Building Chips in America Act of 2023

Impact

The fundamental change proposed by HB4549 will allow for federal financial assistance for semiconductor projects without the heavy burdens associated with NEPA requirements, under certain conditions. Projects that receive assistance and meet specific criteria, such as commencing before securing federal aid or demonstrably falling under existing local environmental regulations, can potentially bypass extensive federal reviews. This could significantly streamline the process for companies looking to expand or modernize their semiconductor facilities, with the intention of enhancing production capabilities domestically.

Summary

House Bill 4549, also known as the Building Chips in America Act of 2023, aims to amend the National Defense Authorization Act concerning environmental reviews related to semiconductor production projects. The bill primarily seeks to clarify what constitutes a major federal action under the National Environmental Policy Act (NEPA) specifically for certain semiconductor projects, thereby facilitating quicker federal approvals for these initiatives. This is particularly pertinent as the U.S. boosts its semiconductor manufacturing capabilities in response to global supply chain disruptions.

Contention

However, moving away from stringent NEPA processes raises concerns regarding environmental oversight. Critics argue that the reduction of federal scrutiny could lead to inadequate environmental protections and force state agencies to shoulder responsibilities without the necessary federal support. The bill indicates that states can assume some responsibilities under NEPA, but with restrictions that might limit their authority. This delegation of responsibility is contentious and has generated discussion about the balance of power between state and federal agencies in overseeing substantial construction and expansion projects.

Lower Energy Costs Act This bill provides for the exploration, development, importation, and exportation of energy resources (e.g., oil, gas, and minerals). For example, it sets forth provisions to (1) expedite energy projects, (2) eliminate or reduce certain fees related to the development of federal energy resources, and (3) eliminate certain funds that provide incentives to decrease emissions of greenhouse gases. The bill expedites the development, importation, and exportation of energy resources, including by waiving environmental review requirements and other specified requirements under certain environmental laws, eliminating certain restrictions on the import and export of oil and natural gas, prohibiting the President from declaring a moratorium on the use of hydraulic fracturing (a type of process used to extract underground energy resources), directing the Department of the Interior to conduct sales for the leasing of oil and gas resources on federal lands and waters as specified by the bill, and limiting the authority of the President and executive agencies to restrict or delay the development of energy on federal land. In addition, the bill reduces royalties for oil and gas development on federal land and eliminates charges on methane emissions. It also eliminates a variety of funds, such as funds for energy efficiency improvements in buildings as well as the greenhouse gas reduction fund.
