States Reform Act of 2023

Impact

The bill's implementation would have a substantial impact on state laws concerning cannabis. It would allow for the removal of cannabis from the Schedule I classification under the Controlled Substances Act, thus granting states the authority to determine their cannabis policies without federal interference. This autonomy is expected to encourage states to enhance their medical cannabis programs and establish regulatory frameworks that are more responsive to local needs, while also allowing for legitimate cannabis-related businesses to thrive.

Summary

House Bill 6028, titled the States Reform Act of 2023, seeks to amend the Controlled Substances Act by decriminalizing cannabis at the federal level and allowing states to maintain control over their cannabis regulations. The bill proposes a framework for the federal regulation of cannabis, similar to the regulation of alcohol, thereby promoting state autonomy in establishing their own cannabis policies. This change reflects a significant shift in drug policy and seeks to eliminate penalties associated with cannabis for non-violent offenders, thus prioritizing public safety and health considerations.

Contention

Noteworthy points of contention surrounding HB 6028 include concerns raised about public safety and youth access to cannabis. While proponents argue that the decriminalization will reduce the burden on the judicial system and provide economic opportunities, opponents fear that it may lead to increased use among minors and lack of control over product safety. Moreover, the bill addresses the status of veterans who use cannabis for therapeutic purposes, making it illegal to discriminate against them in federal employment based on their cannabis use, a measure welcomed by veterans' advocacy groups but criticized by others who worry about the implications for workplace safety.

Halt All Lethal Trafficking of Fentanyl Act or the HALT Fentanyl Act This bill places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. Additionally, the bill establishes a new, alternative registration process for schedule I research that is funded by the Department of Health and Human Services or the Department of Veterans Affairs or that is conducted under an investigative new drug exemption from the Food and Drug Administration. The bill also makes several other changes to registration requirements for conducting research with controlled substances, including permitting a single registration for related research sites in certain circumstances, waiving the requirement for a new inspection in certain situations, and allowing a registered researcher to perform certain manufacturing activities with small quantities of a substance without obtaining a manufacturing registration.
