1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Fort Belknap Indian 4
2020 Community Water Rights Settlement Act of 2023’’. 5
2121 SEC. 2. PURPOSES. 6
2222 The purposes of this Act are— 7
2323 (1) to achieve a fair, equitable, and final settle-8
2424 ment of claims to water rights in the State of Mon-9

4848 SEC. 3. DEFINITIONS. 20

5151 LLOTTEE.—The term ‘‘allottee’’ means an 22
5252 individual who holds a beneficial real property inter-23
5353 est in an allotment of Indian land that is— 24

324324 ODIFICATIONS.—Nothing in this Act pre-11
325325 cludes the Secretary from approving any modifica-12

329329 proval under section 2116 of the Revised Statutes 16

351351 N GENERAL.—In implementing the 7
352352 Compact and this Act, the Fort Belknap Indian 8
353353 Community shall prepare any necessary envi-9
354354 ronmental documents, consistent with all appli-10
355355 cable provisions of— 11
356356 (i) the Endangered Species Act of 12
357357 1973 (16 U.S.C. 1531 et seq.); 13
358358 (ii) the National Environmental Policy 14
359359 Act of 1969 (42 U.S.C. 4231 et seq.), in-15
360360 cluding the implementing regulations of 16
361361 that Act; and 17
362362 (iii) all other applicable Federal envi-18
363363 ronmental laws and regulations. 19
364364 (B) A
365365 UTHORIZATIONS.—The Secretary 20
366366 shall— 21
367367 (i) independently evaluate the docu-22
368368 mentation submitted under subparagraph 23
369369 (A); and 24

376376 FFECT OF EXECUTION .—The execution of 3
377377 the Compact by the Secretary under this section 4
378378 shall not constitute a major Federal action for pur-5
379379 poses of the National Environmental Policy Act of 6
380380 1969 (42 U.S.C. 4321 et seq.). 7
381381 (4) C
382382 OSTS.—Any costs associated with the per-8
383383 formance of the compliance activities under this sub-9
384384 section shall be paid from funds deposited in the 10
385385 Trust Fund, subject to the condition that any costs 11
386386 associated with the performance of Federal approval 12
387387 or other review of such compliance work or costs as-13
388388 sociated with inherently Federal functions shall re-14
389389 main the responsibility of the Secretary. 15
390390 SEC. 5. TRIBAL WATER RIGHTS. 16

392392 ONFIRMATION OFTRIBALWATERRIGHTS.— 17

394394 N GENERAL.—The Tribal water rights are 18
395395 ratified, confirmed, and declared to be valid. 19
396396 (2) U
397397 SE.—Any use of the Tribal water rights 20
398398 shall be subject to the terms and conditions of the 21
399399 Compact and this Act. 22

401401 ONFLICT.—In the event of a conflict be-23
402402 tween the Compact and this Act, this Act shall con-24

407407 (b) INTENT OFCONGRESS.—It is the intent of Con-1
408408 gress to provide to each allottee benefits that are equiva-2
409409 lent to, or exceed, the benefits the allottees possess on the 3
410410 day before the date of enactment of this Act, taking into 4
411411 consideration— 5
412412 (1) the potential risks, cost, and time delay as-6
413413 sociated with litigation that would be resolved by the 7
414414 Compact and this Act; 8
415415 (2) the availability of funding under this Act 9
416416 and from other sources; 10
417417 (3) the availability of water from the Tribal 11
418418 water rights; and 12
419419 (4) the applicability of section 7 of the Act of 13
420420 February 8, 1887 (24 Stat. 390, chapter 119; 25 14
421421 U.S.C. 381), and this Act to protect the interests of 15
422422 allottees. 16

424424 RUSTSTATUS OFTRIBALWATERRIGHTS.— 17
425425 The Tribal water rights— 18
426426 (1) shall be held in trust by the United States 19
427427 for the use and benefit of the Fort Belknap Indian 20
428428 Community and allottees in accordance with this 21
429429 Act; and 22
430430 (2) shall not be subject to loss through non-use, 23
431431 forfeiture, or abandonment. 24

444444 ment to water of an allottee under Federal law shall 7
445445 be satisfied from the Tribal water rights. 8

447447 LLOCATIONS.—An allottee shall be entitled 9
448448 to a just and equitable allocation of water for irriga-10
449449 tion purposes. 11

453453 XHAUSTION OF REMEDIES .—Before 13
454454 asserting any claim against the United States 14
455455 under section 7 of the Act of February 8, 1887 15
456456 (24 Stat. 390, chapter 119; 25 U.S.C. 381), or 16
457457 any other applicable law, an allottee shall ex-17
458458 haust remedies available under the Tribal water 18
459459 code or other applicable Tribal law. 19
460460 (B) A
461461 CTION FOR RELIEF.—After the ex-20
462462 haustion of all remedies available under the 21
463463 Tribal water code or other applicable Tribal 22
464464 law, an allottee may seek relief under section 7 23
465465 of the Act of February 8, 1887 (24 Stat. 390, 24

34703470 SEC. 16. ANTIDEFICIENCY. 8
34713471 The United States shall not be liable for any failure 9
34723472 to carry out any obligation or activity authorized by this 10
34733473 Act, including any obligation or activity under the Com-11
34743474 pact, if— 12
34753475 (1) adequate appropriations are not provided by 13
34763476 Congress expressly to carry out the purposes of this 14
34773477 Act; or 15
34783478 (2) there are not enough funds available in the 16
34793479 Reclamation Water Settlements Fund established by 17
34803480 section 10501(a) of the Omnibus Public Land Man-18
34813481 agement Act of 2009 (43 U.S.C. 407(a)) to carry 19
