18	18	To amend the Higher Education Act of 1965 to provide
19	19	additional amounts of loan forgiveness to teachers of
20	20	English learners and teachers of bilingual and dual lan-
21	21	guage immersion students, and for other purposes.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Supporting Providers 4
26	26	of English Language Learning Act’’ or the ‘‘SPELL Act’’. 5

33	33	OANFORGIVENESS FOR TEACHERS.—Section 3
34	34	428J(c)(3) of the Higher Education Act of 1965 (20 4
35	35	U.S.C. 1078–10(c)(3)) is amended— 5
36	36	(1) in the paragraph heading by striking 6
37	37	‘‘M
38	38	ATHEMATICS, SCIENCE, OR SPECIAL EDUCATION ’’ 7
39	39	and inserting ‘‘M
40	40	ATHEMATICS, SCIENCE, SPECIAL 8
41	41	EDUCATION, OR ENGLISH LANGUAGE EDUCATION ’’; 9
42	42	(2) in subparagraph (A)(ii) by striking ‘‘and’’ 10
43	43	at the end; 11
44	44	(3) in subparagraph (B)(iii) by striking the pe-12
45	45	riod at the end and inserting ‘‘; and’’; and 13
46	46	(4) by adding at the end the following: 14
47	47	‘‘(C) an elementary school or secondary 15
48	48	school teacher— 16
49	49	‘‘(i) who meets the requirements of 17
50	50	subsection (b); 18
51	51	‘‘(ii) whose qualifying employment for 19
52	52	purposes of such subsection is— 20
53	53	‘‘(I) as a teacher of English 21
54	54	learners (as that term is defined in 22
55	55	section 8101 of the Elementary and 23
56	56	Secondary Education Act of 1965 (20 24
57	57	U.S.C. 7801)) whose primary respon-25
58	58	sibility is to teach such learners; or 26

63	63	guage immersion teacher; and 2
64	64	‘‘(iii) who, as certified by the chief ad-3
65	65	ministrative officer of the public or non-4
66	66	profit private elementary school or sec-5
67	67	ondary school in which the borrower is em-6
68	68	ployed, or, in the case of a teacher who is 7
69	69	employed by an educational service agency, 8
70	70	as certified by the chief administrative offi-9
71	71	cer of such agency— 10
72	72	‘‘(I) is teaching English learners 11
73	73	or bilingual or dual language immer-12
74	74	sion students who correspond with the 13
75	75	borrower’s training; and 14
76	76	‘‘(II) has demonstrated knowl-15
77	77	edge and teaching skills in the content 16
78	78	areas of the elementary school or sec-17
79	79	ondary school curriculum that the 18
80	80	borrower is teaching.’’. 19

82	82	OANCANCELLATION FOR TEACHERS.—Section 20
83	83	460(c)(3) of the Higher Education Act of 1965 (20 U.S.C. 21
84	84	1087j(c)(3)) is amended— 22
85	85	(1) in the paragraph heading by striking 23

132	132	SEC. 3. APPLICABILITY. 14
133	133	The amendments made by section 2 shall take effect 15
134	134	on the date of the enactment of this Act and shall apply 16
135	135	with respect to individuals who are eligible to receive 17
136	136	teacher loan forgiveness under section 428J of the Higher 18
137	137	Education Act of 1965 (20 U.S.C. 1078–10) or teacher 19
138	138	loan cancellation under section 460 of such Act (20 U.S.C. 20
139	139	1087j) after such date. 21
