2323 This Act may be cited as the ‘‘Safer Highways and 4
2424 Increased Performance for Interstate Trucking Act’’ or 5

3737 N GENERAL.—Notwithstanding any other 7
3838 provision of this section, a State may issue special 8
3939 permits during an emergency to overweight vehicles 9
4040 and loads that can easily be dismantled or divided 10
4141 if the conditions of either paragraph (2) or para-11
4242 graph (3) are met. 12

4444 RESIDENTIAL DECLARATION .—The con-13
4545 ditions of paragraph (2) as referenced in paragraph 14
4646 (1) of this subsection are— 15
4747 ‘‘(A) the President has declared the emer-16
4848 gency to be a major disaster under the Robert 17
4949 T. Stafford Disaster Relief and Emergency As-18
5050 sistance Act (42 U.S.C. 5121 et seq.); 19
5151 ‘‘(B) the permits described in paragraph 20
5252 (1) are issued in accordance with State law; 21
5353 ‘‘(C) the permits are issued exclusively to 22
5454 vehicles and loads that are delivering relief sup-23
5555 plies; and 24
5656 ‘‘(D) a permit shall expire not later than 25

9999 SEC. 3. ELIGIBILITY FOR WORKFORCE GRANTS. 10
100100 Section 134 of the Workforce Innovation and Oppor-11
101101 tunity Act (29 U.S.C. 3174) is amended by adding at the 12
102102 end the following: 13

104104 RUCKDRIVERS.— 14
105105 ‘‘(1) I
106106 N GENERAL.—With respect to the com-15
107107 mercial motor vehicle operator profession, the Sec-16
108108 retary shall provide grants to individuals for the tui-17
109109 tion and fees and other costs of entry level driver 18
110110 training provided by an entity listed as a training 19
111111 provider on the registry maintained by the Federal 20
112112 Motor Carrier Safety Administration and for such 21
113113 other education and training costs as the Secretary 22
114114 may approve, including the cost of course materials, 23
115115 supplies, technology, and fees for graduation, licen-24
116116 sure, or certification. 25

121121 ticable after the date of enactment of this sub-2
122122 section, the Secretary shall develop a simplified proc-3
123123 ess through which grants may be provided under 4
124124 this subsection that would be readily accessible to in-5
125125 dividuals with non-Federal share requirements set at 6
126126 the lowest level allowed under other provisions of 7
127127 this section. 8

129129 EQUIREMENTS.—Expenses authorized 9
130130 under paragraph (1) shall be provided both through 10
131131 the structure of existing programs pursuant to sub-11
132132 sections (a) through (d) of this section and through 12
133133 the process developed by the Secretary under sub-13

135135 SEC. 4. STRENGTHENING SUPPLY CHAINS THROUGH 15
136136 TRUCK DRIVER INCENTIVES ACT. 16

138138 NGENERAL.—The Internal Revenue Code of 17
139139 1986 is amended by inserting after section 36B the fol-18
140140 lowing new section: 19
141141 ‘‘SEC. 36C. CREDIT FOR COMMERCIAL TRUCK DRIVERS. 20
142142 ‘‘(a) A
143143 LLOWANCE OFCREDIT.—In the case of an eli-21
144144 gible individual, there shall be allowed as a credit against 22
145145 the tax imposed by this subtitle an amount equal to 23
146146 $7,500 for the taxable year. 24

152152 spect to a taxable year, an individual— 3
153153 ‘‘(1) who holds a valid Class A commercial driv-4
154154 er’s license (except as provided in subsection (c)) 5
155155 who operates a tractor-trailer combination that 6
156156 qualifies as a Group A vehicle under section 7
157157 383.91(a)(1) of title 49, Code of Federal Regula-8
158158 tions, 9
159159 ‘‘(2) whose adjusted gross income for the tax-10
160160 able year does not exceed— 11
161161 ‘‘(A) in the case of a joint return or sur-12
162162 viving spouse, $135,000, 13
163163 ‘‘(B) in the case of an individual who is a 14
164164 head of household, $112,500, or 15
165165 ‘‘(C) in the case of any other individual, 16
166166 $90,000, and 17
167167 ‘‘(3) who drove such a vehicle in the course of 18
168168 a trade or business— 19
169169 ‘‘(A) and served not less than 1900 hours 20
170170 of on-duty time, including driving time, during 21
171171 such taxable year, or 22
172172 ‘‘(B) in the case of an individual who did 23
173173 not drive a commercial truck in the preceding 24
174174 taxable year, not less than an average of 40 25

181181 vehicle in the course of a trade or business. 4

183183 PECIALRULE FORAPPRENTICES.—With re-5
184184 spect to an individual enrolled in an apprenticeship pro-6
185185 gram registered under the Act of August 16, 1937 (com-7
186186 monly known as the ‘National Apprenticeship Act’), who, 8
187187 upon completion or in the course of such apprenticeship 9
188188 program will receive a Class A commercial driver’s li-10
189189 cense— 11
190190 ‘‘(1) the requirements of subsection (b)(1) shall 12
191191 not apply, and 13
192192 ‘‘(2) such individual may count training hours 14
193193 in such program as hours driving a vehicle described 15
194194 in subsection (b)(1) for the purposes of this section. 16
195195 ‘‘(d) S
196196 PECIALRULE FORNEWTRUCKDRIVERS.— 17
197197 Except as provided in subsection (e), in the case of an 18
198198 eligible taxpayer who did not drive a commercial truck in 19
199199 the course of a trade or business during the preceding tax-20
200200 able year, subsection (a) shall be applied by substituting 21
201201 ‘$10,000’ for ‘$7,500’. 22

212212 course of a trade or business during the taxable year, the 3
213213 amount of the credit allowed by subsection (a) shall be 4
214214 the amount that bears the same proportion to the dollar 5
215215 amount (determined without regard to this subsection) 6
216216 with respect to the individual under subsection (a) as the 7
217217 number of hours of on-duty time, including driving time, 8
218218 such individual drove a commercial truck in the course of 9
219219 a trade or business during such taxable year bears to 1420 10
220220 hours. 11
221221 ‘‘(f) I
222222 NFLATIONADJUSTMENT.—In the case of any 12
223223 taxable year beginning after 2022, the dollar amounts in 13
224224 this section shall be increased by an amount equal to— 14
225225 ‘‘(1) such dollar amount, multiplied by 15
226226 ‘‘(2) the cost-of-living adjustment determined 16
227227 under section 1(f)(3) for the calendar year in which 17
228228 the taxable year begins, determined by substituting 18
229229 ‘calendar year 2021’ for ‘calendar year 2016’ in sub-19
230230 paragraph (A)(ii). 20
231231 ‘‘(g) L
232232 IMITATION.—An eligible individual shall be al-21
233233 lowed the credit under this section only 2 times. 22
234234 ‘‘(h) D
235235 EFINITIONS.—In this section, the terms ‘‘on- 23
236236 duty time’’ and ‘‘driving time’’ shall have the meaning 24

264264 SEC. 5. PARKING FOR COMMERCIAL MOTOR VEHICLES. 20

266266 ENSE OFCONGRESS.—It is the sense of Con-21
267267 gress that it should be a national priority to address the 22
268268 shortage of parking for commercial motor vehicles on the 23
269269 Federal-aid highway system to improve highway safety. 24

276276 ‘‘§ 180. Parking for commercial motor vehicles 4
277277 ‘‘(a) G
278278 RANTAUTHORITY.—Subject to the availability 5
279279 of funds, the Secretary shall make grants under this sec-6
280280 tion, on a competitive basis, to eligible entities for projects 7
281281 to provide parking for commercial motor vehicles and im-8
282282 prove the safety of commercial motor vehicle operators. 9
283283 ‘‘(b) A
284284 PPLICATIONS.—To be eligible for a grant 10
285285 under this section, an eligible entity shall submit to the 11
286286 Secretary an application at such time and in such manner 12
287287 as the Secretary may require. 13
288288 ‘‘(c) A
289289 PPLICATIONCONTENTS.—An application sub-14
290290 mitted under subsection (b) shall contain— 15
291291 ‘‘(1) a description of the proposed project; and 16
292292 ‘‘(2) any other information that the Secretary 17
293293 may require. 18
294294 ‘‘(d) E
295295 LIGIBLEENTITIES.—The following entities 19
296296 shall be eligible to receive amounts under this section: 20
297297 ‘‘(1) A State. 21
298298 ‘‘(2) A metropolitan planning organization. 22
299299 ‘‘(3) A unit of local government. 23

312312 entity that receives a grant under this section may partner 9
313313 with a private entity to carry out an eligible project under 10
314314 this section. 11

319319 awarded under this section for a project described in 14
320320 paragraph (2) that is on— 15

322322 ‘‘(B) a facility with reasonable access to— 17
323323 ‘‘(i) a Federal-aid highway; or 18
324324 ‘‘(ii) a freight facility. 19

327327 scribed in this paragraph is a project to— 21
328328 ‘‘(A) construct safety rest areas (as such 22
329329 term is defined in section 120(c)) that include 23
330330 parking for commercial motor vehicles; 24

338338 ‘‘(ii) within the boundaries of, or adja-5
339339 cent to, a publicly owned freight facility, 6
340340 including a port terminal operated by a 7
341341 public authority; and 8
342342 ‘‘(iii) at existing facilities, including 9
343343 inspection and weigh stations and park- 10
344344 and-ride locations; 11
345345 ‘‘(C) open existing weigh stations, safety 12
346346 rest areas, and park-and-ride facilities to com-13
347347 mercial motor vehicle parking; 14
348348 ‘‘(D) construct or make capital improve-15
349349 ments to existing public commercial motor vehi-16
350350 cle parking facilities to expand parking utiliza-17
351351 tion and availability, including at seasonal fa-18
352352 cilities; 19
353353 ‘‘(E) identify, promote, and manage the 20
354354 availability of publicly and privately provided 21
355355 commercial motor vehicle parking, such as 22
356356 through the use of intelligent transportation 23
357357 systems; 24

362362 motor vehicle operators at parking facilities as 2
363363 part of a project described in subparagraphs 3

365365 ‘‘(G) improve a parking facility, including 5
366366 through advanced truck stop electrification sys-6
367367 tems and other improvements determined ap-7
368368 propriate by the Secretary, as part of a project 8
369369 described in subparagraphs (A) through (D). 9

371371 UBLICLY ACCESSIBLE PARKING .—Com-10
372372 mercial motor vehicle parking constructed or opened 11
373373 with a grant under this section shall be open and ac-12
374374 cessible to all commercial motor vehicle operators. 13

376376 SE OFFUNDS.— 14
377377 ‘‘(1) I
378378 N GENERAL.—An eligible entity may use 15
379379 a grant under this section for— 16
380380 ‘‘(A) development phase activities, includ-17
381381 ing planning, feasibility analysis, benefit-cost 18
382382 analysis, environmental review, preliminary en-19
383383 gineering and design work, and other 20
384384 preconstruction activities necessary to advance 21
385385 a project under this section; and 22
386386 ‘‘(B) construction and operational improve-23
387387 ments. 24
388388 ‘‘(2) L
389389 IMITATION.— 25

394394 use not more than 25 percent of the amount of 2
395395 a grant under this section for activities de-3
396396 scribed in paragraph (1)(A). 4

398398 XISTING FACILITIES.—Not more 5
399399 than 10 percent of the amounts available for 6
400400 each fiscal year for grants under the program 7
401401 may be used for projects described under sub-8
402402 section (f)(2)(E) that solely identify, promote, 9
403403 and manage the availability of existing commer-10
404404 cial motor vehicle parking. 11
405405 ‘‘(h) S
406406 ELECTIONCRITERIA.—In making grants 12
407407 under this subsection, the Secretary shall give priority to 13
408408 applications that demonstrate— 14
409409 ‘‘(1) a shortage of commercial motor vehicle 15
410410 parking capacity in the corridor in which the project 16
411411 is located; 17
412412 ‘‘(2) consultation with motor carriers, commer-18
413413 cial motor vehicle operators, public safety officials, 19
414414 and private providers of commercial motor vehicle 20
415415 parking; 21
416416 ‘‘(3) that the project will likely— 22
417417 ‘‘(A) increase the availability or utilization 23
418418 of commercial motor vehicle parking; 24

424424 ‘‘(C) improve highway safety, traffic con-3
425425 gestion, and air quality; and 4
426426 ‘‘(4) the ability to provide for the maintenance 5
427427 and operation of the facility. 6
428428 ‘‘(i) F
429429 EDERALSHARE.—Notwithstanding section 7
430430 120, the Federal share for a project carried out under this 8
431431 subsection shall be up to 100 percent. 9
432432 ‘‘(j) T
433433 REATMENT OFPROJECTS.— 10
434434 ‘‘(1) I
435435 N GENERAL.—Notwithstanding any other 11
436436 provision of law, projects funded under this section 12
437437 shall be treated as projects on a Federal-aid highway 13
438438 under this chapter. 14
439439 ‘‘(2) P
440440 ERIOD OF AVAILABILITY.—Funds appro-15
441441 priated for projects under this section shall remain 16
442442 available for a period of 3 years after the last day 17
443443 of the fiscal year in which the funds are made avail-18
444444 able. 19
445445 ‘‘(k) P
446446 ROHIBITION ONCHARGINGFEES.—To be eli-20
447447 gible for a grant under this section, an eligible entity shall 21
448448 agree that no fees will be charged to a commercial motor 22
449449 vehicle to access parking constructed, opened, or improved 23
450450 with a grant under this section. 24

709709 ‘‘(C) the estimated miles traveled by such 16
710710 vehicle on the Interstate System in the State. 17
