or diesel fuel in facilities not 19
254254 owned by the United States; and 20
255255 ‘‘(5) sell, exchange, or otherwise dispose of gas-21
256256 oline or diesel fuel from a Reserve established under 22
257257 this part, including to maintain the quality or quan-23
258258 tity of the gasoline or diesel fuel in a Reserve or to 24
259259 maintain the operational capability of a Reserve. 25

266266 gasoline from a Reserve only upon a finding by the Presi-3
267267 dent that there is a severe gasoline supply interruption 4
268268 within the district in which the Reserve is located. Such 5
269269 a finding may be made only if the President determines 6
270270 that— 7
271271 ‘‘(1) a dislocation in the gasoline market has re-8
272272 sulted from such interruption; or 9
273273 ‘‘(2) a circumstance, other than that described 10
274274 in paragraph (1), exists that constitutes a regional 11
275275 gasoline supply shortage of significant scope and du-12
276276 ration and that action taken under this section 13
277277 would assist directly and significantly in reducing 14
278278 the adverse impact of such shortage. 15
279279 ‘‘(b) D
280280 IESELRELEASE.—The Secretary may sell die-16
281281 sel fuel from a Reserve only upon a finding by the Presi-17
282282 dent that there is a severe diesel fuel supply interruption 18
283283 within the district in which the Reserve is located. Such 19
284284 a finding may be made only if the President determines 20

286286 ‘‘(1) a dislocation in the diesel fuel market has 22

298298 EFINITIONS.—For purposes of this section— 4
299299 ‘‘(1) the term ‘covered entity’ means— 5
300300 ‘‘(A) the People’s Republic of China; 6
301301 ‘‘(B) the Democratic People’s Republic of 7
302302 Korea; 8
303303 ‘‘(C) the Russian Federation; 9
304304 ‘‘(D) the Islamic Republic of Iran; 10
305305 ‘‘(E) any other country the government of 11
306306 which is subject to sanctions imposed by the 12
307307 United States; and 13
308308 ‘‘(F) any entity owned, controlled, or influ-14
309309 enced by— 15
310310 ‘‘(i) a country referred to in any of 16
311311 subparagraphs (A) through (F); or 17
312312 ‘‘(ii) the Chinese Communist Party; 18
313313 ‘‘(2) a ‘dislocation in the gasoline market’ shall 19
314314 be deemed to occur only when— 20
315315 ‘‘(A) the price differential between crude 21
316316 oil and finished gasoline, as reflected in an in-22
317317 dustry daily publication, increases by more than 23
318318 50 percent over its 10-year rolling average, and 24
319319 continues for 7 consecutive days; and 25

323323 ‘‘(B) the price differential continues to in-1
324324 crease during the most recent week for which 2
325325 price information is available; and 3
326326 ‘‘(3) a ‘dislocation in the diesel fuel market’ 4
327327 shall be deemed to occur only when— 5
328328 ‘‘(A) the price differential between crude 6
329329 oil and diesel fuel, as reflected in an industry 7
330330 daily publication, increases by more than 50 8
331331 percent over its 10-year rolling average, and 9
332332 continues for 7 consecutive days; and 10
333333 ‘‘(B) the price differential continues to in-11
334334 crease during the most recent week for which 12
335335 price information is available. 13
336336 ‘‘(d) C
337337 ONTINUINGEVALUATION.—The Secretary 14
338338 shall conduct a continuing evaluation of the price data 15
339339 supplied by the Energy Information Administration and 16
340340 data on gasoline and diesel fuel prices from published 17
341341 sources. 18
342342 ‘‘(e) R
343343 ELEASE OFPETROLEUMPRODUCTS.—After 19
344344 consultation with the gasoline, diesel fuel, and crude oil 20
345345 refining industries, the Secretary shall determine proce-21
346346 dures governing the release of gasoline and diesel fuel 22
347347 from a Reserve. The procedures shall provide that— 23
348348 ‘‘(1) the Secretary may— 24

352352 ‘‘(A) sell gasoline or diesel fuel from a Re-1
353353 serve through a competitive process; or 2
354354 ‘‘(B) enter into exchange agreements for 3
355355 gasoline or diesel fuel that results in the Sec-4
356356 retary receiving a greater volume of gasoline or 5
357357 diesel fuel as repayment than the volume pro-6
358358 vided to the acquirer; 7
359359 ‘‘(2) in all such sales or exchanges, the Sec-8
360360 retary shall receive revenue or its equivalent in gaso-9
361361 line or diesel fuel that provides the Department with 10
362362 fair market value; 11
363363 ‘‘(3) the Secretary shall only sell or dispose of 12
364364 the gasoline or diesel fuel in the Reserve to entities 13
365365 customarily engaged in the sale and distribution of 14
366366 gasoline or diesel fuel; and 15
367367 ‘‘(4) the Secretary shall prohibit the sale or ex-16
368368 port of gasoline or diesel fuel released under this 17
369369 section to a covered entity, except that the Secretary 18
370370 may issue a waiver of such prohibition if the Sec-19
371371 retary certifies that any export or sale authorized 20
372372 pursuant to the waiver is in the national security in-21
373373 terests of the United States. 22
374374 ‘‘(f) P
375375 LAN.—Not later than 180 days after the date 23
376376 of the enactment of this section, the Secretary shall trans-24

381381 the Congress a plan describing— 2
382382 ‘‘(1) the acquisition of storage and related fa-3
383383 cilities or storage services for the network, including 4
384384 the potential use of storage facilities not currently in 5
385385 use; 6
386386 ‘‘(2) the acquisition of gasoline and diesel fuel 7
387387 for storage in the network; 8
388388 ‘‘(3) the anticipated methods of disposition of 9
389389 gasoline and diesel fuel from the network; 10
390390 ‘‘(4) the estimated costs of establishment, main-11
391391 tenance, and operation of the network; 12
392392 ‘‘(5) efforts the Department will take to mini-13
393393 mize any potential need for future drawdowns and 14
394394 ensure that distributors and importers are not dis-15
395395 couraged from maintaining and increasing supplies 16
396396 to the United States; and 17
397397 ‘‘(6) actions to ensure quality of the gasoline 18
398398 and diesel fuel in the network. 19
399399 ‘‘SEC. 195. PROCEEDS FROM SALES. 20
400400 ‘‘The Secretary of the Treasury shall deposit in the 21
401401 SPR Petroleum Account established in the Treasury 22
402402 under section 167 any receipts from the sale, exchange, 23
403403 or other disposition of gasoline or diesel fuel from the net-24
404404 work. 25
