29	29	data to the Centers for Disease Control and Prevention,
30	30	and for other purposes.
31	31	Be it enacted by the Senate and House of Representa-1
32	32	tives of the United States of America in Congress assembled, 2
33	33	SECTION 1. SHORT TITLE. 3
34	34	This Act may be cited as the ‘‘Ensuring Accurate and 4
35	35	Complete Abortion Data Reporting Act of 2023’’. 5

39	39	SEC. 2. FINDINGS. 1
40	40	Congress finds the following: 2
41	41	(1) Reporting abortion data has been voluntary 3
42	42	in the past, which has not resulted in complete data 4
43	43	being submitted to the Centers for Disease Control 5
44	44	and Prevention. 6
45	45	(2) While the Centers for Disease Control and 7
46	46	Prevention requests specific data points from each 8
47	47	State and the District of Columbia, there is a great 9
48	48	variety in the information collected and published by 10
49	49	the States. 11
50	50	(3) In fact, there is not a single abortion data 12
51	51	point publicly reported for all fifty States and the 13
52	52	District of Columbia. 14
53	53	(4) Even more alarming, three States that to-15
54	54	gether account for 15 percent of the United States 16
55	55	population of women of childbearing age do not re-17
56	56	port any abortion data to the Centers for Disease 18
57	57	Control and Prevention. 19
58	58	(5) Accurate statistical data regarding abortion 20
59	59	and those who survive abortion attempts is critical 21
60	60	to public health and policy analysis. 22

65	65	NING SERVICES AND SUPPLIES CONTINGENT 2
66	66	ON SUBMISSION OF ABORTION DATA TO CDC. 3
67	67	Section 1903 of the Social Security Act (42 U.S.C. 4
68	68	1396b) is amended— 5
69	69	(1) in subsection (a)(5), by inserting before ‘‘an 6
70	70	amount equal to’’ the following: ‘‘subject to sub-7
71	71	section (cc),’’; and 8
72	72	(2) by adding at the end the following new sub-9
73	73	section: 10
74	74	‘‘(cc) A
75	75	NNUALREPORTS ONABORTIONDATA.— 11
76	76	‘‘(1) I
77	77	N GENERAL.—Subject to paragraph (2), 12
78	78	as a condition of receiving payment under subsection 13
79	79	(a)(5) with respect to any amount expended during 14
80	80	a year (beginning with the year following two years 15
81	81	after the date of the enactment of this subsection) 16
82	82	for family planning services and supplies described 17
83	83	in section 1905(a)(4)(C) furnished to an individual 18
84	84	described in section 1902(ii) or an individual whose 19
85	85	medical assistance under this title is limited to such 20
86	86	services and supplies furnished pursuant to a waiver 21
87	87	granted under section 1115, each State shall, by not 22
88	88	later than December 31 of the previous year, submit 23
89	89	to the abortion surveillance system of the Centers 24
90	90	for Disease Control and Prevention, with respect to 25
91	91	the year before the previous year, at least abortion 26

96	96	section 317W(a)(3)(A) of the Public Health Service 2

99	99	ATE SUBMISSION OF REPORTS .—With re-4
100	100	spect to a year, in the case of a State that does not 5
101	101	submit by December 31 of the previous year the 6
102	102	abortion data required under paragraph (1) with re-7
103	103	spect to the year before the previous year but sub-8
104	104	mits such data by December 31 of the year, such 9
105	105	State shall continue to receive payment, including 10
106	106	retroactive payment, under subsection (a)(5) with 11
107	107	respect to any amount expended during the year for 12
108	108	family planning services and supplies described in 13
109	109	section 1905(a)(4)(C) furnished to an individual de-14
110	110	scribed in such paragraph. 15
111	111	‘‘(3) C
112	112	ERTIFICATION OF ABORTION DATA .— 16
113	113	‘‘(A) I
114	114	N GENERAL.—With respect to each 17
115	115	submission of abortion data under this sub-18
116	116	section, a State shall certify to the Director of 19
117	117	the Centers for Disease Control and Prevention 20
118	118	that such data is accurate. 21
119	119	‘‘(B) F
120	120	ALSE INFORMATION .—In the case 22
121	121	that the Director of the Centers for Disease 23
122	122	Control and Prevention determines that a State 24
123	123	has knowingly provided false information with 25

128	128	this subsection, such State may not receive pay-2
129	129	ment under subsection (a)(5) with respect to 3
130	130	any amount expended during the first full fiscal 4
131	131	year following such determination for family 5
132	132	planning services and supplies described in sec-6
133	133	tion 1905(a)(4)(C) furnished to an individual 7
134	134	described in paragraph (1).’’. 8
135	135	SEC. 4. COLLECTION OF ABORTION DATA BY CDC. 9
136	136	Part B of title III of the Public Health Service Act 10
137	137	(42 U.S.C. 243 et seq.) is amended by inserting after sec-11
138	138	tion 317V of such Act the following: 12
139	139	‘‘SEC. 317W. ABORTION DATA. 13
140	140	‘‘(a) I
141	141	NGENERAL.—The Secretary, acting through 14
142	142	the Director of the Centers for Disease Control and Pre-15
143	143	vention (in this section referred to as the ‘Secretary’)— 16
144	144	‘‘(1) shall maintain a surveillance system to col-17
145	145	lect aggregate data in a standardized format on 18
146	146	abortions in the United States; 19
147	147	‘‘(2) shall, as part of such system, create a 20
148	148	standard worksheet to collect data from States on 21
149	149	abortions in the respective States; 22
150	150	‘‘(3) in such worksheet— 23
151	151	‘‘(A) shall, at a minimum, include ques-24
152	152	tions on the variables listed in subsection (b), to 25

156	156	be treated as mandatory questions for purposes 1
157	157	of section 1903(cc) of the Social Security Act; 2
158	158	and 3
159	159	‘‘(B) may include such additional questions 4
160	160	on abortion as the Secretary determines to be 5
161	161	appropriate, to be treated as voluntary ques-6
162	162	tions; 7
163	163	‘‘(4) shall, as part of such system, allow for 8
164	164	cross-tabulation of the variables listed in subsection 9
165	165	(b), including cross-tabulation of maternal age by 10
166	166	gestational age; race and ethnicity by gestational 11
167	167	age; type of abortion procedure by gestational age; 12
168	168	race and ethnicity by maternal age; and race and 13
169	169	ethnicity by marital status; and 14
170	170	‘‘(5) periodically update the questions in the 15
171	171	worksheet under paragraph (2) and the classification 16
172	172	of such questions as mandatory or voluntary under 17
173	173	paragraph (3). 18
174	174	‘‘(b) V
175	175	ARIABLES.—The variables listed in this sub-19
176	176	section are the following: 20
177	177	‘‘(1) Maternal age in years. 21
178	178	‘‘(2) Gestational age in completed weeks at the 22
179	179	time of abortion. 23
180	180	‘‘(3) Maternal race. 24
181	181	‘‘(4) Maternal ethnicity. 25

186	186	‘‘(6) The abortion method type. 2
187	187	‘‘(7) Maternal marital status. 3
188	188	‘‘(8) Previous pregnancies of the mother, in-4
189	189	cluding the number of previous live births, the num-5
190	190	ber of previous induced abortions, and the number 6
191	191	of previous spontaneous abortions. 7
192	192	‘‘(9) Maternal residence (State or county). 8
193	193	‘‘(10) Whether the child survived the abortion. 9
194	194	‘‘(c) T
195	195	ECHNICALASSISTANCE.—The Secretary shall 10
196	196	provide technical assistance to States to facilitate and im-11
197	197	prove the reporting of data to the system under subsection 12
198	198	(a). 13
199	199	‘‘(d) A
200	200	NNUALREPORTING.—The Secretary shall— 14
201	201	‘‘(1) include, for each calendar year, the data 15
202	202	collected pursuant to this section in a report on 16
203	203	abortion; and 17
204	204	‘‘(2) publish such report not later than Decem-18
205	205	ber 30 of the third calendar year following the cal-19
206	206	endar year covered by the report. 20
207	207	‘‘(e) D
208	208	EFINITIONS.—In this section, the term ‘State’ 21
209	209	refers to the several States, the District of Columbia, and 22
210	210	any territory of the United States.’’. 23
