20	20	basis of sex, gender identity, and sexual orientation, and
21	21	for other purposes.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Customer Non-Dis-4
26	26	crimination Act’’. 5

32	32	ROHIBITION ONDISCRIMINATION ORSEGREGA-2
33	33	TION INPUBLICACCOMMODATIONS.—Section 201 of the 3
34	34	Civil Rights Act of 1964 (42 U.S.C. 2000a) is amended— 4
35	35	(1) in subsection (a), by inserting ‘‘sex (includ-5
36	36	ing sexual orientation and gender identity),’’ before 6
37	37	‘‘or national origin’’; and 7
38	38	(2) in subsection (b)— 8
39	39	(A) in paragraph (3), by striking ‘‘sta-9
40	40	dium’’ and all that follows and inserting ‘‘sta-10
41	41	dium or other place of or establishment that 11
42	42	provides exhibition, entertainment, recreation, 12
43	43	exercise, amusement, gathering, or display;’’; 13
44	44	(B) by redesignating paragraph (4) as 14
45	45	paragraph (6); and 15
46	46	(C) by inserting after paragraph (3) the 16
47	47	following: 17
48	48	‘‘(4) any establishment that provides a good, 18
49	49	service, or program, including a store, shopping cen-19
50	50	ter, online retailer or service provider, salon, bank, 20
51	51	gas station, food bank, service or care center, shel-21
52	52	ter, travel agency, or funeral parlor, or establish-22
53	53	ment that provides health care, accounting, or legal 23
54	54	services; 24
55	55	‘‘(5) any train service, bus service, car service, 25
56	56	taxi service, airline service, station, depot, or other 26

65	65	2000a–1) is amended by inserting ‘‘sex (including sexual 5
66	66	orientation and gender identity),’’ before ‘‘or national ori-6
67	67	gin’’. 7

70	70	Title II of such Act (42 U.S.C. 2000a et seq.) is amended 9
71	71	by adding at the end the following: 10
72	72	‘‘SEC. 208. DEFINITIONS AND RULES. 11

77	77	ORIENTATION; GENDER IDENTITY ; NATIONAL ORI-14
78	78	GIN.—The term ‘race’, ‘color’, ‘religion’, ‘sex (includ-15
79	79	ing sexual orientation and gender identity)’, or ‘na-16
80	80	tional origin’, used with respect to an individual, in-17
81	81	cludes— 18
82	82	‘‘(A) the race, color, religion, sex (includ-19
83	83	ing sexual orientation and gender identity), or 20
84	84	national origin, respectively, of another person 21
85	85	with whom the individual is associated or has 22
86	86	been associated; and 23
87	87	‘‘(B) a perception or belief, even if inac-24
88	88	curate, concerning the race, color, religion, sex 25

96	96	ENDER IDENTITY.—The term ‘gender 4
97	97	identity’ means the gender-related identity, appear-5
98	98	ance, mannerisms, or other gender-related character-6
99	99	istics of an individual, regardless of the individual’s 7
100	100	designated sex at birth. 8
101	101	‘‘(3) I
102	102	NCLUDING.—The term ‘including’ means 9
103	103	including, but not limited to, consistent with the 10
104	104	term’s standard meaning in Federal law. 11
105	105	‘‘(4) S
106	106	EX.—The term ‘sex’ includes— 12
107	107	‘‘(A) a sex stereotype; 13
108	108	‘‘(B) pregnancy, childbirth, or a related 14
109	109	medical condition; 15
110	110	‘‘(C) sexual orientation or gender identity; 16
111	111	and 17
112	112	‘‘(D) sex characteristics, including intersex 18
113	113	traits. 19

115	115	EXUAL ORIENTATION .—The term ‘sexual 20
116	116	orientation’ means homosexuality, heterosexuality, or 21
117	117	bisexuality. 22
118	118	‘‘(b) R
119	119	ULES.—In this title— 23
120	120	‘‘(1) (with respect to sex) pregnancy, childbirth, 24
121	121	or a related medical condition shall not receive less 25

127	127	‘‘(2) (with respect to gender identity) an indi-3
128	128	vidual shall not be denied access to a shared facility, 4
129	129	including a restroom, a locker room, and a dressing 5
130	130	room, that is in accordance with the individual’s 6
131	131	gender identity. 7
132	132	‘‘SEC. 209. RULES OF CONSTRUCTION. 8

134	134	LAIMS ANDREMEDIESNOTPRECLUDED.— 9
135	135	Nothing in this title shall be construed to limit the claims 10
136	136	or remedies available to any individual for an unlawful 11
137	137	practice on the basis of race, color, religion, sex (including 12
138	138	sexual orientation and gender identity), or national origin 13
139	139	including claims brought pursuant to section 1979 or 14
140	140	1980 of the Revised Statutes (42 U.S.C. 1983, 1985) or 15
141	141	any other law, including the Federal law amended by the 16
142	142	Customer Non-Discrimination Act, regulation, or policy. 17
143	143	‘‘(b) N
144	144	ONEGATIVEINFERENCE.—Nothing in this 18
145	145	title shall be construed to support any inference that any 19
146	146	Federal law prohibiting a practice on the basis of sex does 20
147	147	not prohibit discrimination on the basis of pregnancy, 21
148	148	childbirth, or a related medical condition, sexual orienta-22
149	149	tion, gender identity, or a sex stereotype. 23
150	150	‘‘(c) S
151	151	COPE OF ANESTABLISHMENT.—A reference in 24
152	152	this title to an establishment— 25

157	157	whose operations affect commerce and who is a pro-2
158	158	vider of a good, service, or program; and 3
159	159	‘‘(2) shall not be construed to be limited to a 4
160	160	physical facility or place. 5
161	161	‘‘SEC. 210. CLAIMS. 6
162	162	‘‘The Religious Freedom Restoration Act of 1993 (42 7
163	163	U.S.C. 2000bb et seq.) shall not provide a claim con-8
164	164	cerning, or a defense to a claim under this title or provide 9
165	165	a basis for challenging the application or enforcement of 10
166	166	this title.’’. 11
