Us Congress House Bill HB4479

Introduced
7/6/23

Caption

Positioning the Election Assistance Commission for the Future Act of 2023

Impact

The proposed changes would strengthen the EAC's position in the electoral process by centralizing authority for federal election administration and establishing clear financial parameters for states receiving funds for election-related activities. Moreover, the bill explicitly prohibits EAC funds from being used for get-out-the-vote activities, thereby limiting how state and local governments can utilize federal funds provided under this act. This aspect of the legislation reflects a significant shift in how election assistance funds can be deployed, possibly aiming to distance federal involvement in direct voter mobilization efforts.

Summary

House Bill 4479, known as the ‘Positioning the Election Assistance Commission for the Future Act of 2023,’ seeks to amend the Help America Vote Act of 2002. The bill aims to improve the administration of the Election Assistance Commission (EAC) by affirming its role as the primary federal agency overseeing election administration matters and providing greater funding and staffing capabilities. This includes an increase in the EAC's employee cap from unspecified additional personnel to a maximum of 55 full-time equivalents, as well as an increase in appropriated grant funds from $10 million to $25 million annually for the fiscal years 2024 to 2026.

Contention

Discussions around HB4479 may touch upon various contentious points, particularly focusing on the balance of power between federal and state jurisdictions in administering elections. Some critics argue that centralizing election administration within the EAC could undermine state autonomy in managing their electoral processes. Others may express concern regarding the prohibition of using funds for get-out-the-vote efforts, posing questions about the implications this could have on voter turnout and civic engagement in federal elections. Overall, while the bill aims to streamline election administration and enhance efficiency, its impact on local governance and voter engagement remains a point of discussion.
