construction of 5 a research facility by a non-Federal entity for use by the 6 Agricultural Research Service and a condition of the lease 7 shall be that any facility shall be owned, operated, and 8 maintained by the non-Federal entity and shall be re-9 moved upon the expiration or termination of the lease 10 agreement: Provided further, That the limitations on alter-11 ations contained in this Act shall not apply to moderniza-12 tion or replacement of existing facilities at Beltsville, 13 Maryland: Provided further, That appropriations here-14 under shall be available for granting easements at the 15 Beltsville Agricultural Research Center: Provided further, 16 That the foregoing limitations shall not apply to replace-17 ment of buildings needed to carry out the Act of April 18 24, 1948 (21 U.S.C. 113a): Provided further, That appro-19 priations hereunder shall be available for granting ease-20 ments at any Agricultural Research Service location for 21 the construction of a research facility by a non-Federal 22 entity for use by, and acceptable to, the Agricultural Re-23 search Service and a condition of the easements shall be 24 that upon completion the facility shall be authorized 7 by law. 8 BUILDINGS AND FACILITIES 9 For the acquisition of land, construction, repair, im-10 provement, extension, alteration, and purchase of fixed 11 equipment or facilities as necessary to carry out the agri-12 cultural research programs of the Department of Agri-13 culture, where not otherwise provided, up to $16,700,000 14 to remain available until expended, shall be for the pur-15 poses, and in the amounts, specified for this account in 16 the table titled ‘‘Community Project Funding’’ in the re-17 port accompanying this Act. 18 N ATIONALINSTITUTE OFFOOD ANDAGRICULTURE 19 RESEARCH AND EDUCATION ACTIVITIES 20 For payments to agricultural experiment stations, for 21 cooperative forestry and other research, for facilities, and 22 for other expenses, air-3 craft: Provided further, That in addition, in emergencies 4 which threaten any segment of the agricultural production 5 industry of the United States, the Secretary may transfer 6 from other appropriations or funds available to the agen-7 cies or corporations of the Department such sums as may 8 be deemed necessary, to be available only in such emer-9 gencies for the arrest and eradication of contagious or in-10 fectious disease or pests of animals, poultry, or plants, and 11 for expenses in accordance with sections 10411 and 10417 12 of the Animal Health Protection Act (7 U.S.C. 8310 and 13 8316) and sections 431 and 442 of the Plant Protection 14 Act (7 U.S.C. 7751 and 7772), and any unexpended bal-15 ances of funds transferred for such emergency purposes 16 in the preceding fiscal year shall be merged with such 17 transferred amounts: Provided further, That appropria-18 tions hereunder shall be available pursuant to law (7 19 U.S.C. 2250) for the repair and alteration of leased build-20 ings and improvements, but unless otherwise provided the 21 cost of altering any one building during the fiscal year 22 shall not exceed 10 percent of the current subdivisions, domestic and international organizations, 4 foreign governments, or individuals, provided that such 5 fees are structured such that any entity’s liability for such 6 fees is reasonably based on the technical assistance, goods, 7 or services provided to the entity by the agency, and such 8 fees shall be reimbursed to this account, to remain avail-9 able until expended, without of Rural Housing Service (RHS) 6 multifamily housing properties by such nonprofit organi-7 zations and public housing authorities that commit to keep 8 such properties in the RHS multifamily housing program 9 for a period of time as determined by the Secretary, with 10 such incentives to include, but not be limited to, the fol-11 lowing: allow such nonprofit entities and public housing 12 authorities to earn a Return on Investment on their own 13 resources to include proceeds from low income housing tax 14 credit syndication, own contributions, grants, and devel-15 oper loans at favorable rates and terms, invested in a deal; 16 and allow reimbursement of organizational costs associ-17 ated with owner’s oversight of asset referred to as ‘‘Asset 18 Management Fee’’ of up to and other fi-8 nancial assistance including advances, payments and in-9 centives (including the ability of owners to obtain reason-10 able returns on investment) required by the Secretary: 11 Provided, That the Secretary shall, as part of the preser-12 vation and revitalization agreement, obtain a restrictive 13 use agreement consistent with the terms of the restruc-14 turing. 15 In be ap-8 plied to another farm labor multi-family housing project 9 financed under section 514 or 516 of the Act. 10 RURAL HOUSING VOUCHER ACCOUNT 11 For the rural housing voucher program as authorized 12 under section 542 of the Housing Act of 1949, but not-13 withstanding subsection (b) of such section, $48,000,000, 14 to remain available until expended: Provided, That the 15 funds made available under this heading shall be available 16 for rural housing vouchers to any low-income household 17 (including those not receiving rental assistance) residing 18 in a property financed with a section 515 loan which has 19 been prepaid or otherwise paid off after September 30, 20 2005: Provided further, That the amount of such voucher 21 shall be the difference between comparable market rent 22 for information technology services, and other 10 systems of the National Finance Center or to pay any un-11 foreseen, extraordinary cost of the National Finance Cen-12 ter: Provided further, That none of the amounts reserved 13 shall be available for obligation unless the Secretary sub-14 mits written notification of the obligation to the Commit-15 tees on Appropriations of both Houses of Congress: Pro-16 vided further, That the limitations on the obligation of 17 funds pending notification to Congressional Committees 18 shall not apply to any obligation that, as determined by 19 the Secretary, No funds appropriated by this Act may be 4 used to pay negotiated indirect cost rates on cooperative 5 agreements or similar arrangements between the United 6 States Department of Agriculture and nonprofit institu-7 tions in excess of 10 percent of the total direct cost of 8 the agreement when the purpose of such cooperative ar-9 rangements is to carry out programs of mutual interest 10 between the two parties. This does not preclude appro-11 priate payment of indirect costs on grants and contracts 12 with such institutions when such indirect costs are com-13 puted on a similar basis for all agencies for which appro-14 priations are provided in this Act. 15 S EC. 705. Appropriations to the Department of Agri-16 culture for the cost of direct and guaranteed loans made 17 available in the current fiscal year shall remain available 18 until expended to disburse obligations made in the current 19 fiscal year for the following accounts: the Rural Develop-20 ment Loan Fund program account, the Rural Electrifica-21 tion and Telecommunication Loans program account, and 22 the Rural Housing Insurance Fund program account. 23 S EC. 706. Notwithstanding any other provision of 6 law, any former Rural Utilities Service borrower that has 7 repaid or prepaid an insured, direct or guaranteed loan 8 under the Rural Electrification Act of 1936, or any not- 9 for-profit utility that is eligible to receive an insured or 10 direct loan under such Act, shall be eligible for assistance 11 under section 313B(a) of such Act in the same manner 12 as a borrower under such Act. 13 S EC. 709. Except as otherwise specifically provided 14 by law, not more than $20,000,000 in unobligated bal-15 ances from appropriations made available for salaries and 16 expenses in this Act for the Farm Service Agency shall 17 remain available through September 30, 2025, for infor-18 mation technology expenses. 19 S EC. 710. In the case of each program established 1 or amended by the Agricultural Act of 2014 (Public Law 2 113–79) or by a successor to that Act, other than by title 3 I or subtitle A of title III of such Act, or programs for 4 which indefinite amounts were provided in that Act, that 5 is authorized or required to be carried out using funds 6 of the Commodity Credit Corporation— 7 (1) such funds shall be available for salaries 8 and related administrative expenses, including tech-9 nical assistance, associated with the implementation 10 of the program, without regard to the limitation on 11 the total amount of allotments and fund transfers 12 contained in section 11 of the Commodity Credit 13 Corporation Charter Act (15 U.S.C. 714i); and 14 (2) the use of such funds for such purpose shall 15 not be considered to be a fund transfer or allotment 16 for purposes of applying the limitation on the total 17 amount of allotments and fund transfers contained 18 in such section. 19 S EC. 712. (a) None of the funds made available in 3 this Act may be used to maintain or establish a computer 4 network unless such network blocks the viewing, 5 downloading, and exchanging of pornography. 6 (b) Nothing in subsection (a) shall limit the use of 7 funds necessary for any Federal, State, tribal, or local law 8 enforcement agency or any other entity carrying out crimi-9 nal investigations, prosecution, or adjudication activities. 10 S EC. 714. 15 (2) realigning or reorganizing new, current, or 16 vacant positions or agency activities or functions to 17 establish a center, office, branch, or similar entity 18 with three or more personnel; or 19 (3) carrying out activities or functions that 20 were not described in the budget request; Notwithstanding section 310B(g)(5) of the 9 Consolidated Farm and Rural Development Act (7 U.S.C. 10 1932(g)(5)), the Secretary may assess a one-time fee for 11 any guaranteed business and industry loan in an amount 12 that does not exceed 3 percent of the guaranteed principal 13 portion of the loan. 14 S EC. 718. No employee of the Department of Agri-9 culture may be detailed or assigned from an agency or 10 office funded by this Act or any other Act to any other 11 agency or office of the Department for more than 60 days 12 in a fiscal year unless the individual’s employing agency 13 or office is fully reimbursed by the receiving agency or 14 office for the salary and expenses of the employee for the 15 period of assignment. 16 S EC. 721. Reg. 90675) until the Secretary of Agri-7 culture amends the definition of the term ‘‘variety’’ as de-8 fined in section 278.1(b)(1)(ii)(C) of title 7, Code of Fed-9 eral Regulations, and ‘‘variety’’ as applied in the definition 10 of the term ‘‘staple food’’ as defined in section 271.2 of 11 title 7, Code of Federal Regulations, to increase the num-12 ber of items that qualify as acceptable varieties in each 13 staple food category so that the total number of such items 14 in each staple food category exceeds the number of such 15 items in each staple food category included in the final 16 rule as published on December 15, 2016: Provided, That 17 until the Secretary promulgates such regulatory amend-18 ments, the Secretary shall apply the requirements regard-19 ing acceptable varieties and breadth of stock to Supple-20 mental Nutrition Assistance Program retailers that were 21 in effect on the day before the date of the enactment of 22 the Agricultural Act of 2014 (Public Law 113–79). 23 S EC. 728. (a) The Secretary of Agriculture shall— 1 (1) conduct audits in a manner that evaluates 2 the following factors in the country or region being 3 audited, as applicable— 4 (A) veterinary control and oversight; 5 (B) disease history and vaccination prac-6 tices; 7 (C) livestock demographics and 8 traceability; 9 (D) epidemiological separation from poten-10 tial sources of infection; 11 (E) surveillance practices; 12 (F) diagnostic laboratory capabilities; and 13 (G) emergency preparedness and response; 14 and 15 (2) promptly make publicly available the final 16 reports of any audits or reviews conducted pursuant 17 to subsection (1). 18 (b) This section shall be applied in a manner con-19 sistent with United States obligations under its inter-20 national trade agreements. 21 S EC. 735. None of the funds appropriated by this Act 7 may be used in any way, directly or indirectly, to influence 8 congressional action on any legislation or appropriation 9 matters pending before Congress, other than to commu-10 nicate to Members of Congress as described in 18 U.S.C. 11 1913. 12 S EC. 737. None of the funds made available by this 13 or any other Act thereafter may be used to write, prepare, 14 or publish a proposed rule, final rule, or an interim final 15 rule in furtherance of, or otherwise to implement or en-16 force the proposed rule entitled ‘‘Transparency in Poultry 17 Grower Contracting and Tournaments,’’ published by the 18 Department of Agriculture in the Federal Register on 19 June 8, 2022 (87 Fed. There is rescinded the unobligated bal-15 ances of amounts made available under section 1006 of 16 the American Rescue Plan Act of 2021 (7 U.S.C. 2279 17 note). 18 S EC. 742. None of the funds made available by this 5 or any other Act may be used to enforce the final rule 6 promulgated by the Food and Drug Administration enti-7 tled ‘‘Standards for the Growing, Harvesting, Packing, 8 and Holding of Produce for Human Consumption,’’ and 9 published on November 27, 2015, with respect to the regu-10 lation of entities that grow, harvest, pack, or hold wine 11 grapes, hops, pulse crops, or almonds. 12 S EC. 744. For school years 2023–2024 and 2024– 13 2025, none of the funds made available by this Act may 14 be used to implement or enforce the matter following the 15 first comma in the second sentence of footnote (c) of sec-16 tion 220.8(c) of title 7, Code of Federal Regulations, with 17 respect to the substitution of vegetables for fruits under 18 the school breakfast program established under section 4 19 of the Child Nutrition Act of 1966 (42 U.S.C. 1773). 20 S EC. 745. The Secretary of Agriculture may waive 10 the matching funds requirement under section 412(g) of 11 the Agricultural Research, Extension, and Education Re-12 form Act of 1998 (7 U.S.C. 7632(g)). 13 S EC. 747. There is rescinded the unobligated bal-14 ances of amounts made available under section 22006 of 15 Public Law 117-169 (136 Stat. 2021). 16 S EC. 749. Funds made available under title II of the 11 Food for Peace Act (7 U.S.C. 1721 et seq.) may only be 12 used to provide assistance to recipient nations if adequate 13 monitoring and controls, as determined by the Adminis-14 trator, are in place to ensure that emergency food aid is 15 received by the intended beneficiaries in areas affected by 16 food shortages and not diverted for unauthorized or inap-17 propriate purposes. 18 S EC. 751. None of the funds made available by this 19 Act may be used to procure raw or processed poultry prod-20 ucts imported into the United States from the People’s 21 Republic of China for use in the school lunch program 22 under the Richard B. (a) Subject to subsection (c), none of the 5 funds made available by this Act may be used to finalize, 6 issue, implement, administer, or enforce any rule, regula-7 tion, or order that, pursuant to any revisions to the whole 8 grain requirements under section 246.10 of title 7, Code 9 of Federal Regulations, required by such rule, regulation, 10 or order, would reduce the availability of WIC-eligible 11 breakfast cereals, including the rule entitled ‘‘Special Sup-12 plemental Nutrition Program for Women, Infants, and 13 Children (WIC): Revisions to the WIC Food Packages’’ 14 published by the Department of Agriculture in the Federal 15 Register on November 21, 2022 (87 Fed. For school year 2024–2025, only a school 3 food authority that had a negative balance in the nonprofit 4 school food service account as of June 30, 2023, shall be 5 required to establish a price for paid lunches in accordance 6 with section 12(p) of the Richard B. Russell National 7 School Lunch Act (42 U.S.C. 1760(p)). 8 S EC. 754. None of the funds made available by this 9 Act may be made available to support, directly or indi-10 rectly, the Wuhan Institute of Virology, or any laboratory 11 owned or controlled by the governments of the People’s 12 Republic of China, the Republic of Cuba, the Islamic Re-13 public of Iran, the Democratic People’s Republic of Korea, 14 the Russian Federation, the Bolivarian Republic of Ven-15 ezuela under the regime of Nicola´s Maduro Moros, or any 16 other country determined by the Secretary of State to be 17 a foreign adversary. 18 S EC. 755. Notwithstanding any other provision of 3 law, no funds available to the Department of Agriculture 4 may be used to move any staff office or any agency from 5 the mission area in which it was located on August 1, 6 2018, to any other mission area or office within the De-7 partment in the absence of the enactment of specific legis-8 lation affirming such move. 9 S EC. 757. None of the funds made available by this 10 Act may be used to carry out any program, project, or 11 activity that promotes or advances Critical Race Theory 12 or any concept associated with Critical Race Theory. 13 S EC. 758. The Secretary, acting through the Chief 14 of the Natural Resources Conservation Service, may use 15 funds appropriated under this Act or any other Act for 16 the Watershed and Flood Prevention Operations Program 17 and the Watershed Rehabilitation Program carried out 18 pursuant to the Watershed Protection and Flood Preven-19 tion Act (16 U.S.C. 1001 et seq.), and for the Emergency 20 Watershed Protection Program carried out pursuant to 21 section 403 of the Agricultural Credit Act of 1978 (16 22 U.S.C. 2203) to provide technical services for such pro-23 grams pursuant to section 1252(a)(1) of the Food Secu-24 VerDate Sep 11 2014 00:10 Jun 28, 2023 Jkt 039200 PO 00000 Frm 00107 Fmt 6652 Sfmt 6201 E:\BILLS\H4368.RH H4368 kjohnson on DSK79L0C42PROD with BILLS 108 •HR 4368 RH rity Act of 1985 (16 U.S.C. 3851(a)(1)), notwithstanding 1 subsection (c) of such section. 2 S EC. 759. In administering the pilot program estab-3 lished by section 779 of division A of the Consolidated Ap-4 propriations Act, 2018 (Public Law 115–141), the Sec-5 retary of Agriculture may, for purposes of determining en-6 tities eligible to receive assistance, consider those commu-7 nities which are ‘‘Areas Rural in Character’’: Provided, 8 That not more than 10 percent of the funds made avail-9 able under the heading ‘‘Distance Learning, Telemedicine, 10 and Broadband Program’’ for the purposes of the pilot 11 program established by section 779 of Public Law 115– 12 141 may be used for this purpose. 13 S EC. 760. (a) The modifications made by the Food 1 and Drug Administration on January 3, 2023 to the risk 2 evaluation and mitigation strategy under section 505-1 of 3 the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 4 355-1) for mifepristone are hereby nullified. 5 (b) None of the funds made available by this Act may 6 be used to establish, implement, or enforce— 7 (1) any provision of a risk evaluation and miti-8 gation strategy under section 505-1 of the Federal 9 Food, Drug, and Cosmetic Act (21 U.S.C. 355-1) 10 for mifepristone that is substantially similar to any 11 of the modifications nullified by subsection (a); or 12 (2) any non-enforcement or enforcement discre-13 tion policy for any provision of a risk evaluation and 14 mitigation strategy under such section for 15 mifepristone. 16 S EC. 762. None of the funds appropriated or other-17 wise made available by this Act may be used by FDA to 18 develop, issue, promote, or advance any new guidelines or 19 regulations applicable to food manufacturers for popu-20 lation-wide sodium reduction actions until the issuance of 21 the 2025-2026 National Health and Nutrition Examina-22 tion Survey (NHANES) survey that will show consumer 23 sodium consumption after the completion of the short- 24 term sodium reduction targets. 25 VerDate Sep 11 2014 00:10 Jun 28, 2023 Jkt 039200 PO 00000 Frm 00109 Fmt 6652 Sfmt 6201 E:\BILLS\H4368.RH H4368 kjohnson on DSK79L0C42PROD with BILLS 110 •HR 4368 RH SEC. 763. Within 60 days of enactment of this Act 1 the Secretary shall provide to the Committees a plan for 2 expenditure that accelerates the continued implementation 3 and expansion of the Farmers.gov application and the En-4 terprise Data Analytics Platform and Toolset (EDAPT) 5 to enable USDA users to: (1) view their information, com-6 plete transactions, quickly review the status, and update 7 tabular customer information; (2) submit applications for 8 Farm Production and Conservation programs and receive 9 program payments for all USDA farm programs; (3) to 10 complete their own applications, including electronic sig-11 natures and submission, for all farm programs that re-12 quire direct application; (4) enable electronic income re-13 porting between USDA and IRS; and (5) transition acre-14 age reporting, farm records mapping, and farm records 15 information to Farmers.gov: Provided, That the Farm 16 Production and Conservation Business Center shall pro-17 vide a roadmap for systems to be decommissioned and 18 consolidated with Farmers.gov and EDAPT including, but 19 not limited to, the Agriculture Risk Coverage (ARC) and 20 Price Loss Coverage (PLC) programs, the Dairy Margin 21 Coverage program, and the Farm Service Agency Emer-22 gency Relief Program. 23 S EC. 764. Reg. 34593, relating 10 to diversity, equity, inclusion, and accessibility in the Fed-11 eral workforce), or Executive Order 14091 of February 12 16, 2023 (88 Fed. The Secretary of Agriculture shall take 17 such actions as may be necessary to prohibit the purchase 18 of agricultural land located in the United States by non- 19 resident aliens, foreign businesses, of any agent, trustee, 20 or fiduciary associated with Russia, North Korea, Iran, 21 or the Communist Party of China. 22 S EC. 766. Russell National 6 School Lunch Act (42 U.S.C. 1751 et seq.); 7 (B) under the school breakfast program es-8 tablished under the Child Nutrition Act of 1966 9 (42 U.S.C. 1771 et seq.); 10 (C) as a competitive food available on cam-11 pus during the school day; and 12 (D) to children ages 5 years and older 13 under the child and adult care food program es-14 tablished under section 17 of the Richard B. 15 Russell National School Lunch Act (42 U.S.C. 16 1766); and 17 (2) with respect to weekly sodium limitations to 18 meals and supplements served during such period 19 under the school lunch program established under 20 the Richard B. None of the funds made available by this 11 Act may be used to finalize, implement, administer, or en-12 force any rule that would reduce the maximum monthly 13 allowance with respect to milk under section 246.10 of 14 title 7, Code of Federal Regulations (as in effect on April 15 1, 2023), including the rule entitled ‘‘Special Supple-16 mental Nutrition Program for Women, Infants, and Chil-17 dren (WIC): Revisions to the WIC Food Packages’’ pub-18 lished by the Department of Agriculture in the Federal 19 Register on November 21, 2022 (87 Fed. Reg. 71090). 20 S EC. 768. None of the funds provided by this Act, 4 or provided from any accounts in the Treasury of the 5 United States derived by the collection of fees available 6 to the agencies funded by this Act, may be used by the 7 Secretary of Health and Human Services to finalize, issue, 8 or implement any rule, regulation, notice of proposed rule-9 making, or order setting any tobacco product standard 10 that would prohibit menthol as a characterizing flavor in 11 cigarettes or prohibit characterizing flavors in all cigars 12 and their components and parts. 13 S EC. 770. In this fiscal year and each fiscal year 14 thereafter, and notwithstanding any other provision of 15 law, none of the funds made available by this or any other 16 Act may be used to implement section 3.7(f) of the Farm 17 Credit Act of 1971 in a manner inconsistent with section 18 343(a)(13) of the Consolidated Farm and Rural Develop-19 ment Act. 20 S EC. 771. Russell National School Lunch Act 8 (42 U.S.C. 1769), the summer food service program as 9 established under section 13 of the Richard B. Russell Na-10 tional School Lunch Act, the child and adult care food 11 program as established by section 17 of the Richard B. 12 Russell National School Lunch Act, or the school break-13 fast program established by the Child Nutrition Act of 14 1966 (42 U.S.C. 1773) in either a Bureau-funded school 15 (as defined in section 1141 of the Education Amendments 16 of 1978 (25 U.S.C. 2021)); a school (as defined in section 17 12(d) of the Richard B. Russell National School Lunch 18 Act (42 U.S.C. 1760 (d)) on or near an Indian reserva-19 tion; or an early child care and education facility: Pro-20 vided, That to carry out this pilot program each grant 21 awarded shall be no less than $10,000 and no more than 22 $100,000 for each school year and shall not increase state 23 administrative costs or the amount of benefits provided 24 in any program: Provided further, That the term ‘‘Indian 25 VerDate Sep 11 2014 00:10 Jun 28, 2023 Jkt 039200 PO 00000 Frm 00115 Fmt 6652 Sfmt 6201 E:\BILLS\H4368.RH H4368 kjohnson on DSK79L0C42PROD with BILLS 116 •HR 4368 RH tribe’’ has the meaning given the term in section 4 of the 1 Indian Self-Determination and Education Assistance Act 2 (25 U.S.C. 5304). 3 (b) Notwithstanding any other provision of law, a 4 pilot project grant recipient shall be reimbursed for meals 5 served under the school lunch program, the summer food 6 service program, and the child and adult care food pro-7 gram as if the recipient were a State under the Richard 8 B. Russell National School Lunch Act; and under the 9 school breakfast program as if the recipient were a State 10 educational agency. 11 (c) Not later than 1 year after the conclusion of the 12 pilot program, the Secretary shall submit to Congress a 13 report on the outcomes of the pilot program. 14 S EC. 772. None of the funds made available by this 3 Act may be used by the Food and Drug Administration 4 to issue, promote, or advance any new guideline or regula-5 tion applicable to food manufacturers for Listeria 6 monocytogenes (Lm) until the Food and Drug Adminis-7 tration, based on the available new science, incorporates 8 into the Compliance Policy Guide (CPG), Guidance for 9 FDA Staff, Sec. 555.320, a tolerance for Listeria 10 monocytogenes in low-risk foods, meaning foods that do 11 not support the growth of Listeria monocytogenes. 12 S EC. 775.
