1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Choice in Affordable 4
1919 Housing Act of 2023’’. 5
2020 SEC. 2. DEFINITIONS. 6
2121 In this Act— 7
2222 (1) the term ‘‘Housing Choice Voucher pro-8

3131 SEC. 3. FINDINGS. 5
3232 Congress finds the following: 6
3333 (1) The Housing Choice Voucher program is 7
3434 the Federal Government’s largest program helping 8
3535 low-income families, the elderly, and persons with 9
3636 disabilities to afford decent, safe, and sanitary hous-10
3737 ing in the private market. 11
3838 (2) The Housing Choice Voucher program is 12
3939 proven to have positive impacts on voucher holders, 13
4040 including increased housing stability, reduced home-14
4141 lessness, and children lifted out of poverty. 15
4242 (3) As a public-private partnership, the Hous-16
4343 ing Choice Voucher program relies on the willingness 17
4444 of private landlords to accept vouchers. 18
4545 (4) Landlord participation is declining in the 19
4646 Housing Choice Voucher program, with an average 20
4747 of 10,000 housing providers leaving the program 21
4848 each year between 2010 and 2016. 22
4949 (5) Landlord participation is especially lacking 23
5050 in ‘‘high-opportunity neighborhoods’’ that have low 24

5757 to conduct research on landlord participation in the 4
5858 Housing Choice Voucher program. 5
5959 (7) The Moving to Work demonstration pro-6
6060 gram of the Department of Housing and Urban De-7
6161 velopment has given participating public housing 8
6262 agencies the ability to test innovative strategies to 9
6363 incentivize landlords to accept vouchers. 10
6464 SEC. 4. SENSE OF CONGRESS. 11
6565 It is the sense of Congress that— 12
6666 (1) the Housing Choice Voucher program 13
6767 should be improved to increase the number of land-14
6868 lords, particularly landlords with units in high-op-15
6969 portunity neighborhoods, who accept vouchers in 16
7070 order to expand housing choice and opportunity, and 17
7171 further fair housing; and 18
7272 (2) Federal programs to help people afford safe 19
7373 and decent housing are important in all commu-20
7474 nities, including urban, rural, and tribal areas. 21

8181 NE-TIMEINCENTIVEPAYMENTS.—Section 8(o) 3
8282 of the United States Housing Act of 1937 (42 U.S.C. 4
8383 1437f(o)), is amended by adding at the end the following: 5

8585 NE-TIME INCENTIVE PAYMENTS .— 6

8787 EFINITION.—In this paragraph, the 7
8888 term ‘eligible unit’ means a dwelling unit 8
8989 that— 9
9090 ‘‘(i) is located in a census tract with 10
9191 a poverty rate of less than 20 percent; and 11
9292 ‘‘(ii) has not previously been subject 12
9393 to a housing assistance payment contract 13
9494 under this subsection. 14

9696 NCENTIVE PAYMENT AUTHORITY .— 15
9797 ‘‘(i) I
9898 N GENERAL.—To incentivize 16
9999 landlords who own dwelling units in low- 17
100100 poverty areas to enter into housing assist-18
101101 ance payment contracts under this sub-19
102102 section, the Secretary shall provide assist-20
103103 ance under this paragraph to public hous-21
104104 ing agencies to be used to offer a one-time 22
105105 payment directly to the owner of an eligi-23
106106 ble unit entering into a housing assistance 24
107107 payment contract with the public housing 25
108108 agency for the eligible unit. 26

113113 centive payment made to an eligible owner 2
114114 under clause (i) may not exceed 200 per-3
115115 cent of the monthly housing assistance 4
116116 payment made to the eligible owner for the 5
117117 eligible unit. 6

119119 ONDITIONS PERMITTED .—Sub-7
120120 ject to paragraph (7), a public housing 8
121121 agency may require the owner of an eligi-9
122122 ble unit, as a condition of receiving an in-10
123123 centive payment under clause (i), to com-11
124124 mit to lease the eligible unit to tenants as-12
125125 sisted under this subsection for more than 13

128128 IMIT.—The owner of an eligible 15
129129 unit may not receive more than 1 incentive 16
130130 payment under clause (i), regardless of— 17
131131 ‘‘(I) the number of eligible units 18
132132 owned by the owner; or 19
133133 ‘‘(II) the number of public hous-20
134134 ing agencies with which the owner has 21
135135 entered into housing assistance pay-22

149149 THORITY.—The Secretary shall provide assist-5
150150 ance to public housing agencies to be used to 6
151151 pay the owner of a dwelling unit assisted under 7
152152 this subsection for a security deposit, or a sub-8
153153 stantial portion thereof, on behalf of the tenant 9
154154 of the dwelling unit in accordance with subpara-10
155155 graph (B). 11

157157 INIMUM PHA REQUIREMENTS .—A 12
158158 public housing agency that receives assistance 13
159159 from the Secretary under subparagraph (A) 14
160160 shall administer the assistance in accordance 15
161161 with the following conditions: 16
162162 ‘‘(i) The public housing agency shall 17
163163 pay the owners of dwelling units assisted 18
164164 under this subsection for a security de-19
165165 posit, or a substantial portion thereof, in 20
166166 an amount determined by the public hous-21
167167 ing agency, on behalf of the tenants of the 22
168168 dwelling units. 23
169169 ‘‘(ii) In making payments to owners of 24
170170 dwelling units under clause (i), the public 25

175175 ers of dwelling units occupied by extremely 2
176176 low-income families. 3
177177 ‘‘(iii) The owner of a dwelling unit 4
178178 may deduct amounts from a security de-5
179179 posit payment received under clause (i) to 6
180180 cover damages beyond normal wear and 7
181181 tear caused by the tenant of the dwelling 8
182182 unit, any member of the tenant’s house-9
183183 hold, or any guest or other person under 10
184184 the tenant’s control. 11
185185 ‘‘(iv) The public housing agency shall 12
186186 conduct a damage claims process where-13
187187 by— 14
188188 ‘‘(I) in order to deduct amounts 15
189189 from a security deposit payment re-16
190190 ceived under clause (i), the owner of 17
191191 a covered dwelling unit must submit a 18
192192 claim to the public housing agency 19
193193 with an itemized list of damages and 20
194194 evidence and request reimbursement; 21
195195 and 22
196196 ‘‘(II) the tenant of a covered 23
197197 dwelling unit may refute a claim sub-24
198198 mitted under subclause (I). 25

205205 pair costs for which a tenant will be 4
206206 responsible; and 5
207207 ‘‘(II) notify a tenant, upon the 6
208208 tenant entering into a lease for a 7
209209 dwelling unit assisted under this sub-8
210210 section, of the amount described in 9
211211 subclause (I). 10
212212 ‘‘(vi) The public housing agency may 11
213213 determine what action to take if a tenant 12
214214 demonstrates an inability to pay the 13
215215 amount of repair costs for which the ten-14
216216 ant is responsible under clause (v). 15
217217 ‘‘(vii) At the end of a tenant’s occu-16
218218 pancy of a dwelling unit assisted under 17
219219 this subsection, the landlord shall return to 18
220220 the public housing agency any unused 19
221221 amount of a security deposit payment re-20
222222 ceived under clause (i). 21
223223 ‘‘(C) R
224224 ULE OF CONSTRUCTION .—Nothing 22
225225 in subparagraph (B) shall be construed to pro-23
226226 hibit a public housing agency from establishing 24
227227 additional conditions for the administration of 25

237237 1437f(o)), as amended by subsection (b), is amended by 6
238238 adding at the end the following: 7
239239 ‘‘(24) L
240240 ANDLORD LIAISON BONUS PAYMENTS .— 8
241241 ‘‘(A) I
242242 N GENERAL.—Each year, the Sec-9
243243 retary shall award 1 bonus payment to each 10
244244 public housing agency that employs, contracts 11
245245 with a service partner that employs, or dem-12
246246 onstrates an intent to employ or contract with 13
247247 a service partner that employs, not less than 1 14
248248 dedicated landlord liaison whose duties include, 15
249249 with respect to the tenant-based assistance pro-16
250250 gram under subsection (o)— 17
251251 ‘‘(i) conducting landlord outreach, re-18
252252 cruitment, and retention; 19
253253 ‘‘(ii) educating and training landlords 20
254254 regarding the program; and 21
255255 ‘‘(iii) operating a phone hotline, online 22
256256 portal, monitored email address, or other 23
257257 mechanism designated by the Secretary for 24

264264 EMONSTRATING COMPLIANCE .—The 3
265265 Secretary shall determine how a public housing 4
266266 agency may demonstrate that it offers or in-5
267267 tends to offer a landlord liaison service for pur-6
268268 poses of subparagraph (A). 7
269269 ‘‘(C) A
270270 MOUNT.—The Secretary shall estab-8
271271 lish an amount for the landlord liaison bonus 9
272272 payment authorized under subparagraph (A) 10
273273 that— 11
274274 ‘‘(i) may vary by region; 12
275275 ‘‘(ii) does not exceed the 150 percent 13
276276 of the average cost of employing, or con-14
277277 tracting with a service partner that em-15
278278 ploys, such a landlord liaison, based on 16
279279 local market conditions; and 17
280280 ‘‘(iii) is sufficient to incentivize public 18
281281 housing agencies to employ, or contact 19
282282 with a service partner that employs, such 20
283283 a landlord liaison.’’. 21

286286 United States Housing Act of 1937 (42 U.S.C. 1437f), 23

296296 Lashkowitz Housing Partnership Fund’, for the pur-5
297297 pose of incentivizing landlords to participate in the 6
298298 tenant-based assistance program under subsection 7
299299 (o) in accordance with paragraph (2) of this sub-8
300300 section. 9
301301 ‘‘(2) A
302302 UTHORIZED USES.—The Secretary shall 10
303303 use amounts from the Housing Partnership Fund 11
304304 for— 12
305305 ‘‘(A) incentive payments under subsection 13
306306 (o)(22); 14
307307 ‘‘(B) security deposit payments under sub-15
308308 section (o)(23); 16
309309 ‘‘(C) landlord liaison bonus payments 17
310310 under subsection (o)(24); and 18
311311 ‘‘(D) other uses, as determined by a public 19
312312 housing agency and approved by the Secretary, 20
313313 designed primarily— 21
314314 ‘‘(i) to recruit owners of dwelling 22
315315 units, particularly dwelling units in census 23
316316 tracts with a poverty rate of less than 20 24
317317 percent, to enter into housing assistance 25

415415 Department of Agriculture; 7
416416 ‘‘(II) the dwelling unit was phys-8
417417 ically inspected and passed inspection 9
418418 in connection with the assistance de-10
419419 scribed in subclause (I) during the 11
420420 preceding 12-month period; and 12
421421 ‘‘(III) the applicable public hous-13
422422 ing agency is able to obtain the re-14
423423 sults of the inspection described in 15
424424 subclause (II). 16

427427 Nothing in clause (i), (ii), or (iii) shall be 18

578578 section (b) shall be construed to prevent the Secretary 17

583583 (2) reforming the Section 8 Management As-22
584584 sessment Program in any other manner, at the dis-23
