20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Air Reserve Compo-4
24	24	nent Fighter Recapitalization Act of 2023’’. 5

28	28	SEC. 2. LIMITATION ON TERMINATION OF FIGHTER SQUAD-1

31	31	IMITATION.—The Secretary of the Air Force 3
32	32	may not terminate the fighter flying mission of any fighter 4
33	33	squadron of the Air National Guard or the Air Force Re-5
34	34	serve until a period of 180 days has elapsed following the 6
35	35	date on which the Secretary submits the plan required 7
36	36	under subsection (b). 8
37	37	(b) P
38	38	LANREQUIRED.— 9
39	39	(1) I
40	40	N GENERAL.—The Secretary of the Air 10
41	41	Force, in coordination with the Director of the Air 11
42	42	National Guard and the Commander of the Air 12
43	43	Force Reserve, shall develop a notional plan for the 13
44	44	recapitalization of all fighter squadrons of the Air 14
45	45	National Guard and the Air Force Reserve. 15
46	46	(2) E
47	47	LEMENTS.—The plan under paragraph (1) 16
48	48	shall— 17
49	49	(A) provide options for the modernization 18
50	50	of fighter squadrons of the Air National Guard 19
51	51	and the Air Force Reserve and the replacement 20
52	52	of the aircraft of such squadrons at a rate that 21
53	53	ensures recapitalization of such squadrons with 22
54	54	relevant and more capable replacement fighter 23
55	55	aircraft; 24
56	56	(B) ensure that each fighter squadron of 25
57	57	the Air National Guard and the Air Force Re-26

62	62	mission assigned fighter aircraft to meet force 2
63	63	presentation requirements of geographic com-3
64	64	batant commanders for both steady-state and 4
65	65	operational contingency planning and execution; 5
66	66	(C) include consideration for the tem-6
67	67	porary reassignment of aircraft to such squad-7
68	68	rons from other components of the Air Force, 8
69	69	as necessary to meet the requirements of the 9
70	70	plan; and 10
71	71	(D) include the Secretary of the Air 11
72	72	Force’s assessment of any effects of the force 12
73	73	presentation on— 13
74	74	(i) combatant commanders; 14
75	75	(ii) aircrew accession absorption ca-15
76	76	pacity; 16
77	77	(iii) industrial capacity to support any 17
78	78	additional production above programmed 18
79	79	quantities; and 19
80	80	(iv) costs aside from normal training 20
81	81	and personnel costs of unit mission transi-21
82	82	tions. 22

84	84	UBMITTAL TO CONGRESS .—The Secretary 23
85	85	of the Air Force shall submit to the congressional 24

90	90	graph (1) together with an explanation of— 2
91	91	(A) any programmatic funding required to 3
92	92	implement such plan; and 4
93	93	(B) how the plan differs from other plans 5
94	94	of the Secretary of the Air Force with respect 6
95	95	to fighter aircraft squadrons of the Air Na-7
96	96	tional Guard and the Air Force Reserve (includ-8
97	97	ing any such plans in effect as of the date of 9
98	98	the submittal of the plan under paragraph (1)); 10
99	99	and 11
100	100	(C) any effects of the plan on operations 12
101	101	and efforts to recapitalize or transition existing 13
102	102	fighter aircraft squadrons of the Air National 14
103	103	Guard and the Air Force Reserve as proposed 15
104	104	in the future-years defense program submitted 16
105	105	to Congress under section 221 of title 10, 17
106	106	United States Code, for fiscal year 2024. 18
