1420 (a) I
15-NGENERAL.—Beginning on the date that is 90 6
16-days after the date of the enactment of this Act, a foreign- 7
17-produced item shall be subject to the Export Administra-8
18-tion Regulations (pursuant to the Export Control Reform 9
19-Act of 2018 (50 U.S.C. 4801 et seq.)) if the item— 10
20-(1) meets— 11
21-(A) the product scope requirements de-12
22-scribed in subsection (b); and 13
23-(B) the destination scope requirements de-14
24-scribed in subsection (c); and 15
25-(2) is exported, reexported, or in-country trans-16
26-ferred to Iran from abroad or involves the Govern-17
27-ment of Iran. 18
21+NGENERAL.—Beginning on the date that is 120 8
22+days after the date of the enactment of this Act, a foreign- 9
23+produced item shall be subject to the Export Administra-10
24+tion Regulations (pursuant to the Export Control Reform 11
25+Act of 2018 (50 U.S.C. 4801 et seq.)) if the item— 12

30+(A) the product scope requirements de-2
31+scribed in subsection (b); and 3
32+(B) the destination scope requirements de-4
33+scribed in subsection (c); and 5
34+(2) is exported, reexported, or in-country trans-6
35+ferred to Iran or involves persons affiliated with the 7
36+Government of Iran. 8

29-RODUCTSCOPEREQUIREMENTS.—A foreign- 19
30-produced item meets the product scope requirements of 20
31-this subsection if the item— 21
32-(1) is a direct product of United States-origin 22
33-technology or software subject to the Export Admin-23
34-istration Regulations that is specified in a covered 24
35-Export Control Classification Number or is identi-25 3

37-fied in supplement no. 7 to part 746 of the Export 1
38-Administration Regulations; or 2
39-(2) is produced by any plant or major compo-3
40-nent of a plant that is located outside the United 4
41-States, if the plant or major component of a plant, 5
42-whether made in the United States or a foreign 6
43-country, itself is a direct product of United States- 7
44-origin technology or software subject to the Export 8
45-Administration Regulations that is specified in a 9
46-covered Export Control Classification Number. 10
38+RODUCTSCOPEREQUIREMENTS.—A foreign- 9
39+produced item meets the product scope requirements of 10
40+this subsection if the item— 11
41+(1) is a direct product of United States-origin 12
42+technology or software subject to the Export Admin-13
43+istration Regulations that is specified in a covered 14
44+Export Control Classification Number; or 15
45+(2) is produced by any plant or major compo-16
46+nent of a plant that is located outside the United 17
47+States, if the plant or major component of a plant, 18
48+whether made in the United States or a foreign 19
49+country, itself is a direct product of United States- 20
50+origin technology or software subject to the Export 21

49-eign-produced item meets the destination scope require-12
50-ments of this subsection if there is knowledge that the for-13
51-eign-produced item is destined to Iran or will be incor-14
52-porated into or used in the production or development of 15
53-any part, component, or equipment subject to the Export 16
54-Administration Regulations and produced in or destined 17
55-to Iran. 18
54+ESTINATIONSCOPEREQUIREMENTS.—A for-24
55+eign-produced item meets the destination scope require-25

63+Administration Regulations and produced in or destined 5

59-N GENERAL.—A license shall be required 20
60-to export, reexport, or in-country transfer a foreign- 21
61-produced item from abroad that meets the product 22
62-scope requirements described in subsection (b) and 23
63-the destination scope requirements described in sub-24 4

65-section (c) and is subject to the Export Administra-1
66-tion Regulations pursuant to this section. 2
68+N GENERAL.—A license shall be required 8
69+to export, reexport, or in-country transfer a foreign- 9
70+produced item that meets the product scope require-10
71+ments described in subsection (b) and the destina-11
72+tion scope requirements described in subsection (c) 12
73+and is subject to the Export Administration Regula-13
74+tions pursuant to this section. 14

68-XCEPTIONS.—The license requirements of 3
69-paragraph (1) shall not apply to— 4
70-(A) food, medicine, or medical devices that 5
71-are— 6
72-(i) designated as EAR99; or 7
73-(ii) not designated under or listed on 8
74-the Commerce Control List; or 9
75-(B) services, software, or hardware (other 10
76-than services, software, or hardware for end- 11
77-users owned or controlled by the Government of 12
78-Iran) that are— 13
79-(i) necessarily and ordinarily incident 14
80-to communications; or 15
81-(ii) designated as— 16
82-(I) EAR99; or 17
83-(II) Export Control Classification 18
84-Number 5A992.c or 5D992.c, and 19
85-classified in accordance with section 20
86-740.17 of title 15 Code of Federal 21
87-Regulations; and 22
88-(iii) subject to a general license issued 23
89-by the Department of Commerce or De-24
90-partment of Treasury. 25 5

92-(e) NATIONALINTERESTWAIVER.—The Secretary of 1
93-Commerce may waive the requirements imposed under this 2
94-section if the Secretary— 3
95-(1) determines that the waiver is in the national 4
96-interests of the United States; and 5
97-(2) submits to the Committee on Foreign Af-6
98-fairs of the House of Representatives and the Com-7
99-mittee on Banking, Housing, and Urban Affairs of 8
100-the Senate a report explaining which requirements 9
101-are being waived and the reasons for the waiver. 10
102-(f) S
103-UNSET.—The authority provided under this sec-11
104-tion shall terminate on the date that is 7 years after the 12
105-date of the enactment of this Act. 13

107-EFINITIONS.—In this section— 14
108-(1) the term ‘‘Commerce Control List’’ means 15
109-the list maintained pursuant to part 744 of the Ex-16
110-port Administration Regulations; 17
111-(2) the term ‘‘covered Export Control Classi-18
112-fication Number’’ means an Export Control Classi-19
113-fication Number in product group D or E of Cat-20
114-egory 3, 4, 5, 6, 7, 8, or 9 of the Commerce Control 21
115-List; 22
116-(3) the terms ‘‘Export Administration Regula-23
117-tions’’, ‘‘export’’, ‘‘reexport’’, and ‘‘in-country trans-24
118-fer’’ have the meanings given those terms in section 25 6

120-1742 of the Export Control Reform Act of 2018 (50 1
121-U.S.C. 4801); and 2
122-(4) the terms ‘‘direct product’’, ‘‘technology’’, 3
123-‘‘software’’, ‘‘major component’’, ‘‘knowledge’’, ‘‘pro-4
124-duction’’, ‘‘development’’, ‘‘part’’, ‘‘component’’, 5
125-‘‘equipment’’, and ‘‘government end users’’ have the 6
126-meanings given those terms in section 734.9 or part 7
127-772 of the Export Administration Regulations, as 8
128-the case may be. 9
