19	19	enter into self-determination contracts with Indian Tribes

22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘SNAP Tribal Food 4
26	26	Sovereignty Act of 2023’’. 5

30	30	SEC. 2. SELF-DETERMINATION FOR SNAP. 1
31	31	Title I of the Indian Self-Determination and Edu-2
32	32	cation Assistance Act (25 U.S.C. 5321 et seq.) is amended 3
33	33	by adding at the end the following: 4
34	34	‘‘SEC. 112. SELF-DETERMINATION FOR SNAP. 5
35	35	‘‘(a) A
36	36	GRICULTURESELF-DETERMINATIONAUTHOR-6
37	37	IZED.—The Secretary of Agriculture shall enter into self- 7
38	38	determination contracts, in accordance with subsection 8
39	39	(b), with Indian Tribes and Tribal organizations, on the 9
40	40	request of any Indian Tribe by Tribal resolution, to plan, 10
41	41	conduct, and administer any function, service, or activity 11
42	42	of the supplemental nutrition assistance program estab-12
43	43	lished under the Food and Nutrition Act of 2008 (7 13
44	44	U.S.C. 2011 et seq.) for the Indian Tribe. 14
45	45	‘‘(b) S
46	46	ELF-DETERMINATIONCONTRACT.—A self-de-15
47	47	termination contract entered into under subsection (a) 16
48	48	shall have the same terms and conditions, and be subject 17
49	49	to the same procedures, regulations, and requirements, as 18
50	50	a self-determination contract entered into under section 19
51	51	102, except that the Secretary of Agriculture and the De-20
52	52	partment of Agriculture shall be the appropriate Secretary 21
53	53	and agency for purposes of a self-determination contract 22
54	54	entered into under subsection (a). 23
55	55	‘‘(c) T
56	56	ECHNICALASSISTANCE.—The Office of Self- 24
57	57	Governance of the Bureau of Indian Affairs shall provide 25

62	62	tracts authorized under this section to— 2
63	63	‘‘(1) the Secretary of Agriculture; and 3
64	64	‘‘(2) Indian Tribes and Tribal organizations 4
65	65	that request that assistance.’’. 5
66	66	SEC. 3. SELF-GOVERNANCE FOR SNAP. 6
67	67	Title IV of the Indian Self-Determination and Edu-7
68	68	cation Assistance Act (25 U.S.C. 5361 et seq.) is amended 8
69	69	by adding at the end the following: 9
70	70	‘‘SEC. 418. SELF-GOVERNANCE FOR SNAP. 10
71	71	‘‘(a) A
72	72	GRICULTURE SELF-GOVERNANCE AUTHOR-11
73	73	IZED.—The Secretary of Agriculture shall enter into self- 12
74	74	governance compacts and funding agreements, in accord-13
75	75	ance with subsection (b), with Indian Tribes and Tribal 14
76	76	organizations, on the request of any Indian Tribe by Trib-15
77	77	al resolution, to plan, conduct, and administer any func-16
78	78	tion, service, or activity of the supplemental nutrition as-17
79	79	sistance program established under the Food and Nutri-18
80	80	tion Act of 2008 (7 U.S.C. 2011 et seq.) for the Indian 19
81	81	Tribe. 20

83	83	ELF-GOVERNANCECOMPACT AND FUNDING 21

85	85	GREEMENT.—A self-governance compact and funding 22
86	86	agreement entered into under subsection (a) shall have the 23
87	87	same terms and conditions, and be subject to the same 24
88	88	procedures, regulations, and requirements, as a self-gov-25

93	93	under sections 40 and 403, except that the Secretary of 2
94	94	Agriculture and the Department of Agriculture shall be 3
95	95	the appropriate Secretary and agency for purposes of a 4
96	96	self-governance compact and funding agreement under 5
97	97	this section. 6
98	98	‘‘(c) T
99	99	ECHNICALASSISTANCE.—The Office of Self- 7
100	100	Governance of the Department of the Interior shall pro-8
101	101	vide technical assistance regarding the self-governance 9
102	102	compacts and funding agreements authorized under this 10
103	103	section to— 11
104	104	‘‘(1) the Secretary of Agriculture; and 12
105	105	‘‘(2) Indian Tribes and Tribal organizations 13
106	106	that request that assistance.’’. 14
