55	55	STABLISHMENT.—In carrying out sub-7
56	56	section (b), the Secretary shall establish and main-8
57	57	tain within the Strategic Petroleum Reserve an Eco-9
58	58	nomic Petroleum Reserve of up to 350,000,000 bar-10
59	59	rels of crude oil. 11

61	61	OURCE.—The Economic Petroleum Re-12
62	62	serve shall consist of— 13
63	63	‘‘(A) 90,000,000 barrels of crude oil that 14
64	64	are stored in the Strategic Petroleum Reserve 15
65	65	on the date of enactment of this subsection, less 16
66	66	any amounts drawn down and sold under sec-17
67	67	tion 161(k) after such date; and 18

75	75	and Conservation Act (42 U.S.C. 6240) is amended by 4

79	79	TROLEUMRESERVE.— 7

81	81	N GENERAL.—For purposes of section 8
82	82	154(g), the Secretary may acquire crude oil under 9
83	83	this section only by purchase from domestic pro-10
84	84	ducers for a contract price of not more than $60 per 11
85	85	barrel, in accordance with this subsection. 12
86	86	‘‘(2) I
87	87	MMEDIATE DELIVERY .—The Secretary 13
88	88	may enter into a contract under paragraph (1) at 14
89	89	any time for immediate delivery of crude oil. 15

91	91	UTURE DELIVERY.— 16

93	93	UTHORIZED PERIOD .—During the 17
94	94	period that begins on the date of enactment of 18
95	95	this subsection and ends on December 31, 19
96	96	2024, the Secretary may enter into a contract 20
97	97	under paragraph (1) for delivery of crude oil to 21
98	98	occur during the period that begins on January 22
99	99	1, 2025, and ends on December 31, 2027. 23

101	101	RIORITY.—In carrying out subpara-24
102	102	graph (A), to the extent there are multiple of-25

109	109	uncompleted wells, that are minimizing green-4
110	110	house gas emissions from activities at such 5
111	111	wells, as determined by the Secretary in con-6
112	112	sultation with the Administrator of the Envi-7
113	113	ronmental Protection Agency. 8
114	114	‘‘(4) F
115	115	UNDING.—The Secretary may enter into 9
116	116	a contract under paragraph (1) using amounts de-10
117	117	posited in the SPR Petroleum Account under section 11
118	118	167(c)— 12
119	119	‘‘(A) that are attributable to covered re-13
120	120	ceipts described in section 167(e)(3)(A); or 14
121	121	‘‘(B) that were appropriated for such pur-15
122	122	pose pursuant to section 166. 16

124	124	PPLICABILITY OF CERTAIN CONSIDER -17
125	125	ATIONS.—The objectives described in subsections 18

212	212	‘‘SEC. 192. ESTABLISHMENT. 11

214	214	NGENERAL.—Notwithstanding any other pro-12
215	215	vision of this Act, the Secretary shall establish, maintain, 13
216	216	and operate a national network of Strategic Refined Pe-14
217	217	troleum Product Reserves. 15
218	218	‘‘(b) L
219	219	OCATIONS.—In carrying out subsection (a), the 16
220	220	Secretary shall establish, maintain, and operate at least 17
221	221	one Reserve in each district. 18
222	222	‘‘(c) C
223	223	APACITY.—Each Reserve shall have the capac-19
224	224	ity to contain at least 4,000,000 barrels of gasoline and 20
225	225	2,000,000 barrels of diesel fuel, and the network shall 21
226	226	have the capacity to contain up to 250,000,000 barrels 22
227	227	of gasoline and diesel fuel. 23

239	239	‘‘SEC. 193. AUTHORITY. 5
240	240	‘‘To the extent necessary or appropriate to carry out 6
241	241	this part, the Secretary may— 7
242	242	‘‘(1) purchase, contract for, lease, or otherwise 8
243	243	acquire, in whole or in part, storage and related fa-9
244	244	cilities, and storage services; 10
245	245	‘‘(2) use, lease, maintain, sell, or otherwise dis-11
246	246	pose of storage and related facilities acquired under 12
247	247	this part; 13
248	248	‘‘(3) acquire by purchase, exchange (including 14
249	249	exchange of petroleum products from the Strategic 15
250	250	Petroleum Reserve or received as royalty from Fed-16
251	251	eral lands), lease, or otherwise, gasoline or diesel 17
252	252	fuel for storage in a Reserve; 18
253	253	‘‘(4) store gasoline or diesel fuel in facilities not 19
254	254	owned by the United States; and 20
255	255	‘‘(5) sell, exchange, or otherwise dispose of gas-21
256	256	oline or diesel fuel from a Reserve established under 22
257	257	this part, including to maintain the quality or quan-23
258	258	tity of the gasoline or diesel fuel in a Reserve or to 24
259	259	maintain the operational capability of a Reserve. 25

266	266	gasoline from a Reserve only upon a finding by the Presi-3
267	267	dent that there is a severe gasoline supply interruption 4
268	268	within the district in which the Reserve is located. Such 5
269	269	a finding may be made only if the President determines 6
270	270	that— 7
271	271	‘‘(1) a dislocation in the gasoline market has re-8
272	272	sulted from such interruption; or 9
273	273	‘‘(2) a circumstance, other than that described 10
274	274	in paragraph (1), exists that constitutes a regional 11
275	275	gasoline supply shortage of significant scope and du-12
276	276	ration and that action taken under this section 13
277	277	would assist directly and significantly in reducing 14
278	278	the adverse impact of such shortage. 15
279	279	‘‘(b) D
280	280	IESELRELEASE.—The Secretary may sell die-16
281	281	sel fuel from a Reserve only upon a finding by the Presi-17
282	282	dent that there is a severe diesel fuel supply interruption 18
283	283	within the district in which the Reserve is located. Such 19
284	284	a finding may be made only if the President determines 20
285	285	that— 21
286	286	‘‘(1) a dislocation in the diesel fuel market has 22
287	287	resulted from such interruption; or 23
288	288	‘‘(2) a circumstance, other than that described 24
289	289	in paragraph (1), exists that constitutes a regional 25
290	290	diesel fuel supply shortage of significant scope and 26

298	298	EFINITIONS.—For purposes of this section— 4
299	299	‘‘(1) the term ‘covered entity’ means— 5
300	300	‘‘(A) the People’s Republic of China; 6
301	301	‘‘(B) the Democratic People’s Republic of 7
302	302	Korea; 8
303	303	‘‘(C) the Russian Federation; 9
304	304	‘‘(D) the Islamic Republic of Iran; 10
305	305	‘‘(E) any other country the government of 11
306	306	which is subject to sanctions imposed by the 12
307	307	United States; and 13
308	308	‘‘(F) any entity owned, controlled, or influ-14
309	309	enced by— 15
310	310	‘‘(i) a country referred to in any of 16
311	311	subparagraphs (A) through (F); or 17
312	312	‘‘(ii) the Chinese Communist Party; 18
313	313	‘‘(2) a ‘dislocation in the gasoline market’ shall 19
314	314	be deemed to occur only when— 20
315	315	‘‘(A) the price differential between crude 21
316	316	oil and finished gasoline, as reflected in an in-22
317	317	dustry daily publication, increases by more than 23
318	318	50 percent over its 10-year rolling average, and 24
319	319	continues for 7 consecutive days; and 25

323	323	‘‘(B) the price differential continues to in-1
324	324	crease during the most recent week for which 2
325	325	price information is available; and 3
326	326	‘‘(3) a ‘dislocation in the diesel fuel market’ 4
327	327	shall be deemed to occur only when— 5
328	328	‘‘(A) the price differential between crude 6
329	329	oil and diesel fuel, as reflected in an industry 7
330	330	daily publication, increases by more than 50 8
331	331	percent over its 10-year rolling average, and 9
332	332	continues for 7 consecutive days; and 10
333	333	‘‘(B) the price differential continues to in-11
334	334	crease during the most recent week for which 12
335	335	price information is available. 13
336	336	‘‘(d) C
337	337	ONTINUINGEVALUATION.—The Secretary 14
338	338	shall conduct a continuing evaluation of the price data 15
339	339	supplied by the Energy Information Administration and 16
340	340	data on gasoline and diesel fuel prices from published 17
341	341	sources. 18
342	342	‘‘(e) R
343	343	ELEASE OFPETROLEUMPRODUCTS.—After 19
344	344	consultation with the gasoline, diesel fuel, and crude oil 20
345	345	refining industries, the Secretary shall determine proce-21
346	346	dures governing the release of gasoline and diesel fuel 22
347	347	from a Reserve. The procedures shall provide that— 23
348	348	‘‘(1) the Secretary may— 24

352	352	‘‘(A) sell gasoline or diesel fuel from a Re-1
353	353	serve through a competitive process; or 2
354	354	‘‘(B) enter into exchange agreements for 3
355	355	gasoline or diesel fuel that results in the Sec-4
356	356	retary receiving a greater volume of gasoline or 5
357	357	diesel fuel as repayment than the volume pro-6
358	358	vided to the acquirer; 7
359	359	‘‘(2) in all such sales or exchanges, the Sec-8
360	360	retary shall receive revenue or its equivalent in gaso-9
361	361	line or diesel fuel that provides the Department with 10
362	362	fair market value; 11
363	363	‘‘(3) the Secretary shall only sell or dispose of 12
364	364	the gasoline or diesel fuel in the Reserve to entities 13
365	365	customarily engaged in the sale and distribution of 14
366	366	gasoline or diesel fuel; and 15
367	367	‘‘(4) the Secretary shall prohibit the sale or ex-16
368	368	port of gasoline or diesel fuel released under this 17
369	369	section to a covered entity, except that the Secretary 18
370	370	may issue a waiver of such prohibition if the Sec-19
371	371	retary certifies that any export or sale authorized 20
372	372	pursuant to the waiver is in the national security in-21
373	373	terests of the United States. 22
374	374	‘‘(f) P
375	375	LAN.—Not later than 180 days after the date 23
376	376	of the enactment of this section, the Secretary shall trans-24

381	381	the Congress a plan describing— 2
382	382	‘‘(1) the acquisition of storage and related fa-3
383	383	cilities or storage services for the network, including 4
384	384	the potential use of storage facilities not currently in 5
385	385	use; 6
386	386	‘‘(2) the acquisition of gasoline and diesel fuel 7
387	387	for storage in the network; 8
388	388	‘‘(3) the anticipated methods of disposition of 9
389	389	gasoline and diesel fuel from the network; 10
390	390	‘‘(4) the estimated costs of establishment, main-11
391	391	tenance, and operation of the network; 12
392	392	‘‘(5) efforts the Department will take to mini-13
393	393	mize any potential need for future drawdowns and 14
394	394	ensure that distributors and importers are not dis-15
395	395	couraged from maintaining and increasing supplies 16
396	396	to the United States; and 17
397	397	‘‘(6) actions to ensure quality of the gasoline 18
398	398	and diesel fuel in the network. 19
399	399	‘‘SEC. 195. PROCEEDS FROM SALES. 20
400	400	‘‘The Secretary of the Treasury shall deposit in the 21
401	401	SPR Petroleum Account established in the Treasury 22
402	402	under section 167 any receipts from the sale, exchange, 23
403	403	or other disposition of gasoline or diesel fuel from the net-24
404	404	work. 25
