68-This Act may be cited as ‘‘Sarah’s Law’’. 4
69-SEC. 2. MANDATORY DETENTION OF CERTAIN ALIENS 5
70-CHARGED WITH A CRIME RESULTING IN 6
71-DEATH OR SERIOUS BODILY INJURY. 7
72-Section 236(c) of the Immigration and Nationality Act 8
73-(8 U.S.C. 1226(c)) is amended— 9
74-(1) in paragraph (1)— 10
75-(A) in subparagraph (C)— 11
76-(i) by striking ‘‘sentence’’ and insert-12
77-ing ‘‘sentenced’’; and 13
78-(ii) by striking ‘‘or’’; 14
79-(B) in subparagraph (D), by striking the 15
80-comma at the end and inserting ‘‘, or’’; and 16
81-(C) by inserting after subparagraph (D) the 17
82-following: 18
83-‘‘(E)(i)(I) is inadmissible under paragraph 19
84-(6)(A), (6)(C), or (7) of section 212(a), 20
85-‘‘(II) is deportable under section 21
86-237(a)(1)(B) as an alien whose nonimmigrant 22

50+(A) in subparagraphs (A) and (B), by 9
51+striking the comma at the end of each subpara-10
52+graph and inserting a semicolon; 11
53+(B) in subparagraph (C)— 12
54+(i) by striking ‘‘sentence’’ and insert-13
55+ing ‘‘sentenced’’; and 14
56+(ii) by striking ‘‘, or’’ and inserting a 15
57+semicolon; 16
58+(C) in subparagraph (D), by striking the 17
59+comma at the end and inserting ‘‘; or’’; and 18
60+(D) by inserting after subparagraph (D) 19
61+the following: 20
62+‘‘(E)(i)(I) was not inspected and admitted 21
63+into the United States; 22
64+‘‘(II) held a nonimmigrant visa (or other 23
65+documentation authorizing admission into the 24
66+United States as a nonimmigrant) that has 25
67+been revoked under section 221(i); or 26

73+‘‘(ii) has been charged by a prosecuting au-3
74+thority in the United States with any crime 4
75+that resulted in the death or serious bodily in-5
76+jury (as defined in section 1365(h)(3) of title 6
77+18, United States Code) of another person,’’; 7
78+and 8
79+(2) by adding at the end the following: 9

104-OTIFICATION REQUIREMENT .—Upon en-11
105-countering or gaining knowledge of an alien described 12
106-in paragraph (1), the Secretary of Homeland Secu-13
107-rity shall— 14
108-‘‘(A) obtain information from law enforce-15
109-ment agencies and from other available sources 16
110-regarding the identity of any victims of the 17
111-crimes for which such alien was charged, ar-18
112-rested, or convicted; and 19
113-‘‘(B) provide the victim or, if the victim is 20
114-deceased, a parent, guardian, spouse, or closest 21
115-living relative of such victim, with information, 22
116-on a timely and ongoing basis, including— 23
81+OTIFICATION REQUIREMENT .—Upon en-10
82+countering or gaining knowledge of an alien de-11
83+scribed in paragraph (1), the Assistant Secretary of 12
84+Homeland Security for Immigration and Customs 13
85+Enforcement shall make reasonable efforts— 14
86+‘‘(A) to obtain information from law en-15
87+forcement agencies and from other available 16
88+sources regarding the identity of any victims of 17
89+the crimes for which such alien was charged or 18
90+convicted; and 19
91+‘‘(B) to provide the victim or, if the victim 20
92+is deceased, a parent, guardian, spouse, or clos-21
93+est living relative of such victim, with informa-22
94+tion, on a timely and ongoing basis, including— 23

11896 of birth, and country of nationality; 25

132-Security shall issue a detainer for an alien described 10

134-detained by Federal, State, or local officials, shall ef-12
135-fectively and expeditiously take custody of the alien.’’. 13
136-SEC. 3. SAVINGS PROVISION. 14
137-Nothing in this Act, or the amendments made by this 15
138-Act, may be construed to limit the rights of crime victims 16
139-under any other provision of law, including section 3771 17
140-of title 18, United States Code. 18
