Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Military Lodging Re-4
form Act of 2023’’. 5

SEC. 2. AUTHORITY TO OPERATE CERTAIN TRANSIENT 1
HOUSING OF THE DEPARTMENT OF DEFENSE 2
TRANSFERRED TO ASSISTANT SECRETARY OF 3
DEFENSE FOR ENERGY, INSTALLATIONS, AND 4
ENVIRONMENT. 5
(a) T
RANSFER OFAUTHORITY.— 6
(1) A
SSIGNMENT.—Paragraph (7) of section 7
138(b) of title 10, United States Code, is amended 8
by adding at the end the following new sentence: 9
‘‘The Assistant Secretary is responsible, subject to 10
the authority, direction, and control of the Secretary 11
of Defense, for all matters relating to lodging in-12
tended to be occupied by members of the Armed 13
Forces that require such lodging due to a temporary 14
duty assignment or a permanent change of station 15
order.’’. 16

RANSFER.— 17
(A) I
N GENERAL.—Not later than 90 days 18
after the date of the enactment of this Act, the 19
Secretary of Defense shall transfer each duty or 20
responsibility relating to covered transient hous-21
ing to the Assistant Secretary of Defense for 22
Energy, Installations, and Environment. 23
(B) C
ERTIFICATION.—Not later than 180 24
days after the date of the enactment of this 25
Act, the Secretary of Defense shall submit to 26

the congressional defense committees a certifi-1
cation that the transfer required under sub-2
paragraph (A) has been completed. 3

OORDINATION ON COVERED TRANSIENT 4
HOUSING.— 5
(A) A
RMY TRANSIENT HOUSING .—On mat-6
ters relating to covered transient housing of the 7
Department of the Army, the Assistant Sec-8
retary of Defense for Energy, Installations, and 9
Environment shall coordinate with the Assistant 10
Secretary of the Army for Installations, Energy, 11
and Environment. 12
(B) N
AVY TRANSIENT HOUSING .—On mat-13
ters relating to covered transient housing of the 14
Department of the Navy, the Assistant Sec-15
retary of Defense for Energy, Installations, and 16
Environment shall coordinate with the Assistant 17
Secretary of the Navy (Energy, Installations, 18
and Environment). 19
(C) A
IR FORCE TRANSIENT HOUSING .—On 20
matters relating to covered transient housing of 21
the Department of the Air Force, the Assistant 22
Secretary of Defense for Energy, Installations, 23
and Environment shall coordinate with the As-24

EFERENCES.—Any reference in law, regulation, 3
guidance, instruction, or other document of the Federal 4
Government to the Under Secretary of Defense for Per-5
sonnel and Readiness with respect to covered transient 6
housing shall be deemed to refer to the Assistant Sec-7
retary of Defense for Energy, Installations, and Environ-8
ment. 9
(c) C
OVEREDTRANSIENTHOUSINGDEFINED.—In 10
this section, the term ‘‘covered transient housing’’ means 11
lodging intended to be occupied by members of the Armed 12
Forces that require such lodging due to— 13
(1) a temporary duty assignment; or 14
(2) a permanent change of station order. 15
