5353 NGENERAL.—Section 24 of the Internal Rev-3
5454 enue Code of 1986 is amended by striking subsections (a), 4
5555 (b), and (c) and inserting the following new subsections: 5
5656 ‘‘(a) A
5757 LLOWANCE OF CREDIT.—There shall be al-6
5858 lowed as a credit against the tax imposed by this chapter 7
5959 for the taxable year an amount equal to the sum of— 8
6060 ‘‘(1) $3,500 for each qualifying child of the tax-9
6161 payer ($4,500 in the case of a qualifying child who 10
6262 has not attained age 6 as of the close of the cal-11
6363 endar year in which the taxable year of the taxpayer 12

6565 ‘‘(2) in the case of any taxable year beginning 14
6666 before January 1, 2026, $500 for each qualifying 15

110110 For purposes of this subsection, the term ‘social se-7
111111 curity number’ means, with respect to a return of 8
112112 tax, a social security number issued to an individual 9
113113 by the Social Security Administration, but only if 10
114114 the social security number is issued— 11
115115 ‘‘(A) to a citizen of the United States or 12
116116 pursuant to subclause (I) (or that portion of 13
117117 subclause (III) that relates to subclause (I)) of 14
118118 section 205(c)(2)(B)(i) of the Social Security 15

209209 treated as met with respect to such child, for the 16
210210 taxable year immediately preceding the year in 17
211211 which such child is born alive, if the taxpayer in-18
212212 cludes on the return of tax for such taxable year a 19
213213 social security number for such child which is issued 20
214214 before the due date for such return of tax (without 21
215215 regard to extensions). 22

224224 fying child of an eligible taxpayer who is born 2
225225 alive and with respect to whom the credit under 3
226226 this section is not claimed under paragraph (1) 4
227227 for the taxable year described in such para-5
228228 graph, for the taxable year in which the child 6
229229 is born alive, with respect to such child— 7
230230 ‘‘(i) the amount of the credit allowed 8
231231 (before the application of this subsection) 9
232232 under subsection (a), and 10
233233 ‘‘(ii) the amount of the credit allowed 11
234234 (before the application of this subsection) 12
235235 under subsection (d)(1), 13
236236 shall each be increased by the amount of the 14
237237 credit which would have been allowed under 15

285285 gible taxpayer’ means a taxpayer who— 5
286286 ‘‘(i) with respect to a child, is the 6
287287 mother who— 7
288288 ‘‘(I) carries or carried such child 8
289289 in the womb, and 9
290290 ‘‘(II) is the biological mother of 10
291291 such child or initiated the pregnancy 11
292292 with the intention of bearing and re-12
293293 taining custody of and parental rights 13
294294 to such child (or acted to such effect), 14
295295 or 15
296296 ‘‘(ii) in the case of a joint return, is 16
297297 the husband of such mother, 17
298298 but only if such taxpayer includes on the return 18
299299 of tax for the taxable year the social security 19
300300 number of such taxpayer (of at least 1 of such 20
301301 mother or husband, in the case of a joint re-21
302302 turn). 22

534534 MOUNT OF MONTHLY PAYMENT .—The 15
535535 amount of a monthly payment made in any benefit 16
536536 month within a benefit period to an individual enti-17
537537 tled to a parental leave benefit shall be an amount 18
538538 equal to— 19
539539 ‘‘(A) the amount of the parental leave ben-20
540540 efit determined for the individual under sub-21
541541 section (b), divided by 22
542542 ‘‘(B) the number of benefit months se-23
543543 lected by the individual pursuant to paragraph 24
544544 (1) with respect to such benefit. 25

565565 documentation as the Commissioner may 16
566566 require to demonstrate that the applicant 17
567567 is the parent of the qualified child shall be 18
568568 subject to criminal and civil penalties; 19
569569 ‘‘(ii) the full cost to the Trust Funds 20
570570 of any amount received by an individual as 21
571571 a parental leave benefit must be repaid 22
572572 through reductions to old-age insurance 23
573573 benefits payable to the individual in subse-24
574574 quent months, or by other means; and 25

590590 benefit to finance spending more time with 13
591591 the qualified child at home and away from 14
592592 employment during the benefit period; and 15
593593 ‘‘(iii) the individual consents to the 16
594594 terms and conditions specified in the notice 17
595595 described in subparagraph (A). 18

598598 TIONS.—The Commissioner of Social Security may 20
599599 establish an option under which an individual may 21
600600 file an application for a parental leave benefit under 22

618618 N GENERAL.—The Commissioner of So-10
619619 cial Security shall establish procedures to ensure the 11
620620 prevention of fraud with respect to applications for 12
621621 parental leave benefits under this section, including 13
622622 procedures for the submission of such proof or docu-14
623623 mentation as the Commissioner may require to 15
624624 verify the information contained in such an applica-16
625625 tion. 17
626626 ‘‘(2) E
627627 NFORCEMENT.—In any case in which an 18
628628 individual willfully, knowingly, and with intent to de-19
629629 ceive the Commissioner of Social Security fails to 20
630630 comply with the procedures established under para-21
631631 graph (1), the Commissioner may impose on such in-22
632632 dividual, in addition to any other penalties that may 23
633633 be prescribed by law— 24

651651 Old-Age and Survivors Insurance Trust Fund (as 13
652652 such amount is determined by the Commissioner) in 14
653653 accordance with this subsection. 15

681681 deduction that will be applied to each monthly 12
682682 payment of such benefits during the calendar 13

741741 the making of such determination, to be a pay-12
742742 ment of more than the correct amount for pur-13
743743 poses of section 204; and 14
744744 ‘‘(B) the Commissioner may recover such 15
745745 amounts by means of any method available to 16
746746 the Commissioner under such section. 17

750750 of this section, the Commissioner shall establish a 20

932932 (2) Descriptions of how employers will be re-23
933933 cruited to participate in such program and how the 24
934934 State will solicit input from employers in the design 25
935935 and implementation of such program. 26

948948 THERREQUIREMENTS.—A State receiving 9
949949 funds under this section shall prioritize providing evi-10
950950 dence-based work activities through a program funded in 11
951951 whole or in part with such funds for eligible non-custodial 12
952952 parents who are eligible for benefits under the supple-13
953953 mental nutrition assistance program, as defined in section 14
954954 3(t) of the Food and Nutrition Act of 2008 (7 U.S.C. 15
955955 2012(t)), and, at the option of the State, may limit partici-16
956956 pation in such program to such eligible non-custodial par-17
957957 ents. 18

959959 EPORTS.—Not later than 12 months after the 19
960960 end of the last fiscal year in which a State expends funds 20
961961 from a grant made under this section, the State shall sub-21
962962 mit to the Secretary a report that includes the following 22

13161316 health indicators, financial well-being, and other 18
13171317 needs of populations to be served by the entity as 19
13181318 described in paragraph (3), including, to the extent 20
13191319 practicable, the prevalence of mentoring opportuni-21

13211321 ‘‘(5) the quantifiable benchmarks that will be 23
13221322 used to measure program success; 24

15911591 practicable, have an understanding of the barriers 22
15921592 and lived experience of that community, which may 23
