3232 SECTION 1. SHORT TITLE. 1
3333 This Act may be cited as the ‘‘Augmentative and Al-2
3434 ternative Communication Centers of Excellence and Na-3
3535 tional Technical Assistance Act’’ or the ‘‘AACCENT Act’’. 4
3636 SEC. 2. FINDINGS. 5
3737 Congress makes the following findings: 6
3838 (1) Communication is a basic human need and 7
3939 fundamental right, and is essential to self-deter-8
4040 mination, social inclusion, and emotional and phys-9
4141 ical well-being. In enacting a provision of the Ameri-10
4242 cans with Disabilities Act of 1990 (referred to in 11
4343 this section as the ‘‘ADA’’), Congress recognized 12
4444 that ‘‘physical or mental disabilities in no way di-13
4545 minish a person’s right to fully participate in all as-14
4646 pects of society,’’ and that ‘‘the discriminatory ef-15
4747 fects of communication barriers’’ are a form of dis-16
4848 crimination. 17
4949 (2) Three decades after the passage of the 18
5050 ADA, Americans with significant expressive commu-19
5151 nication disabilities still experience discrimination in 20
5252 the form of communication barriers, institutionaliza-21
5353 tion, segregation, and relegation to lesser services, 22
5454 programs, activities, benefits, jobs, or other opportu-23
5555 nities compared to Americans without significant ex-24
5656 pressive communication disabilities. 25

6161 communication is lacking, but it is estimated there 2
6262 are at least 4,000,000 people in the United States 3
6363 who cannot reliably meet their daily communication 4
6464 needs using natural speech. 5
6565 (4) The population of individuals with signifi-6
6666 cant expressive communication difficulties is at sub-7
6767 stantial risk for limited education, unemployment, 8
6868 poor health outcomes, poverty, and low quality of 9
6969 life. 10
7070 (5) People can acquire a significant expressive 11
7171 communication disability and need augmentative and 12
7272 alternative communication as a result of many 13
7373 health and developmental conditions at all stages of 14
7474 life. 15
7575 (6) Research indicates that individuals who be-16
7676 long to racial or ethnic minority communities face a 17
7777 greater likelihood of being born with or acquiring ex-18
7878 pressive communication disabilities, as well as added 19
7979 difficulties in obtaining intervention services, includ-20
8080 ing augmentative and alternative communication. 21
8181 (7) Individuals with significant expressive com-22
8282 munication disabilities, schools, families, employers, 23
8383 direct support providers, health care providers, the 24
8484 justice system, and the general public need more in-25

9090 nication tools, services, and other supports for indi-3
9191 viduals with significant expressive communication 4
9292 disabilities. 5
9393 (8) The lived experiences and writings of indi-6
9494 viduals with significant expressive communication 7
9595 disabilities demonstrate the positive impact aug-8
9696 mentative and alternative communication has on 9
9797 their lives. These lived experiences and writings also 10
9898 illustrate the harm that results from denying aug-11
9999 mentative and alternative communication to those 12
100100 who need it. 13
101101 (9) The leadership of individuals with signifi-14
102102 cant expressive communication disabilities is critical 15
103103 in crafting and implementing effective policies and 16
104104 programs affecting their lives, including policies and 17
105105 programs regarding augmentative and alternative 18
106106 communication. 19
107107 (10) The freedoms of expression, and to be un-20
108108 derstood, are essential to both democracy and to in-21
109109 dividual well-being. Individuals with significant ex-22
110110 pressive communication disabilities must be afforded 23
111111 equal rights, opportunities, strategies, technologies, 24
112112 services, and other supports to effectively express 25

119119 The purpose of this Act is to work toward eliminating 4
120120 the continued discrimination, isolation, marginalization, 5
121121 and denial of equal opportunity of individuals with signifi-6
122122 cant expressive communication disabilities by providing for 7
123123 comprehensive national training, technical assistance, and 8
124124 resource centers to improve— 9
125125 (1) access to a full range of augmentative and 10
126126 alternative communication; 11
127127 (2) access to equal opportunity; 12
128128 (3) awareness and implementation of relevant 13
129129 laws, policies, and practices; 14
130130 (4) leadership and self-advocacy skills; 15
131131 (5) capacity, in the case of individuals with sig-16
132132 nificant expressive communication disabilities, edu-17
133133 cators, professionals, and families; 18
134134 (6) national statistical data; and 19
135135 (7) societal awareness. 20
136136 SEC. 4. DEFINITIONS. 21
137137 In this Act: 22
138138 (1) A
139139 DVISORY COUNCIL.—The term ‘‘advisory 23
140140 council’’ means an 11-person advisory council that— 24

148148 abilities who collectively have diverse— 5
149149 (i) educational and professional back-6
150150 grounds; 7
151151 (ii) racial, ethnic, gender, and lin-8
152152 guistic identities; 9
153153 (iii) disabilities, including intellectual 10
154154 disabilities, ages, and geographic locations; 11
155155 (iv) levels of income; and 12
156156 (v) forms of augmentative and alter-13
157157 native communication relied upon; and 14
158158 (C) is subject to each of the following con-15
159159 ditions: 16
160160 (i) The initial council members shall 17
161161 be identified in the grant application by 18
162162 the partners of the eligible entity. 19
163163 (ii) Each member of the advisory 20
164164 council shall be appointed for a period of 21
165165 5 years. 22
166166 (iii) The Chair and Vice Chair of the 23
167167 council shall be selected by the council 24
168168 members at the first meeting and there-25

178178 NICATION.—The term ‘‘augmentative and alternative 6
179179 communication’’ means any tool, method, tech-7
180180 nology, strategy, service, training, coaching, and 8
181181 other support used to supplement or replace speech. 9

183183 OMPETITIVE INTEGRATED EMPLOY -10
184184 MENT.—The term ‘‘competitive integrated employ-11
185185 ment’’ has the meaning given the term in section 7 12
186186 of the Rehabilitation Act of 1973 (29 U.S.C. 705). 13

188188 ISABILITY.—The term ‘‘disability’’ has the 14
189189 meaning given the term in section 3 of the Ameri-15

193193 LIGIBLE ENTITY.—The term ‘‘eligible enti-18
194194 ty’’ means a partnership of at least 2 organiza-19
195195 tions— 20
196196 (A) for which the controlling partner of the 21
197197 partnership is a nonprofit organization 22
198198 headquartered in the United States that vests 23
199199 power and authority in individuals with signifi-24
200200 cant expressive communication disabilities in 25

211211 sive communication disabilities; 8
212212 (C) that has a cross-disability and cross- 9
213213 generational focus; 10
214214 (D) that is advised by an advisory council; 11
215215 (E) that has adopted a mission that values 12
216216 equal opportunity and the fundamental right of 13
217217 communication access, and operating principles 14
218218 that respect the rights of individuals with sig-15
219219 nificant expressive communication disabilities to 16
220220 express themselves in the manner of their 17
221221 choosing; and 18
222222 (F) of which the organizational members, 19
223223 collectively— 20
224224 (i) have knowledge, experience, and 21
225225 capacity in conducting training, technical 22
226226 assistance, or knowledge dissemination re-23
227227 lated to the priority activities described in 24
228228 section 6; 25

242242 (aa) centers for independent 11
243243 living authorized under part C of 12
244244 title VII of the Rehabilitation Act 13
245245 of 1973 (29 U.S.C. 796f et seq.); 14
246246 (bb) home and community- 15
247247 based service providers; 16
248248 (cc) employers; 17
249249 (dd) health care providers; 18
250250 (ee) protection and advocacy 19
251251 organizations; 20
252252 (ff) aging networks; 21
253253 (gg) caregiver organizations; 22
254254 or 23
255255 (hh) State, Tribal, or local 24
256256 government agencies; and 25

263263 zations, institutions of higher education, 4
264264 professional associations, or caregiver orga-5

267267 VIDENCE-BASED.—The term ‘‘evidence- 7
268268 based’’, used with respect to assistance that is 8
269269 knowledge, a resource, training, or technical assist-9
270270 ance, means assistance— 10
271271 (A) that demonstrates a rationale based on 11
272272 a high-quality research finding or positive eval-12
273273 uation that such assistance is likely to improve 13
274274 a communication outcome or other relevant out-14
275275 come; and 15
276276 (B) for which ongoing efforts are made to 16
277277 examine the effects of the assistance. 17
278278 (7) I
279279 NDIVIDUAL WITH SIGNIFICANT EXPRES -18
280280 SIVE COMMUNICATION DISABILITIES .—The term ‘‘in-19
281281 dividual with significant expressive communication 20
282282 disabilities’’ means an individual of any age— 21
283283 (A) who has 1 or more real or perceived 22
284284 significant expressive communication disabilities 23
285285 and may have other disabilities; and 24

296296 NSTITUTION OF HIGHER EDUCATION .—The 7
297297 term ‘‘institution of higher education’’ has the 8
298298 meaning given the term in section 101(a) of the 9
299299 Higher Education Act of 1965 (20 U.S.C. 1001(a)). 10

301301 ATIONAL RESOURCE CENTER .—The term 11
302302 ‘‘national resource center’’ means a National Re-12
303303 source Center on Augmentative and Alternative 13
304304 Communication referred to in section 5(a). 14

306306 ECRETARY.—The term ‘‘Secretary’’ 15
307307 means the Secretary of Health and Human Services. 16

309309 IGNIFICANT EXPRESSIVE COMMUNICA -17
310310 TION DISABILITY.— 18

312312 N GENERAL.—The term ‘‘significant 19
313313 expressive communication disability’’ means any 20
314314 disability, whether congenital, developmental, or 21
315315 acquired at any point in life, that prevents or 22
316316 significantly limits an individual from under-23
317317 standing or being understood using spoken 24
318318 words, resulting in the individual’s need for or 25

325325 PPLICATION.—The term does not 3
326326 apply to an individual whose primary commu-4
327327 nication disability is visual or auditory in na-5
328328 ture, but does apply to an individual with a dis-6
329329 ability described in subparagraph (A) who also 7
330330 has a visual or auditory communication dis-8
331331 ability and who may communicate using sign 9
332332 language. 10

334334 TATE.—The term ‘‘State’’ means the 50 11
335335 States, the District of Columbia, the Commonwealth 12
336336 of Puerto Rico, the United States Virgin Islands, 13
337337 Guam, American Samoa, and the Commonwealth of 14
338338 the Northern Mariana Islands. 15
339339 SEC. 5. GRANTS. 16
340340 (a) I
341341 NGENERAL.—The Secretary shall award 3 17
342342 grants through an open competition to eligible entities, 18
343343 with applications approved under section 7, to create, 19
344344 maintain, and administer a network of National Resource 20
345345 Centers on Augmentative and Alternative Communication. 21
346346 Each national resource center shall be a comprehensive 22
347347 training, technical assistance, and resource center created 23
348348 to work toward eliminating the continued discrimination 24
349349 against, isolation of, marginalization of, and denial of ef-25

354354 viduals with significant expressive communication disabil-2
355355 ities, through activities including the priority activities de-3
356356 scribed in section 6. 4

358358 WARDS FOR MULTIPLECENTERS.—The Sec-5
359359 retary shall award the grants for national resource centers 6
360360 in 3 geographically diverse locations, and shall designate 7
361361 one of the centers as the lead administrative center. 8
362362 (c) L
363363 EADADMINISTRATIVECENTER.—The lead ad-9
364364 ministrative center shall coordinate— 10
365365 (1) all activities of the centers; 11
366366 (2) specialization of priorities among the cen-12
367367 ters; 13
368368 (3) dissemination of information among the 14
369369 centers; 15
370370 (4) responses of the centers to the Secretary; 16
371371 and 17
372372 (5) ensuring that the full range of individuals 18
373373 with significant expressive communication disabil-19
374374 ities is served by the centers. 20
375375 (d) A
376376 MOUNT.—The Secretary shall, to the extent 21
377377 practicable, award the 3 grants in amounts that total not 22
378378 more than $9,000,000 per year of a period described in 23
379379 subsection (e). 24

383383 (e) PERIODS.—The Secretary shall award each grant 1
384384 for a period of 5 years, through an open competition held 2
385385 initially and at the end of each 5-year period. An eligible 3
386386 entity that receives a grant under this section may reapply 4
387387 for such a grant at the end of the grant period. 5
388388 SEC. 6. NATIONAL RESOURCE CENTER PRIORITY ACTIVI-6
389389 TIES. 7
390390 The priority activities of a national resource center 8
391391 shall be to— 9
392392 (1) increase access to and effective implementa-10
393393 tion of the full range of augmentative and alter-11
394394 native communication for all individuals with signifi-12
395395 cant expressive communication disabilities in the 13
396396 United States, regardless of age, race, ethnicity, 14
397397 gender, gender identity, LGBTQ+ status, immigra-15
398398 tion status, educational achievement, socioeconomic 16
399399 condition, primary language, nature or severity of 17
400400 disability, location of residence, and age of onset of 18
401401 the significant expressive communication disability; 19
402402 (2) increase the capacity of individuals with sig-20
403403 nificant expressive communication disabilities, edu-21
404404 cators, professional service providers, families, and 22
405405 direct support professionals to support individuals 23
406406 with significant expressive communication disabil-24
407407 ities by creating and disseminating evidence-based 25

412412 ance, and recommended practices in ensuring indi-2
413413 viduals with significant expressive communication 3
414414 disabilities have the tools and other supports nec-4
415415 essary to exercise self-determination and effectively 5
416416 access and participate in all aspects of life, including 6
417417 education, employment, health care, and community 7
418418 living; 8
419419 (3) promote awareness and implementation of 9
420420 the laws, regulations, policies, practices, procedures, 10
421421 and systems that facilitate access to the full range 11
422422 of augmentative and alternative communication and 12
423423 promote equal access and opportunity for individuals 13
424424 with significant expressive communication disabil-14
425425 ities; 15
426426 (4) support and enhance the skills and leader-16
427427 ship of individuals with significant expressive com-17
428428 munication disabilities and their families to advocate 18
429429 for the rights of the individuals to effective commu-19
430430 nication, education, self-determination, access to jus-20
431431 tice, and equal opportunity and participation in all 21
432432 aspects of life; 22
433433 (5) support the improved collection, availability, 23
434434 and dissemination of demographic and characteristic 24
435435 data, with a cross-disability and cross-generational 25

440440 sive communication disabilities in the United States, 2
441441 the barriers the individuals experience to meaningful 3
442442 access to augmentative and alternative communica-4
443443 tion, and the unmet communication support and 5
444444 other needs of this population; and 6
445445 (6) increase societal awareness and knowledge 7
446446 about individuals with significant expressive commu-8
447447 nication disabilities and the importance of, need for, 9
448448 benefits of, and rights to meaningful access to effec-10
449449 tive communication tools and other supports in all 11
450450 aspects of community and life. 12
451451 SEC. 7. APPLICATIONS. 13
452452 (a) I
453453 NGENERAL.—To be qualified to receive a grant 14
454454 under section 5, an eligible entity shall submit an applica-15
455455 tion to the Secretary at such time and in such manner 16
456456 as the Secretary may require. 17
457457 (b) C
458458 ONTENTS.—Each such application from an eligi-18
459459 ble entity shall include, at a minimum, each of the fol-19
460460 lowing: 20
461461 (1) A description of the experience of each part-21
462462 ner organization in the entity in providing training, 22
463463 information, advocacy, and support related to aug-23
464464 mentative and alternative communication and indi-24

474474 cant expressive communication disabilities, to— 7
475475 (A) early intervention specialists; 8
476476 (B) elementary education, secondary edu-9
477477 cation, postsecondary education, and specialized 10
478478 instructional support personnel as defined in 11
479479 section 8101 of the Elementary and Secondary 12
480480 Education Act of 1965 (20 U.S.C. 7801); 13
481481 (C) caregiver groups; 14
482482 (D) providers of home and community- 15
483483 based services for adults; 16
484484 (E) health care providers and educators; 17
