2828 SEC. 2. LIMITATION ON TERMINATION OF FIGHTER SQUAD-1

3131 IMITATION.—The Secretary of the Air Force 3
3232 may not terminate the fighter flying mission of any fighter 4
3333 squadron of the Air National Guard or the Air Force Re-5
3434 serve until a period of 180 days has elapsed following the 6
3535 date on which the Secretary submits the plan required 7
3636 under subsection (b). 8

3838 LANREQUIRED.— 9
3939 (1) I
4040 N GENERAL.—The Secretary of the Air 10
4141 Force, in coordination with the Director of the Air 11
4242 National Guard and the Commander of the Air 12
4343 Force Reserve, shall develop a notional plan for the 13
4444 recapitalization of all fighter squadrons of the Air 14
4545 National Guard and the Air Force Reserve. 15
4646 (2) E
4747 LEMENTS.—The plan under paragraph (1) 16
4848 shall— 17
4949 (A) provide options for the modernization 18
5050 of fighter squadrons of the Air National Guard 19
5151 and the Air Force Reserve and the replacement 20
5252 of the aircraft of such squadrons at a rate that 21
5353 ensures recapitalization of such squadrons with 22
5454 relevant and more capable replacement fighter 23
5555 aircraft; 24
5656 (B) ensure that each fighter squadron of 25
5757 the Air National Guard and the Air Force Re-26

6767 porary reassignment of aircraft to such squad-7
6868 rons from other components of the Air Force, 8
6969 as necessary to meet the requirements of the 9

7171 (D) include the Secretary of the Air 11
7272 Force’s assessment of any effects of the force 12
7373 presentation on— 13
7474 (i) combatant commanders; 14
7575 (ii) aircrew accession absorption ca-15
7676 pacity; 16
7777 (iii) industrial capacity to support any 17
7878 additional production above programmed 18
7979 quantities; and 19
8080 (iv) costs aside from normal training 20
8181 and personnel costs of unit mission transi-21
8282 tions. 22

8484 UBMITTAL TO CONGRESS .—The Secretary 23
8585 of the Air Force shall submit to the congressional 24

9595 to fighter aircraft squadrons of the Air Na-7
9696 tional Guard and the Air Force Reserve (includ-8
9797 ing any such plans in effect as of the date of 9
9898 the submittal of the plan under paragraph (1)); 10

100100 (C) any effects of the plan on operations 12
101101 and efforts to recapitalize or transition existing 13
102102 fighter aircraft squadrons of the Air National 14
103103 Guard and the Air Force Reserve as proposed 15
104104 in the future-years defense program submitted 16
105105 to Congress under section 221 of title 10, 17
106106 United States Code, for fiscal year 2024. 18
