3333 TION INPUBLICACCOMMODATIONS.—Section 201 of the 3
3434 Civil Rights Act of 1964 (42 U.S.C. 2000a) is amended— 4
3535 (1) in subsection (a), by inserting ‘‘sex (includ-5
3636 ing sexual orientation and gender identity),’’ before 6
3737 ‘‘or national origin’’; and 7
3838 (2) in subsection (b)— 8
3939 (A) in paragraph (3), by striking ‘‘sta-9
4040 dium’’ and all that follows and inserting ‘‘sta-10
4141 dium or other place of or establishment that 11
4242 provides exhibition, entertainment, recreation, 12
4343 exercise, amusement, gathering, or display;’’; 13
4444 (B) by redesignating paragraph (4) as 14
4545 paragraph (6); and 15
4646 (C) by inserting after paragraph (3) the 16
4747 following: 17
4848 ‘‘(4) any establishment that provides a good, 18
4949 service, or program, including a store, shopping cen-19
5050 ter, online retailer or service provider, salon, bank, 20
5151 gas station, food bank, service or care center, shel-21
5252 ter, travel agency, or funeral parlor, or establish-22
5353 ment that provides health care, accounting, or legal 23

9696 ENDER IDENTITY.—The term ‘gender 4
9797 identity’ means the gender-related identity, appear-5
9898 ance, mannerisms, or other gender-related character-6
9999 istics of an individual, regardless of the individual’s 7

103103 including, but not limited to, consistent with the 10
104104 term’s standard meaning in Federal law. 11

106106 EX.—The term ‘sex’ includes— 12
107107 ‘‘(A) a sex stereotype; 13
108108 ‘‘(B) pregnancy, childbirth, or a related 14
109109 medical condition; 15
110110 ‘‘(C) sexual orientation or gender identity; 16

112112 ‘‘(D) sex characteristics, including intersex 18

115115 EXUAL ORIENTATION .—The term ‘sexual 20
116116 orientation’ means homosexuality, heterosexuality, or 21

134134 LAIMS ANDREMEDIESNOTPRECLUDED.— 9
135135 Nothing in this title shall be construed to limit the claims 10
136136 or remedies available to any individual for an unlawful 11
137137 practice on the basis of race, color, religion, sex (including 12
138138 sexual orientation and gender identity), or national origin 13
139139 including claims brought pursuant to section 1979 or 14
140140 1980 of the Revised Statutes (42 U.S.C. 1983, 1985) or 15
141141 any other law, including the Federal law amended by the 16
142142 Customer Non-Discrimination Act, regulation, or policy. 17
143143 ‘‘(b) N
144144 ONEGATIVEINFERENCE.—Nothing in this 18
145145 title shall be construed to support any inference that any 19
146146 Federal law prohibiting a practice on the basis of sex does 20
147147 not prohibit discrimination on the basis of pregnancy, 21
148148 childbirth, or a related medical condition, sexual orienta-22
149149 tion, gender identity, or a sex stereotype. 23

151151 COPE OF ANESTABLISHMENT.—A reference in 24
152152 this title to an establishment— 25

158158 vider of a good, service, or program; and 3

161161 ‘‘SEC. 210. CLAIMS. 6
162162 ‘‘The Religious Freedom Restoration Act of 1993 (42 7
163163 U.S.C. 2000bb et seq.) shall not provide a claim con-8
164164 cerning, or a defense to a claim under this title or provide 9
165165 a basis for challenging the application or enforcement of 10
166166 this title.’’. 11
